Present at this executive session are the following individuals Joseph R. Veno, Chairman Thomas A. Clough, Vice Chairman Carol B. Roberts David A. Gentile Colleen Loughlin, Retirement Board Administrator Elaine Kelly, Assistant Retirement Board Administrator Michael Sacco, Attorney for the Reading Retirement Board Laura Bullis, Police Officer and Member of the Reading Retirement System Mark Segalla, Police Chief who fried the Involuntary Accidental Disability Application David Clark, Deputy Police Chief The hearing was recorded and is considered to be a part of the minutes. The records used and reviewed for this hearing were Police Chief Mark Segalla's Involuntary Application for Accidental Disability Retirement, the Employer's Statement and the medical records obtained relating to the disability claim. Chief Segalla appeared and testified as to the reason he filed an involuntary accidental disability retirement. During an in-service, mandated training on March 24, 2016, Officer Laura Bullis injured her shoulder during a defensive tactic exercise. She filed an injury report and going on 18 months in which Officer Bullis is unable to perform the essential functions of a police officer. There is no light duty long term and no other position available to her with her limitations. Officer Laura Bullis gave a testimony of what happened, discussed her symptoms, and what treatments she is undergoing. Ms. Bullis explained that she still has limited range of motion after surgery and has not made progress after physical therapy. The Board's Attorney Michael Sacco recommended that the Board forward the application to a medical panel. • CAROL ROBERTS moved to request a medical panel for Laura Bullis. Lisa Palermo v. Andover Small Eneine Service. Inc. Attorney Michael Sacco had a discussion regarding Lisa Palermo's case v. Andover Small Engine Service, Inc. Lisa Palermo is an Accidental Disability retiree that went out for disability when she was working as a Firefighter and injured her shoulder when she was picking up a generator that was extremely heavy. Lisa is suing the Andover Small Engine Service, Inc. for negligence. The reason the Board is involved when anyone who is injured as a result of the negligence of a third party and receives an accidental disability, the Board is required to offset the accidental disability allowance against any amount the member receives for lost wages. Attorney Sacco reminded the Board that the Board has a statutory right of offset pursuant to M.G.L. c. 32, § 14A with respect to any settlement or judgement amount attributable to wages relating to the same injury for which Ms. Palermo is receiving a disability retirement. Attorney Sacco is in receipt of a letter from Attorney J. Michael Conley requesting the Board's position on litigation. Attorney Sacco suggested a range from 10.200/. of a settlement. The Board could not determine if they should take a percentage or wait and see whatthe breakout is on the settlement so Attorney Sacco will request a copy of the complaint and let Attorney Conley know that the Board is not in a position to make a decision now. Once Michael receives the complaint, he will submit a recommendation to the Board. • CAROL ROBERTS moved to adjourn to open session.
