The proposed aznendment would annul Article 49 of [he Ar[icles of Amendment to
the Constiiution and substitute a new amendment which declares that the people have
the right to clean aix and water, freedom from excessive and onnecessary noise, and
the natural, scenic, historic and esthetic qualities of their environment. It further
declaxes [hat the protection of the righ[ to the mnservation� development and u[il-
ization of [he agricultaral, mineral, forest� water, air and other natuxal resources
is a public purpose.
The Legislatuxe is authorized to adopt necessary legislation and to provide
foz eminent domain takings where requit'ed for the purposes of the amendment. Any
property so taken may only be used for other purposes or disposed of upon a two-thixds
vote of the Ligislature.

below, which was approved by [he General Court in a joint session of the two branches
held duly 2, 1969, received 204 vo[es in the affirmative and 49 in [he negative, and
in a joint session of the two branches held May 12, 1971, received 245 votes in
the affixmative and 20 in the negative?

The proposed amendmwt would authorize, bu[ not require, the Legislature [o
modify the Massachusetts income tax laws by the use of graduated raies instead of
the present flat or anifotm rates. The Legisla[ure could do this in any one of three
ways:
l. Apply a uniform cate or percentage to an individual's federal income
tax liability; on
2, AppLy graduated ca[es to an individual's federal taxable income; or
3. Apply graduated nates to income de[ermined io be taxable under
Massachusetts Law.
The Legislature would aLso be authorized io provide for xeasonable exemptions,
deductions and abatesents and make the definition of any term used in the state ffix
1aw automatically the same as it is undec Federal Law.
