ES NO 111� Town Warrant State Election November 3, 1970 � SUMMF�RY The nroposed amendment to the Co�stitution abolishes the require- ment that in order to vote in a state election a person must have re- sided within the Commonwealth one year. If zmended, the Constitution would require only that a voter have resided six months in the too» or district in which he claims a right to vote. QUESTION NO. 3 PROPOSED AMENDMENT TO THE CONSTITUTION Do you approve o£ the adoption of an amendme-�.t to the constitution summarized below, which was approved by the General Court in a joint � session of the two branches held October 9, 1967, received 142 votes in the affirmative and 102 in the neqative, and in a joint se^,sion of the two branches held May 14, 1969, received 222 votes in the affirmative and 49 in the negative? YES SUPIMARY N� The proposed amendment to the Constitution amends the existin� con- ' stitutional provisions which direct the division of the Commonwealth � '! into 240 representative districts and 40 senatorial districts. It pro- � vides for census of the inhabitants of each city and town in the Common- orealth in the year 1971 a�d in every tenth year thereafter. The census in 1971 is to be the basis for determining the representative and senator- ial districts for the ten-year period beqinning January 1 , 1975. Each subsequent census shall be the ba,is for determining the districts for each ten-year period beginning the fourth January following each census , so that the census in 1981 will determine the districts as of January, 1965 , etc. The amendment provides that the house of representatives shall con- sist of t�a^ hundred and forty members and the senate of forty members. In its��first regular session following each census, the Legislsture shall divide the Commonwealth into two hundred and forty representztive districts of contiguous territory and forty senatorial districts also of contiguous territory. Each representative district shall contain, zs nearly as may be, an eqaal number of inhabitants according to the census. Each senatorizl district shall also contain ��s nearly as may be an equal number o£ inhabitants accordinq to the census. A representative dis- trict shall not unite two or more counties , towns, or cities, or parts � thereof, or a city and a town, or parts thereo£, in one district unless the same is unavoidable. FUrther, no town of less than six thousand inhabitants shall be divided in forming representative districts . It is also provided that the County of Dukes County and Nantucket County shall each be a representative district, not�vithstanding the foregoing. � The senatorial districts, each of which shall elect one Senator, shall be £ormed withoUt uniting t�ao counties or parts of two or more counties, �nless the same is una¢oidable. Each representative shall be an inhabitant of the district for which he is chosen at least one year immediately preceding his election, and each senator shall be an inhabitant of the district for which he is chosen at the time of his election and shall have been an inhzbitant of� nf the Commonwealth for at least five years immediately preceding ' his election. Fany representative or senator who ceases to be an inhabi- I tant of the Commonwealth shall cease to represent his district. �� To�vn Warrant State Llection November 3, 1970� ��j The amendment also provides that the Legislature (1) may by law limit the time within which judicial proceedings may be instituted call- inq in questio❑ any such division and ( 2) shall prescribe by law the manner of calling and condacting elections for the choice of represent- atives and of ascertaining their election. Finally, the ame�dment annuls the existing co�stitutional provisions with respect to apportionment o£ representative and senatorial districts, althouah those provisions will remain in effect until January 1, 1975. Grammer, Sr. Constable of Readinq STATE ELECTION � November 3, 1970 Pursuant to the Warrant and the Constable' s Return thereon, a State Election was held at the time and places specified in the War- rznt and was called to order by the Wardens in the orecinets as follows: Precinct 1 Pearl Street School John F. Cronin Precinct 2 Joshua Eaton School Joseph P. Reimer Precinct 3 Community Center Herbert F. Gent, Jr. Precinct 4 Memorial High School C. Dewey Smith who then partially read the warrant, when on motion of Russell H. Stone, Jr. , Precinct 1; John H. Crooker, Precinct 2; Florence E. Cempbell , Precinct 3; Margaret C. Hubbard, Precinct 4, it was voted to dispense with the further reading of the Warrant, except the Constable' s Return, which i,�as then read by the Wardens in charge. The ballot boxes were examined by the Wardens in charge and each found to be empty and all r.egistered 000. The polls �vere then declzred open at 7:00 �. M. and were closed at 6: 00 P. hi. with the folloo�ing results: Whole number of votes cast 9,063. � ,
