James “Jamie” Maughan died
peacefully in his sleep at home on
September 30, 2021. He was born in
Richmond, Virginia on August 26, 1949
to Matthew Webster Maughan and
Myra Topping Maughan. Jamie grew up
with his two brothers, George and
Webster, in Chester, Virginia, where his family was active in St. John’s
Episcopal Church and the community at large.
Jamie earned his undergraduate degree from Old Dominion University
and went on to obtain his Master ’s Degree from Virginia Tech, where he
also met his wife, Emily. Jamie then completed his PhD in Oceanography
at the University of Rhode Island.
Jamie worked for decades as an environmental scientist working for
Metcalf & Eddy, CH2MHill, and Volpe. His work focused on creating
and maintaining clean water supplies everywhere. He consulted on
projects as varied as town water supplies, clean lakes, the Boston Harbor
clean up, and sustainable clean water systems for indigenous peoples. His
work took him into the field and offices all around the world, where his
innate understanding of how to communicate with people despite
language barriers made him an invaluable asset on every job. After
retirement, he continued to spread his passion for the environment and
protecting it by sharing his knowledge and experience with graduate
students at the Harvard Extension School and the University of
Massachusetts, Lowell.
His work was never limited to just his salaried positions -- he was a
strong believer in volunteering and giving back to the world that he felt
had been so kind to him. He actively volunteered for the Town of
Reading, serving on multiple committees, including the Zoning Board,
Conservation Committee, and as Town Meeting Member. In this way he
was able to contribute his environmental impact lens to all major
decisions.
For years, Jamie volunteered for Bread and Roses, a nonprofit
organization in Lawrence that provides critical services and hot meals for
all who are in need - regardless of legal, residential, or income status. He
never missed his monthly turn in the kitchen, preparing and delivering

meals. He also served as Treasurer on the Bread and Roses Board of
Directors.
In addition to his intellectual and professional pursuits, Jamie was known
for always being on the move, whether building a back deck for his
family to enjoy in the summer and fall, kayaking with his family and
friends across Massachusetts and along the Chesapeake Bay, morning
swims at the YMCA, and routine tennis matches with his friends in
Reading and Winchester. Jamie could spot a snowy egret and great blue
heron from a mile away, identify any species of tree, and could navigate
his way around any river. Jamie was also an avid sports fan, especially
for the New England Patriots and Boston Red Sox.
He willingly and happily adopted anyone into his world -- old and young,
who wanted to make a difference in the lives of other people. His life was
an example to us all, and we should endeavor to live as he did: as a fine
and decent person who cared more about others than himself.
Jamie is survived by his devoted wife, Emily Terry Maughan; daughter
Edwina Leahy, her husband Kevin and their daughter Scarlett of Andover,
MA; and son Matthew Maughan and his wife Marikate of Philadelphia,
PA. He is also survived by his brother, Webster Maughan and his wife
Joy, by his brother George Maughan and his wife Joan; by his sister-in-
law Edwina Forch and her husband Paul; by his brother-in-law Mat Terry
and his wife Candy. He is also survived by numerous nieces, nephews,
godchildren, and dear friends. He knew and loved them all. He will be
sorely missed.

Good Afternoon,
I hope this email finds you well. As requested, I am sending this new inquiry as a follow up
from my December 8 email request to open our location at 323 Main St. at 5am. I
understand it’s been quite a transition for the town over the last several months and I’m
hopeful this request will make it to an agenda soon. I know you have a lot on your plate and
understand from our conversation this afternoon, that this could be as late as July.
As referenced from our conversation, we are looking to open at 5am for many reasons.
Those primarily being for consistency, smooth transitions and to accommodate Reading
residents on their way to work. Whether for just a quick bagel and coffee to larger event
orders that are for such things as hospital staffs, local events, and the like we want to be
able to service the town as needed. As mentioned in our conversation we have either had
to reject orders outright, or beg the customers to go to our locations in
Peabody. Sometimes this goes over well, and other times it does not, to the suffering of
our business, as well as potential tax revenue for the town on our sales.
From 5-6am we consistently have our front lot fill with people waiting until 6 for our store to
open. By allowing us to open at 5am, people could be helped as they come, eliminating
idling cars, and allowing for people to be served greater in a first come first served basis. It
would eliminate confusion of customers from other stores who see Reading is open at 6
and thinking our other locations are the same. It would allow for a smooth transition of
staffing as well since less staff will need to arrive all at the same time. Our other locations
have two to three people who open at five with two more arriving at six and the rest at
seven or eight. In Reading, we are all but fully staffed for 6am to service all the customers
who have been waiting for us to open. In our other locations we are able to manage
expectations of our customers, and add extra staff as needed when we do have those as
we call them “Hosptial” and “5k run” or “event” orders. We would like to be able to add
this value back to Reading, its residents and the surrounding towns, Boston and the south
shore.
Overall, we are looking for Reading residents to start their day in Reading, and continue to
support small business in Reading. We want everyone to start their day on their pace, get
safely to work and do it over a fresh cup of coffee and a bagel or two.
As discussed, we know the topic of the drive thru will be one of concern. Not all of our
locations have a drive thru, but even so, even in the locations where we do, it is primarily
foot traffic in that opening hour.
This request does not specifically seek to open the drive thru at 5am, rather we seek
to allow customers to come INSIDE the store, get their bagels and coffee and go about
their morning. If however, our neighbors and the board were open to the idea of the drive
thru being open at any time prior to 6am, we do have safeguards in place to minimize any
disruption to our neighbors. Our menu board can be adjusted to lower the volume of the
speaker, and as is consistent with our other locations, larger orders and event orders are
only available for pick up in store only. This is not part of our request but would not be
opposed if the neighbors or board found it of value to consider.
We humbly request to open (the front) of our store at 5am and hope that it will be
determined to be a public convenience that will not disrupt our residential neighbors. We
hope to instead create consistency with our business, ADD value to the town financially
through sales, but mostly connect to the character of the small town pace experience.

Why is this Committee needed?
●Reading Select Board made a proclamation on August 9, 2022 to honor Bill Russell
●Nearly 2 years have passed and no progress has been made
●Last spring former SB Chair Jackie McCarthy and former Town Manager Fidel Maltez both
recommended to Cato that a Select Board Ad Hoc Committee be formed
●Town of Reading has the responsibility to follow through with the proclamation
●Ad Hoc Committee will allow residents to work with the town to explore potential options and
make a recommendation
●A “Bill Russell Day” is about acknowledging the past, honoring Bill Russell as an athlete and civil
rights activist, and continuing education on the importance of civil rights
What will the Committee do?
●Acknowledge and express accountability for the mistreatment of Bill Russell and his family
●Identify potential options for an initial launch and enable the town to continue education on the
causes he promoted:
○Civil rights, equity, justice, inclusion, and sportsmanship
●Collect information and insights from town resources and residents to ensure that the
commemoration day addresses the priorities and values that Bill Russell espoused and by which he
lived.
●Determine potential funding mechanisms to allow for programming to continue annually
●Honor Bill Russell’s legacy by striving to create the vision of an inclusive, equitable, and welcoming
community.
Who will be on the Committee?
●Select Board member or designee
●Designee of the Office of Equity and Social Justice
●Employee of Reading Police Department
●Two Reading residents
●Resident student appointed by the School Committee
●Member of CATO - The Coalition of Us
●School Committee Member or designee

Russell Family Involvement
●Recognize the Russell family has no responsibility to the Town or obligation to participate
●A reasonable effort will be made to contact the Russell family to inform them of the Committee, it’s
purpose, and its deliverables.
●The Committee’s decisions are not contingent upon the family’s participation or approval
●No committee with the name of Bill Russell embedded can raise funds without the permission of
Bill Russell’s estate.
●CATO was advised to wait to involve the family until some plan or options were formed
Ad-Hoc Committee Deliverables
1.Provide the Select Board with a report exploring the best ways for the Town to acknowledge and
express accountability for the mistreatment experienced by the Russell Family as well as current
day challenges for minorities in town.
2.Orchestrate and execute the inaugural program, leveraging insights gleaned from the event as a
foundation to inform and shape subsequent programming.
3.Submit multiple options for program recommendations with rationale and suggestions for
funding mechanisms to the Select Board within 12 months of conception, unless otherwise
approved by the Select Board.
4.Work with the Town Manager to transfer all information and responsibilities to the town
department/leadership that will ensure the continuation of the annual program after the
Committee’s sunset.
Conclusion
●The Town has the responsibility to follow through on the August 9, 2022 proclamation
●Ad Hoc Committee moves forward with honoring Bill Russell, allowing residents to work with town
staff to determine programming options
●The goal is to enable an annual event that promotes ongoing education and action that supports
the vision of an inclusive and welcoming community
●Ad-Hoc Committee will do the legwork for the Select Board to move forward annually with
honoring the proclamation
Ad Hoc Commemoration Establishment Committee
This is the Charge for the Ad Hoc Committee to be approved by the Select Board of Reading,
Massachusetts.
Authority The Ad Hoc Commemoration Establishment Committee (ACE)is an Ad
Hoc Committee under the jurisdiction of the Reading Select Board.
Membership ACE will be comprised of at least seven (7)diverse Reading Residents as
follows:
●1 Select Board Member or designee (ex-officio,appointed by
the Select Board)
●1 Designee of Office of Equity and Social Justice (appointed
by the Director of the OESJ)
●1 Employee of the Reading Police Department (ex-officio,
appointed by the Civil Rights Officer)
●2 Reading residents (appointed by the Select Board)
●1 Resident student currently enrolled in a school,public or
private,funded or partially funded by Reading,in Grades 9-12
(appointed by the School Committee)
●1 Coalition of Us (CATO)Member or designee (appointed by
CATO)
●1 School Committee Member or designee (ex-officio,
appointed by the School Committee)
●1 Council of Aging Member or designee,with preference to
someone who may have been in town during Russell’s tenure
(appointed by the Council of Aging)
●1 Designee of the Reading Public Library and Board of
Library Trustees (appointed by BOLT)
Associate Membership:3 Associate Members,appointed by the Select Board.
Section 3.3.1.6 of the General Bylaw shall apply to the actions of all
associates.Four (4)members must be present for quorum.

In order to help the Committee carry out its purpose,the Select Board hopes
that the following community leaders will lend their professional guidance
and advice to the Committee.

Meetings may rely upon administrative support provided by Town Hall staff
in some cases but not all i.e.scheduling and posting meetings,taking or
processing minutes,etc.
Purpose The purpose of this committee is to provide the Reading Select Board with
recommendations on the best ways to implement the below listed items:
●Develop a long-term action plan to implement the Select Board’s
proclamation presented on August 9,2022,as shown in Exhibit A.
●Acknowledge and express accountability for the mistreatment of Bill
Russell and his family.
●Establish the funding and infrastructure for the long-term action plan.
●Identify barriers to participation,engagement,and representation for
Black and brown people in all aspects of Reading life.
●Honor Bill Russell's legacy by striving to create the vision of an
inclusive,equitable,and welcoming community.
The larger purpose of this committee is to launch an annual commemoration
of Bill Russell that educates about and builds on the understanding of Bill
Russell’s vision and nurtures his legacy of improved civil rights in Reading,
making Reading a place that Black and brown people feel a sense of
belonging and are empowered to engage within the community.
This day does not need to be called ‘The Bill Russell Day’,as that is not what
he necessarily would have preferred.Rather it should focus on and educate
about the causes he promoted:civil rights,equity,justice,inclusion,and
sportsmanship.
Committee Action Plan:ACE will hold regular meetings (at least monthly)
and actively seek community engagement to develop an action plan that
learns from,educates about,and commemorates Bill Russell’s legacy with the
Reading community on an ongoing basis,ACE shall utilize all available
resources to:
●Research Bill Russell’s history.
●Gather input from the Committee’s members,Reading residents,and
other information from local DEI related surveys.
●Explore ways in which the town can acknowledge and express
accountability for the mistreatment of Bill Russell and his family.
●Invite members of historically marginalized communities to share
their stories to better inform Committee and community decisions.
●Collect and archive these stories with the goal of developing or adding
to a database to share these stories with others in the community.
●Encourage relationships between town administration,departments,
and organizations that will promote,collaborate,and implement the
plans recommended by this committee.
●Gather,analyze,and organize information for future planning
decisions and the best practices related to events,programs,and
activities that promote equity,inclusion,and ensure a welcoming
community.
●Research and recommend a structural framework for long-term
planning to annually honor and promote the civil rights values
advocated and exemplified by Bill Russell.
●Plan and hold at least one community-wide event,program,or activity
to launch the annual program.
●Research options for establishing an ongoing town funding source that
will ensure continuity for this annual program.
●ACE will work with the Town Manager to transfer the information
and responsibilities to a town administrator after the Committee’s
sunset.
The Committee shall consider the following:
●Black and brown voices in the choice of recommendation.
●Ways to engage as many residents as possible,in both the planning
and programming.
●Listen to and consider the concerns and ideas of all residents,
administration,and volunteers.
●Using public funds and grants to ensure the continuity of the
recommendations.
●If possible,establish contact with the Russell family to inform them of
ACE,its purposes,and any related future programming.
●If ACE and future planners aspire to use Bill Russell’s name in the
title of their recommended plan,the Committee will attempt to obtain
permission and invite the Russell family to programming.
●Committee members are encouraged to attend future Cato
Conversations.
Role of the
Russell Family
Recognizing that the Russell family has no responsibility to the Town or
obligation to participate or reply,the expectation is that reasonable effort will
be made to contact the Russell family and to inform the family of the
Committee’s purpose and its deliverables.The Committee’s decisions are not
contingent upon the family’s participation or approval,however it is the hope
that the family will recognize the goals and intent of this Committee to
promote equity and inclusion in Reading as part of Bill Russell’s legacy.
No committee with the name of Bill Russell embedded can raise funds
without the permission of Bill Russell’s estate.
Deliverable The Committee’s deliverables shall include,but not be limited to,the
following:
1.Report to the Select Board every 2 months on the progress of the
Committee until goals are reached.
2.Provide the Select Board with a report exploring the best way for the
Town to acknowledge and express accountability for the mistreatment
experienced by the Russell Family.
3.Orchestrate and execute the inaugural program.
4.Debrief and use insights gleaned from the event as a foundation to
inform and shape subsequent programming.
5.Submit multiple options for annual program recommendations with
rationale along with suggestions for funding mechanisms to the Select
Board within 12 months of the start of the ad hoc committee,unless
another date is agreed upon by the Select Board.
6.Work with the Town Manager to transfer all information and
responsibilities to the town department/administrator that will ensure
the continuation of the annual program before the ACE Committee
sunsets.
Sunset The expectation of the ACE Committee is that the specified action items
outlined above will be completed within a twelve (12)month period.
Accordingly,the Committee shall sunset 12 months from vote date but may
be extended by Select Board vote.

I apologize for the late response. I have been traveling extensively for work. At the
May 22, 2024, Town Forest Committee (TFC) meeting I informed Chairman Bill
Sullivan that due to work constraints, I would be unable to apply for re-appointment to
the Town Forest Committee. Due to the multiple vacancies on the Town Forest
Committee, Bill Sullivan asked if I would reconsider my decision. Currently I am a
Full Member of the TFC. Bill Sullivan asked me if would entertain seeking
reappointment as an Associate Member of the TFC. By doing so it would allow me to
continue to be a member of the TFC and also provide the needed flexibility to balance
the responsibilities of my job.
I have considered Bill Sullivan's proposal and will agree to seek reappointment as an
Associate Member of the Town Forest Committee. Please provide any instruction
that will allow for my reappointment as an Associate member instead of a Full
member of the TFC.

Retired Professional Civil Engineer with 45 years of experience. Career experience primarily consisted of providing consulting
engineering services to public agencies and municipalities in Massachusetts. Main technical focus was in the areas of traffic /
transportation. Also, have experience overseeing projects involving water distribution and sewer collection systems, drainage,
landscape architecture and other various technical disciplines within the civil engineering field.
Hometown is Arlington, MA, where I was involved in various committees over the years. These included: Project Specific
School Building Committees, Field Inventory/Use Review Committee, and Consultant Selection Committees. I also served 25
years on the Capital Planning Committee, which reviewed and evaluated capital requests from various Town departments and

Over the last few School Committee Meetings, the School Committee has heard nominations to name portions
of the athletic facilities after two long-time staff members, Phil Vaccaro (May 9th, 2024) and Charlie Hardy (May
23rd, 2024). During our meeting on the 6th of June, we discussed these nominations, voted to refer them to an
Advisory Committee, per our policy, and voted on the constituents and charge of that committee. The details of
the committee constituents and the charge are outlined below.
The advisory committee makeup will be:

Additionally, below is the charge for the advisory committee in alignment with Section 6 of School Committee
Policy BDF:
Length of Service: Through November 2024.
Assignment: Consider the nomination to name the Gymnasium inside Hawkes Field House after Phil
Vacarro and Turf 2 after Charlie Hardy in alignment with Sections A and B of Policy FF of the Reading
School Committee. Those sections are:
A. A person, living or deceased, for whom a public school may be named or a room or area of a
school campus dedicated, must have made significant contributions to education in the
Reading Public Schools. Evidence of such contributions may include, but are not limited to,
the following:
a. Extraordinarily effective and dedicated service to and/or on behalf of the youth in
the Reading Public Schools.
b. Persistent efforts to sustain a quality system of public education for all youth and to
improve programs and services for them.
c. Demonstrated understanding of the essential nature of public education in the
perpetuation of our democratic form of government.
B. The nominee must otherwise be worthy of the honor of having a school named for him/her or a
room or area dedicated to him/her. Evidence of such attributes should include, but are not
limited to, the following:
a. Superior levels of performance in strengthening and supporting the public schools.
b. Effective citizenship
c. Community service
d. Excellent character and general reputation
e. High standards of ethics
As part of the consideration, execute appropriate research and gather necessary public feedback
and input to form a recommendation for the School Committee for this topic.
Resources: The Committee, through its work with the Administration, shall aid with meeting notices
and meeting locations. Additionally, the Committee will provide all letters of support or other such
materials it receives which will enable the advisory committee to assess community support and
alignment with Sections A and B of Policy FF.
Dates for Major Reports: The Committee wishes to receive the final recommendation by the end of
November 2024 at a yet-to-be-scheduled regular School Committee meeting.
Governing Policies: It is recommended that the advisory committee leverage the following policies
throughout their process:
Policy BEDH – Public Comment at School Committee Meetings
Policy JIB – Student Involvement in Decision Making
Policy KDB – Community Involvement in Decision Making
Additionally, it is required that the advisory committee operate in compliance with MGL 30A:18-25
(Open Meeting Law).
Press Releases: The advisory committee shall not provide a press release and defer all press
inquiries to the School Committee via the School Committee Chair.
I am sharing this with you as we would like the Select Board to vote on a member to join this committee
over the next five to six months during your next meeting, or soon after that so that the committee can get
started on their work.

Re: May 17, 2024, Open Meeting Law Complaint
Dear Mr. Dewar:
On May 17, 2024, you filed an Open Meeting Law (“OML”) Complaint against the
Reading Select Board (“Board”) alleging that the Board violated the OML on February 3, 2024
when Karen Herrick discussed the appointment of a new Town Manager with the husband of
then Select Board member Jacqueline McCarthy.1 As outlined below, on June 4, a majority of the
Select Board voted in favor of finding that a violation of the OML occurred. In response to this
violation, the Board commits itself to future compliance with the law. A copy of your Complaint
is attached to this response.
I. Relevant Facts
On April 22, 2024, former Select Board member McCarthy submitted a “Letter to the
Editor” to local news outlets. In her letter, Ms. McCarthy stated:
I took our need to hire a new Town Manager seriously. I spent a significant
amount of time assessing our options. My goal was to arrive at a unanimous
vote among our closely divided Board. (Regrettably, by speaking
individually with Mark Dockser, and then with Carlo Bacci, the Open
Meeting Law (OML) may have been violated). I shared this information
with my husband, who on February 3 shared this information with my
former colleague and friend Karen Herrick. My choice for Town Manager
was not the same as Ms. Herrick’s.
Your Complaint alleges that this conversation between Ms. Herrick and Mark Delaney, Ms.
McCarthy’s husband, resulted in a violation of the Open Meeting Law.
The Board met in executive session on June 4, 2024 to review your Complaint. During its
discussion, the Board was unable to come to a consensus on the facts surrounding Ms. Herrick’s
conversation with Mr. Delaney.

II.Board’s Response and Remedies
While the Board could not come to an agreement on the facts surrounding the incident in
question, a majority of the Board voted to find that a violation of the Open Meeting Law
occurred.
The Board also voted to allow Ms. Herrick to issue a statement in response to the
Complaint and to attach her statement to the Board’s official response. A copy of her statement is
therefore attached to this letter. Please note that this statement does not reflect the position of the
Board, nor is it endorsed by the Board.
To remedy this violation, the Board will (1) post its response on the Town’s website as
part of the Board’s next meeting packet and (2) commit to future compliance with the OML. The
Board also discussed the importance of being cautious when speaking with the spouses of other
members about matters within the Board’s jurisdiction.
The Board appreciates you bringing this matter forward and will take all steps necessary
to ensure continued compliance with the law.

This addendum is my statement in response to your Open Meeting Law complaint and the Reading
Select Board vote on the matter.
I have been on friendly terms with Jackie McCarthy and Mark Delaney since before Jackie joined the
SB. I first met them on Auburn St to better understand their concerns about the water tower project
and Mark Delaney was part of my campaign team two years ago. I am a Licensed Realtor in MA and
FL and serve as a MAR State Political Coordinator. We regularly chat about our families, our work
with MAR (Massachusetts Association of Realtors), pending state legislation as well as local politics,
Town Meeting, hobbies,…etc.
Mark Delaney texted me twice on Saturday Feb 3 asking about my trip to Naples, FL and wanting to
talk. We connected later that afternoon.
After initial hellos - Mark Delaney announced, “I think we have consensus!”
I responded with, “Consensus on what - what are you talking about?”
Mark Delaney said, “Chris and Carlo are leaning toward Matt K and now that Jackie has spent lots of
time talking to staff she is too.”
When I asked how Mark could know this, he said, “Carlo (Bacci) called Jackie and blurted out that he
and Chris were voting for Matt K. before Jackie could tell him to stop talking.”
I noted that it was possibly an opening meeting law violation if Jackie and Mark Dockser had also
spoken about the town manager selection as they were members of the search committee.
The remaining parts of our conversation were about Mark Delaney’s thoughts on our next Town
Manager as well as mine. I believe we also chatted about golf.
I did not speak to any Select Board member about the Town Manager Selection vote and I never
shared the details of what I had learned in this call with another Select Board member.
I was not informed that Chair Bacci was inviting members of the public to our OML discussion and
executive session nor was this published in our packet or detailed in the related agenda item of June
4, 2024.
I requested the Select Board conduct this discussion with a member of the public in Open Session
and this request was denied.
Mr Delaney, a private resident, was asked by Chair Bacci if I had ever threatened Ms McCarthy. He
answered, “no.”
Mr Delaney was asked if he believed that there was intent to commit serial communication during our
February 3 phone call. He answered, “no.”
Town Counsel, Ivria Fried, emailed the Select Board on 2/7/2024 and asked that the two Select Board
members involved in the potential violation contact her. I assumed that Carlo Bacci and Mark
Dockser would be reaching out to Town Counsel and disclosing the full extent of their conversations
with other Select Board members. I never spoke to any other Select Board members about the Town
Manager selection vote. Ms McCarthy to the best of my knowledge was not present during my
conversation with Mr, Delaney on 2/7/2024, but Mr Delaney did at the end of our conversation
mention her arrival and state that he needed to conclude our discussion.
In this statement, I can relay only what I was personally told. I was not present for the discussion
between Carlo Bacci and Ms McCarthy nor was I present for the discussion between Carlo Bacci and
Chris Haley regarding the Town Manager Selection vote.
