MassDOT and HSH met yesterday to test-run using GoToWebinar to record the audio for the presentation. We’ll likely use this platform for future virtual meetings. Once Andy records the presentation with audio (sometime 2 this week), it will be transcribed and posted to the project website. We aim to get this on the project website by the end of this week or early next week. 3. Road signs are going up today on Main Street. 4. Overnight work and lane closures will take place next week to install temporary pavement markings. A project advisory has been approved by MassDOT Comms and they will post it on their Twitter account this week: https://bit.ly/2UQ0s7A. Better, a direct public comment period should be made available, even if limited given COVID-19. Perhaps those who speak can be selected by a lottery conducted by Town Clerk and Town Counsel? I hope these questions will be answered tonight during the meeting. First, I would like to know exactly how the first notification was made to Ms Alvarado, which should includes the date, method, and person making the notification. I would also like to know who objected to the notification, why it was deemed necessary to do the notification again, and why the wording was changed to make it appear as though the first notification did not take place. I would also like to know specifically how the first notification did not meet the Town Charter. All these facts should be readily available to taxpayers in town. Second, I was completely appalled to see that several hundred taxpayers in this town have had their integrity questioned, as their signatures have been considered invalid because of supposed fraudulent activity. I know of a few people who signed in my presence, and I also noticed many others who told me they signed. How can something like that happen without any proof? I am reaching out to those individuals on the list that I personally know to make them aware, and I am sure that many will be in contact with the board of Registrars to let them know of the legitimacy of their signatures. I also noticed many first responders on the list, whether it be law enforcement or medical personnel, and to think that these people need to take any time out of their very limited time during this pandemic to prove they are not engaged in unlawful behavior is an absolute disgrace. I hope you all, as well as your families and loved ones, are staying healthy during this pandemic. Personally, I have been doing checks on neighbors, making large quantities of masks to help protect my friends who are directly working with Covid 19 patients, and trying to keep my medically-fragile daughter safe from catching the virus. I hope I will be allowed in on the call. My email is listed above. In addition, regarding the topic of the meeting, I am very troubled by many of the allegations made in the response to the recall petition. In particular, one concern is about the allegation that many signatures are allegedly invalid because they supposedly are “illegible”, allegedly “do not match” voter affidavit cards, and/or that the signatures allegedly were not personally made by individuals. These are very serious allegations being made here, including allegations at the very least that possibly multiple people have allegedly violated one or more Massachusetts General Laws, such as MGL Ch. 53 section 7 (as the response specifically states). The response does not, however, provide any actual proof of these allegations, and I hope the Reading Board of Registrars, who certified these signatures as valid, demands actual proof from Ms. Alvarado and her attorney of each and every allegation made in this response regarding grounds for declaring ANY signature to be invalid. A mere statement that a signature is “illegible” s eems subjective as does the allegation that signatures do not “match”. I do not see any indication that any certified handwriting expert has analyzed the signatures and come to such conclusions. Thus, it becomes a comparison of the presumption of validity after review by multiple members of the Reading Board of Registrars, whose job it is to do this all the time, vs. a subjective allegation of invalidity by Ms. Alvara do and/or her counsel. Perhaps those whose very signatures are being challenged will dir ectly notify you once they learn of this to affirm that yes, indeed, that is their valid signature. But, it seems that there is a troubling lack of any proof of this allegation. Shouldn’t the response have provided direct side by side comparisons of each signature that is being alleged to not match the voter affidavit and/or to allegedly be “illegible”? The burden of proof would seem to be on the party making the allegation. The allegation in connection with Appendix F is particularly troubling to me, wherein the response states “This Appendix F is divided into groups of signatures that one voter signed for other voters. In each of these groups, the voter who signed in person, signature, should be counted, but the other 2 signature(s) in the group should not be counted.” How does Ms. Alvarado or her attorney know this to be factual for each and every allegation they have made (and the response contains approximately 160 different groups of two or more individuals where this is alleged that “one voter” signed)? Were either of them there at the time of the signing in each and every case? Have they taken any statements from any witnesses who observed alleged acts of signing for others? No proof of any of this has been provided in the response, nor has any indication been made as to “which” person in the group is the genuine signature and which other(s) were allegedly not made personally. I assume actual proof of this serious allegation must exist, because it is being made by an elected official of the town of Reading and by a member of the Massachusetts bar. Note that the Massachusetts Rules of Professional conduct, Rule 4.1, states clearly that “A lawyer In the course of representing a client a lawyer shall not knowingly: (a) make a false statement of material fact or law to a third person…” . One would hope, therefore, that all statements of “facts” in this response by attorney Newman, such as the allegations about some signatures not being signed by the actual person, have a basis in fact, are known to be not false, and can be proven. I look forward to hearing about their proof for these serious allegations. Speaking of the Massachusetts bar, Mr. Newman has repeatedly signed his name listing a listed a BB0# (Massachusetts attorney registration number) that does not exist in the Mass BB0 system and does not, in fact, match the number that the Mass BBO lists for him. Mass BBO website lists the number as 370380, but he is repeatedly listing it, on officially filed documents, as 37380. This has happened multiple times in multiple filed documents he has made in connection with this matter. The Coronavirus COVID-19 pandemic has forced Mystic Valley Elder Services (MVES) to take unprecedented measures to remain a viable resource to older adults, adults living with disabilities, and their caregivers. We continue to adapt with the evolving situation affecting our communities. MVES is taking proactive measures to ensure the safety of staff, volunteers, and the 20,000 individuals served on an annual basis. As a mission-based community resource, MVES is committed to meeting consumers’ needs during this uncertain time. However, we remain prudent in following the recommendations of national, state and local authorities so that our services are delivered in the safest manner possible. Our main office at 300 Commercial Street is closed to visitors with very limited staff working onsite while most staff are working remotely practicing social distancing. Despite challenges associated with adapting to a mostly-virtual setup, our dedicated professional team has stepped up in a big way and are working hard to keep our programs operational. During a typical month, Mystic Valley Elder Services (MVES) delivers approximately 50,000 meals to more than 2,000 older adults aged 60 to 100+ years in their homes as part of the Meals on Wheels program. These individuals are our loved- ones, parents, grandparents, veterans and neighbors. The program provides hot and cold nutritional meals on a daily basis to these individuals as some may struggle to prepare meals for themselves, or because of physical limitations or financial difficulties. We need to do something immediately to keep people away from the playing fields. I assumed everything was roped off..
