HomeMy WebLinkAbout1947-10-20 Law Committee Minutes MINUTES OF THE MEETING Or THE LAW COMMITTEE HELD OCTOBER 20, 1947 A meeting of the Law Committee was duly held in the Municipal Building on Monday, October 20, 1947 at 9:00 o'clock P. M. , notice of such meeting having been forwarded to each of such members giving the time and place thereof. There were present Kenneth C. Latham, Chairman, Harold W. Putnam, Harold B. Currell, Dr. Edward M. Halligan and Herbert G. Evans, being a majority of the Law Committee. The Chairman called the meeting to order. Samuel H. Davis, Town Counsel acted as Secretary pro tem. I The Town Counsel made a report to the meeting concerning the claim of Douglas S. Wilson, 69 Turnpike Road, Chelmsford, as a result of an accident which occurred on August 17, 1947 on Pearl Street near jthe residence of Gertrude E. Laird, in which it is claimed that an i overhanging dead limb of a tree fell upon his car damaging the top and breaking both sides of the windshield. Mr. Davis also called 4 attention to the fact that if the owner of the car had comprehensive coverage on his insurance policy, that the Company would pay for the damage. After consideration of the matter, it was Upon motion duly made and seconded, IF VOTED: That in the event that there was no comprehensive f 1 L -2- Minutes of the Meeting Held October 20, 1947 of the Law Committee coverage on the claimant' s insurance policy, that the matter be settled by the payment of the damage to the automobile amounting to '51.00. Mr. Davis also reported to the meeting that a claim has been made against the Town by Robert C. Robbins, 9 Marion Place, Everett, resulting from an accident which occurred on September 2, 1947 on High Street, in which the automobile of the claimant was driven into j a trench, which was dug by the Electrict Light Department for the purpose of installing underground cables. The trench had been filled in, but because of an extraordinary rain on the day in question, the trench settled leaving a hole filled with water, which was the cause of the accident. The damage to the automobile was '76.55. After consideration of the matter, it was Upon motion duly made and seconded, VOTED; That the Town settle the claim for damages and that the Electric Light Department of the Town pay the same from its revenue. The Town Counsel also reported that a claim has been made against the Town by Alice Duclos, 11 Pearl Street, Reading, as a result of an accident which occurred on Salem Street near Harrison Street, about August 31, 1947 in which it is claimed that Pars. Duclos fell on the sidewalk spraining her ankle and cutting her knees, resulting from a section of the sidewalk being broken at this location. Claimant's doctor's bill is ;;28.00. -3- Minutes of the Meeting Held October 20, 1947 of the Law Committee After consideration of the matter, it was Upon motion duly made and seconded, VOTED: To pay the claimant $35.00 in full settlement of her damage claim.
