HomeMy WebLinkAbout1950-05-01 Law Committee Minutes L MINUTES OF THE MEETING OF THE LAW COMMITTEE HELD MAY 1, 1950 ;.#hnusrss�.�r�sr�s�h��,�xk kxuzi�sut�zs:,,��.•ri+.t�x Fxsrter-u+,�w»x A meeting of the Law Committee of the Town of Reading was duly held in the Assessor' s Room in the Municipal Building on Monday, May 1, 1950 at 9;00 o' clock P.M., notice of such meeting having been forwarded to each of such members giving the time and place thereof. There were present Kenneth C. Latham, Joseph D. Knight, Harold B. Currell, and James E. Calvin.,being a majority of the Law Committee. There was also present Melvin S. Crosby representing the School Committee. The Chairman called the meeting to order. The Minutes of the previous meeting were not read as they were not available. Melvin S. Crosby was duly elected Secretary pro tem for this meeting. Samuel H. Davis was nominated as a candidate for Town Counsel for the ensuing year and upon motion duly made by Mr. Currell and seconded by Mr. Knight , Mr. Davis was unanimously chosen Town Counsel for the term ending April 15, 1951. Mr. Davis thereafter was present at the meeting and reported to the Committee relative to the settlement of two small damage claims. c 2 - First ; the claim of John Twomey, 3 Mt. Vernon Street, Reading amounted to $25.00. Mr. Davis reported that Mr. Twomey' s car was damaged by an employee of the Public Works Department who found it necessary to move the automobile in order to allow the unloading of granite curbing from a trailer truck on Linden Street, corner of Mt. Vernon Street . Twomey' s automobile rolled backwards and the front door flew open and came in contact with a maple tree, springing the door hinges and damaging the car. Upon motion duly made and seconded, it was voted to authorize the Town Counsel to settle the claim for $25.00. Second; Mr. Davis reported that a claim had been made by Eleanor M. Lyman fm damage to an automobile owned by her while parked on Main Street on September 19, 1949. On this occasion while the Public Works Department was blasting ledge for water service pipe, a piece of rock struck the side of the Hose House and carommed off hitting the right front door of the Plymouth Sedan owned by the claimant , damaging the automobile to the extent of $7.12. Upon motion duly made and seconded, it was voted to authorize the settlement of this claim for $7.12 provided the Town has no insurance coverage on claim of this nature. Mr. Davis also reported that the land damage case of Ralph F. Heselton was on the April Jury List for trial at Lowell and that he had made a settlement upon the following - 3 = basis and requested the committee to approve the terms of settlement . The Town is to pay Ralph F. Heselton the sum of $'7500. in full settlement of his damages from which sum the amount due the Woburn Co-Operative Bank, Mortgagee is to be paid and the balance to be turned over to Heselton. The Town is to give a revocable lease to Ralph F. Heselton of the land which the Town acquired from him at an annual rental of $200.00 with a pro- vision that the same may be cancelled by either party giving to the other a ninety day written notice of such intention to cancel , such lease to provide that at the termination thereof Heselton is to have the privilege of removing his buildings from the leased land entirely at his own cost and expense. The matter of the Town acquring the 2 1/2 acres still owned by Heselton was discussed by the Cormtittee but no action was taken thereon. No further business being brought before the meeting, it was upon motion duly made and seconded, VOTED: To adjourn. Adjourned. Attest: Se � o to
