HomeMy WebLinkAbout1980-04-07 Board of Public Works Minutes April 7, 1980 Meeting of the Board of Public Works convened in Room 16 , Municipal Building at 7 :30 P . M. Present were Chairman Cowell , Secretary Wood , Board Mem- bers DeHart , Fallon and Barker together with Superintendent Louanis and Finance Committee Member Linscott . Chairman Cowell requested Mrs . Wood Assume the Chair dur- ing his momentary absence from the meeting. Minutes of the meeting of March 31 , 1980 were accepted as amended . Mr . Cowell rejoined the meeting and assumed the Chair. The Board read letter from Mr . and Mrs . Brown of 13 Track Road wherein they express a desire to purchase Lot 11 immediately adjacent to their Lot B12 from the Town of Reading in order to afford them the possibility of adding living area to their exist- ing house and by fencing, preclude the possibility of foot traffic thereby eliminating debris and other associated annoyances exper- ienced presently . Superintendent Louanis explained that the De- partment of Public Works of Massachusetts - Division of Waterways in May 1941 as authorized by Chapter 458 of the Acts of 1939 took a forty foot (401 ) easement through and divided equally between Lots 10 and 11 . It is necessary to enter this property from time to time to clean this ditch . A brief discussion ensued. Mr . Cowell requested that this item be postponed until later in the evening in order that the Board could proceed with scheduled hear- ings. Secretary Wood read Notice of Public Hearing regarding tak- ing an easement for drainage and. sewerage purposes at 7 :45 P .M. in. Richards Circle, Woburn , Massachusetts and separate Notice of Public Hearing regarding taking an easement for drainage and sewerage purposes in Border Road, F Street , Beacon Street and C Street : meetings to be held contiguously . Chairman Cowell greeted the citizens present and introduced the Board and asked Superinten- dent Louanis to outline the procedure to be followed in conducting the Hearing . Superintendent Louanis explained that this joint- hearing was scheduled first to meet with the Woburn residents affected by the easement through their property and secondly to meet with homeowners living on private ways to notify them that the Board of Public Works must take an easement on each private ' way in order to make it possible to install and maintain the sewer lines in the respective streets. The meeting was then opened to questions from the citizens . Mr . Siraco of Richards Circle in Woburn questioned why others on his street were not notified of the hearing and why his particu- lar lot was selected for easement purposes. Superintendent Louanis stated it was not necessary by law to hold this hearing and there- fore since only one lot was to be affected the Town of Reading notified only Mr . Siraco . The Superintendent reported, when questioned, that the plan as presented is the best engineering solution to the problem. The possibility of sewer pumping stations had been explored but it is in the best interest of all concerned to avoid pumping stations whenever possible . Pumping stations should be used only when there is no other possible way to go. The Superintendent offered to meet with Mr . Siraco and his family and indicate where the work will be done and stated the land would be returned as closely as possible to its present state , when the project is complete. Superintendent Louanis outlined briefly the procedure followed when an easement is taken by eminent domain stating an appraisal would be made, a pay date set and an award made . Mr . Siraco indicated he intended to file an objection. Mrs. Muise of 7 D Street questioned how far into her property the easement would extend and it was explained that the easement would be taken in the middle of the gravel area. Mrs. Hoffman questioned whether Beacon Street would be paved after the sewer was put in the street . She was informed that the abutters would have to petition to have the street accepted in order to have the street paved. It was moved, seconded and voted 5-0 to close the hearing . Mrs . Wood read Notice of Public Hearing at 8 : 30 P .M. concern- ing taking of easements for drainage purposes on Mark Avenue. Superintendent Louanis explained that the proposed drainage work , will alleviate the flooding conditions currently experienced by homeowners at #40 and #44 Mark Avenue . The new pipe will increase the street drainage at this location to an amount four times its Minutes - continued April 7 , 1980 present capacity . Mr . and Mrs. Elton Merritt of 44 Mark Avenue and Mr . and Mrs. Domenic Rotondi of 40 Mark Avenue signed a Waiver of Claim from Damages. It was moved , seconded and voted to close the hearing. Mrs. Wood read Notice of Public Hearing regarding taking an easement for drainage and sewerage purposes at 722 Pearl Street . The Engineering Division had secured a Waiver of Claim from Damages from Mr . and Mrs. Henry Bendikien and the Depart- ment proposes to install a catch basin in the street, install drainage pipe through the Bendikian property to the low lying swamp area to the rear thus relieving flooding problems. It was moved, seconded and voted 5-0 to close the Hearing . The Board reviewed the results of the polling of residents on Beacon Street as to their desire concerning the installation of sewer mains in their street . The Engineering Division was able to contact eight out of the fourteen property owners and all eight were in favor . Three attempts were made to contact each of the remaining six homeowners without success . It was moved , seconded and voted to install sewer lines in Beacon Street and assess betterments accordingly . The vote was 5-0. It was moved , seconded and voted 5-0 to install sewer main in South Street in accordance with the plan and assess betterments in accordance with the estimated sewer frontage assessment sheet . It was moved, seconded and voted 5-0 to take an easement in Beacon Street for drainage and sewerage purposes . The Board signed the Order of Taking. It was moved, seconded and voted 5-0 to take an easement on Border Road for drainage and sewerage purposes. The Board signed the Order of Taking . It was moved, seconded and voted 5-0 to take an easement in D Street for drainage and sewerage purposes. The Board signed the Order of Taking . ' It was moved , seconded and voted 5-0 to take an easement in F Street for drainage and sewerage purposes. The Board signed the Order of Taking . It was moved, seconded and voted 5-0 to take an easement through private property for drainage and sewerage purposes on ' Mark Avenue property presently awned by Domenic and Carolyn Rotondi and W. Elton and Elsa V . Merritt. The Board signed the Order of Taking . It was moved , seconded and voted 5-0 to take an easement through private property at 722 Pearl Street , land currently owned by Mr . and Mrs. Henry Bendikian. The Board signed the Orderof Taking . It was moved, seconded and voted to adjourn at 9: 10 P.M . and following a meeting as the Board of Survey meeting of the Board of Public Works reconvened at 9: 55 P . M. Chairman Cowell requested the Board continue its discussion concerning the desire of Mr. and Mrs. Brown to purchase Lot 11 on Track Road. Superintendent Louanis could find no problem in selling the land to the Brown ' s provided they are willing to give the Town a 20 ' easement . Chairman Cowell suggested the Board write to the Brown ' s and send a copy of the letter to the Board of Selectmen saying this Board has no objection to the sale of ' the land. provided the necessary easements are retained. Bids were received on March 27 , 1980 at 2 :00 P .M. for trees and shrubs. Bigelow Nurseries was able to supply all items re- quested for a total bid of $3, 074 .00 . However , the total cost using the low bid items by all companies is $2 ,895.00. Therefore the bid was awarded by a vote of 5-0 as follows : Bigelow Nurseries - P. 0. J. K. Municipal Services, Inc. . . . . . . 35.00 per hr . It was moved, seconded and voted 5-0 to award the contract for Street Sweeping to the low bidder , J . K . Municipal Services at $35 .00 per hour for an upset limit of $14, 580. Bids for the Sale of Scrap Metal were received at 1 :30 P .M. on April 3, 1980 as follows: E. Martel Plant Dismantling and Recycling, Inc . $ 15.00 Ton Richard Standley 15. 10 " Tombarello and Sons, Inc . 7.00 " It was moved , seconded and voted to award the contract to Richard Standley in the amount of $15. 10 per ton. The Board signed the Pay Roll for the period ending April 4, 1980 and the Bill Roll dated April 11, 1980 . The Board reviewed the proposed letter to the D. E . Q. E. and it was agreed to rewrite it with suggested changes. The request for an abatement for street assessment on C Street was brought to the Board ' s attention and tabled for con- sideration at a later date .
