Meeting of the Board of Public Works convened at 7:00
P. M. in Room 103 at the Parker Junior High School..
Present were Chairman Price, Secretary Cowell , Board
Members Testa, DeHart and Wood, Superintendent Louanis and H.
Theodore Cohen, Town Counsel . Also present was Attorney Troy,
Attorney Sempert and their client William Winkler.
Chairman Price asked if Mr. Winkler wished to have the
meeting held in Executive or Open Session. It was agreed to
hold the meeting in Open Session.
Chairman Price then invited Attorney Troy to speak in
behalf of his client, William Winkler. Attorney Troy requested
Mr. Winkler be reinstated in his job as his trial in Superior
Court had resulted in a "Decision without Finding" and the
case will be dismissed in 1980. A court appearance by Mr.
Winkler will not be necessary at that time.
During the discussion period that followed Attorney Troy
quoted from former Chairman Dustin ' s letter of November 9,
1977, as follows: "We support the Superintendent in his sus-
pension of Mr. Winkler without pay pending the result of his
new trial denovo in Superior Court and further action will be
taken at such time as guilt or innocence has been determined."
Attorney Troy cited various cases and argued the incident for
which Mr. Winkler was arrested occurred outside his working
hours, was in no way related to his employment by the Town,
he was, in fact, on vacation at the time, his employment is a
property right to which he is entitled and if he is not rein-
stated they will ask for an immediate hearing with all parties
involved present.
Chairman Price requested that Town Counsel be allowed
time in which to research the cases in point cited by Attorney
Troy and to report his findings to the Board for review by
the Board. This was agreeable to everyone present.
The meeting was adjourned and the Board members entered
the auditorium to attend Town Meeting.
