Mr. Chris Cridler stated that he and Mr. Anthony Silva both have children who attend the same school and they both confirmed that neither of them has had any conversation about the project. Mr. Anthony Silva briefly explained his project using a sideshow. He stated that that it's a legal one story with two bedrooms which they are looking to expand the home which also has Conservation restrictions. They would not be creating any new non -conformity. Mr. Chris Cridler asked Mr. Bret Bennett for clarification on whether the applicant was here for a Variance or a Special Permit. Mr. Bret Bennett stated that he wrote it up as a Variance due to the fact that voluntary demolition and reconstruction you need to use the existing foot print or meet the setbacks. The applicants project would be decreasing the non -conformity but they would not be using the same exact footprint. Mr. Patrick Houghton asked what the front yard setback was changing to. Mr. Anthony Silva stated the set back was going from 4.5' to 6.5' but 2V is what is required. Mr. Anthony Silva stated that his project does not change the neighborhood as his neighbors' setbacks are all pretty similar. He then briefly went through his Variance Criteria. Mr. Cy Caouette mentioned that he is wondering if the Board needs to approve this as a Variance based on the language of the bylaw section 7.4. Mr. Andrew Grasberger also agreed with Mr. Cy Caouette. Page I I Mr. Andrew MacNichoI stated from the staff standpoint its viewed as a voluntary demolition and anew non -conformity, thus requiring a Variance. Mr. Andrew Grasberger opened and closed public comments there was no one from the public in attendance. Chris Cridler made a motion to grant a Variance for Case 823-15-15 Temple Street. Cy Caouette seconded the motion and it was approved 4-0-0. Vote was 4-0-0 (Hartman, Houghton, Grasberger, Caouette, Cridler) Chris Cridler made a motion to grant a Special Permit for Case 823-15 —15 Temple Street. Cy Caouette seconded the motion and it was approved 4-0-0. Vote was 4-0-0 (Houghton, Grasberger, Caouette, Cridler) ZBA Minutes 10/18/22 Cy Caouette made a motion to accept the minutes. Patrick Houghton seconded the motion and it was approved 4-". Vote was 4-0-0 (, Houghton, Grasberger, Caouette, Cridler) ZBA Minutes 1/31/23 Cy Caouette made a motion to accept the minutes. Chris Cridler seconded the motion and it was approved 4-0-0. Vote was 4-0-0 (Houghton, Grosberger, Caouette, Cridler) ZBA Minutes 4/25/23 Chris Cridler made a motion to accept the minutes. Cy Caouette seconded the motion and it was approved 4-0-0. Vote was 4-0-0 (Houghton, Grasberger, Caouette, Cridler) Mr. Andrew MacNichol and the Board Members had a brief discussion about 2024 ZBA Meeting Schedule. Chris Cridler made a motion to Adjourn the meeting at 7:26 PM. Patrick Houghton seconded the motion. Page 1 2
