Meeting of the Board of Public Works opened in Room 16,
' Municipal Building at 7:30 P. M.
Present were Chairman Dustin, Secretary Price, Board Mem-
bers Russell and Botka, Assistant Superintendent of Operations
McIntire and Acting Assistant Superintendent-Engineering,
Bergeron and Carl Beaulieu of the Finance Committee.
Minutes of the previous meeting were accepted with correc-
tion.
The Board reviewed letter sent to the Water Resources Com-
mission, Division of Water Pollution Control regarding Fiscal
Year 1978 Federal Priority List Wastewater Treatment Facilities
together with supporting information. It was accepted as a point
of information.
The Board of Selectmen had requested a list of projects for
the Economic Development Administration and the prepared list in
order of priority, i .e. High, Moderate and Low, was submitted to the
' Board for comment. Following considerable discussion the Board re-
quested that Item 2 under Moderate Priority, namely Park Construc-
tion, be moved up to become Item 6 on High Priority. List as a-
mended attached hereto.
Mr. Robert Fuller appeared before the Board in behalf of
the Reading Y.M.C.A. and with the aid of Mr. Bergeron indicated
on a plan where the 'Y ' planned to locate the driveway entrance
and exit to their property on Arthur B. Lord Drive. Vertical
granite curb with an eight foot radius will be used in each in-
stance. Following a brief discussion, it was moved, seconded and
voted to grant permission for the curb cuts as shown on the plan.
-It was further moved, seconded and voted to allow the Y.M.C.A, to
tie into the existing catch basin subject to the review and
approval of the Engineering Division.
Read Notice of Public Hearing regarding taking of easements
for drainage, sewerage and water purposes in, and in the vicinity
of Lafayette Road, a private way located off Main Street (Route
28) . Mr . Alfred Overton questioned the cost of his individual
service pipe since the original plan for servicing his home at
#55 and the Amato residence at #48 had been altered. The Board
directed Mr. Bergeron to prepare a new cost estimate and in-
form the property owners of the probable cost. It was moved, '
seconded and voted to close the Hearing. It was further moved,
seconded and voted to take the easement for water, drainage and
sewer purposes in and through Lafayette Road. The Board signed
the Orders of Taking through properties owned by the following:
(1 ) Hubert and Frances Cronin - Ralph and Doris Lake - Mary L.
Comers and Jean J. Jorio
(2) Alfred and Dorothy Overton
(3) Joyce M. Rand
The Board met with Atty. Vigeant and his client Mr. Fernekees,
a property owner on Barbara Lane. Mr. Vigeant reviewed the history
of discussions, letters and meetings relative to the installation of
a main sewer in Barbara Lane. The Board reviewed Town Counsel 's
opinion, as follows: "Regardless of the wishes of the homeowners,
it is clear that the Board is authorized to extend the sewer to
Barbara Lane, either to Mr. Fernekees ' lot or for the entire length
of the Lane, and to assess all of the abuttors accordingly if they
deem such action necessary to public convenience and health. Should ,
the Board decide to extend the sewer to Mr. Fernekees ' lot, I would
prefer to see assessments levied in the usual manner, that is to
the owners of record, and have Mr. Fernekees enter into a private
agreement with the other abuttors by which he would pay their
assessments. If for some reason the other abuttors would not en-
ter into such a private agreement, then I can find no reason why
the Board may not enter into an agreement with Mr. Fernekees where-
by he would agree to pay the frontage assessments for the other
abuttors, as well as his own, if the Board votes to extend the
sewer to his lot." A lengthy discussion ensued and it was agreed
to hold another sewer hearing on September 19, 1977 at 7:45 P.M.
In the interim Mr. Fernekees and his attorney could proceed with
negotiations with the neighbors on Barbara Lane. The Board di-
rected Assistant Superintendent McIntire to send notices of the
impending hearing to the abuttors via certified mail . ,
Meeting adjourned temporarily in order that the Board could
meet as the Board of Survey and reconvened at 9:45 P. M.

The Board reviewed letter from Town Counsel concerning pri-
vate construction of a sewer in a public way wherein General Law
Chapter 83, Section 8 is cited as follows: "no person shall dig
up or make an excavation in a public way for the laying altering
or repairing of a drain or sewer without obtaining a written'
permit from the board or officer having charge of the mainten-
ance and repair of sewers in the town in which such way is
situated," and that, "no such permit shall , except in case of an
emergency, be approved or issued by said board or officer until
copies of the notices to public utility companies required by
section forty of chapter eight-two have been filed with said
board or officer by the applicant for such permit." Following
a lengthy discussion it was moved, seconded and voted to grant
permission to allow the construction of the sewer within the public
way subject to the following recommendations of Town Counsel :
1 . The plans and specifications for the construction of the
sewer should be carefully reviewed by the Board and, if necessary,
by the Department of Public Health and the Department of Public
Works.
2. An agreement should be entered into whereby the progress,
nature and completion of the construction is carefully monitored
and restricted, together with provisions for appropriate enforce-
ment remedies by the Board.
3. A performance and payment bond in the full amount required to
complete the construction of the sewer should be• provided.
4. Public Liability insurance in an amount suitable to the Board
should be provided.
5. As part of the agreement enumerated in number two above, the
terms of the conveyance to the Town should be set forth, includ-
ing the obligation of Mr. Manning to indemnify the Town for any
loss or liability arising by reason of his construction of the
sewer.
and the Engineering Division's recommendations as follows:
1 . The Town approve the contractor doing the work.
2. A performance bond in an amount determined by the Engineering
Division be furnished to the Town.
3: The Town receive a conveyance of easements and utilities in-
stalled.
4. The plans submitted with proposed sewer main extension, if re-
quired, be modified to meet the requirements of the Engineer-
ing Division.
5. All work done be inspected by the Engineering Division and
installed according to the specifications of the Department.
6. The contractor will provide all equipment necessary to per-
form and pass air pressure tests satisfactory to the Engineer-
ing Division.
7. The contractor or developer will repair any damage to the
roadways and right-of-way areas and will provide the necessary
trench patches for all work done and at the lapse of 90 days
from the installation of the last trench patch the entire
disturbed area would be given a one inch thick bituminous
concrete overlay.
Mr. Symes, of Chimo Development, who has agreed to purchase the
property from Mr. Manning was present and agreed to conform with
the ruling.
The Board reviewed bids received on Contract 77-8 for Apply-
ing Bituminous Chip Seal , as follows:
Bell and Flynn, Inc. . . . . . . . . . . . . . . .Unit price .40 square yard
Able Bituminous Contr. Inc. . . . . . . . .Unit price .447 square yard
Following a brief discussion it was moved, and seconded to award
the contract to Bell and Flynn, Inc. The vote: 3 in favor, Mr.
Price opposed.
The Board reviewed bids received on repairing bituminous
concrete roads and sidewalks with infra-red heater method, as
follows:
Felix A. Marino Co. Inc. . . . . . . . . . . $ 6.50 a square yard
It was moved and seconded to authorize the Superintendent to con-
tract with Marino the only bidder, for infra-red heater method of
repairing bituminous concrete roads and sidewalks at the unit
price of $6.50 per square yard. The vote: 3 in favor, Mr.
Price opposed.
Read letter from Robert W. Fitzgerald in which he requested
that the sewer main be extended in Colonial Drive in order that
he could request a house connection for his home at number 71 .
It was moved, seconded and voted to table the item until Septem-
ber 12th or 19th and Assistant Superintendent McIntire was directed

to write Mr. Fitzgerald acknowledging receipt of his letter and
inform him of the Board 's action, stating further that in the
meantime a study of the Brewer Lane area would be done.
The Board met with Mr. John R. Rivers of Riverside Homes,
Inc. and Peter Ogren of Hayes Engineering who indicated on a
plan the location of the seven lots on the easterly side of
South Street where Mr. Rivers intends to build. The builder
agreed to conform with the comments of the Engineering Division,
as follows:
1 . The seven lots shown on the plan all have sufficient frontage
and area to meet the existing Zoning By Laws as legal build-
able lots.
2. The developer wishes to provide municipal services by easement
into the property to allow the homes to have a large noise
barrier from Route 93•
3. The final location, plans, specifications, etc. , would be done
to the satisfaction of the Superintendent using Town of Reading
specifications.
4. The developer will be required to provide all legal documents
to convey the easements and municipal services to the Town and
provide a performance bond in a form acceptable to the Town.
5. There will be a separate driveway for each lot within the
limits of the lot being served.
6. The water main would loop down along the property line of
Lot 5 and 6 and have a hydrant and tee installed to allow
the Town to close the loop sometime in the future.
7. A normal house service will be installed in a utility easement
across Lot 6 for the Lot 7 water service in place of extend-
ing the water main into Lot 7.
8. The easement water main would in effect eliminate the need
of approximately 470 lineal feet of water main for the
eventual loop connection to the West Street side of South
Street.
9• Having the utilities in the easement will create no problem
for the opposite side of South Street due to the fact that
Route 93 butts up to South Street in the proposed project
area.
10. One inch bituminous concrete overlay on the street where
utilities are placed on South Street.
The Board signed the Plan.
Mr. Price suggested tabling a discussion concerning the
Municipal Incinerator until the Superintendent returns from his
vacation.
Underground construction is in progress in the area of
Causeway Road and the Municipal Light Department has requested
permission to move one pole for a short time, make a temporary
replacement, and when work is complete place the pole as near as
possible to its original position. Mr. Bergeron indicated on a
plan the present and temporary location of the pole and the Board
agreed to grant permission as there would be no inconvenience to
other property owners.
The Board reviewed letter of application to become a licensed
drain layer from Donohoe & sons, Inc. , 80 Pearl Street in Reading
and the supporting references. It was moved, seconded and voted
to issue a license to Jerry Donohoe, President of Donohoe and Sons,
Inc. providing he furnish a proper bond and pay the standard
license fee of $25.00.
The Board signed the Payroll for the period ending August
12th and the Bill Roll dated August 19th, 1977•
