HomeMy WebLinkAbout1946-04-29 Law Committee Minutes t MINUTES OF THE MEETING OF THE LAW COMMITTEE FELD APRIL 29, 1946 A meeting of the Law Committee of the Town of Reading was duly held in the Selectmen' s Rooma, Municipal Building, Reading on April 29, 1946 at 9:00 o' clock in the evening. There were present Mr. Kenneth C. Latham, Mr. Henry R. Johnson, Dr. E. M. Halligan, Mr. Wendell P. Davis, Mr. Joseph D. Knight, Mr. Harold B. Currell, Mr. J. Warren Killam, being all the members of the Law Committee. Mr. Kenneth C. Latham called the meeting to order and presided at the meeting. The nomination of Samuel H. Davis to act as Town Counsel was made and seconded and the Committee voted to appoint him as Town Counsel for the ensuing year. The Town Counsel made a report at the meeting relative to the case of Fdward Lane concerning an accident on Salem Street which occurred December 19, 1942, and announced that Mr. Arthur W . Coolidge, Counsel for the claimant requested an audience with the Committee. Upon motion duly made and seconded it was VOTED: To hear Mr. Coolidge in the matter. After Mr. Coolidge made his statement to the Committee the matter was taken under advisement, and after discussion, it was, Upon motion duly made and seconded, 41 VOTED: That .the Town Counsel be authorized to settle the case for a a= not exceeding $300.00. �r 2 Yinutes of the Meeting Held April 29, 1946 of the Law Committee The Town Counsel reported upon claim of Herbert S. Richardson against the Town amounting to $5.00 for towing of Mr. Richardson' s car from Fairview Avenue, because of a cave-in of the street on i March 4, 1946. After consideration, it was, Upon motion duly made and seconded, VOTED: To pay Ms. Richardson the sum of $5.00 in settlement of his damage. A report was made by the Town Counsel concerning the pending case i of DeYar against the Town for personal injuries sustained by Barbara DeMar on Lowell Street on February 4, 1944, in which a truck of the Plater Department operated by Alex Richmond struck the DeIl1ar girl, seriously injuring her. The Town Counsel further stated that the Insurance Company representing the Town was defending the case and that the limits of the Town Insurance was only yh5000.00 and recommended that the Insurance coverage be increased to 4x10,000 to 120,000 limits. The Chairman announced the Insurance Committee had already taken action and had increased the insurance in accordance with the recommends- tion. There was also a report and general discussion of the recent Appeal filed by William H. Kelch against the members of the Board of Appeal affecting the real estate located at 78 Salem Street, Reading, and it was decided by the Committee that the Town Counsel should take the necessary action to protect the interests of the Town and the Members of the Board of Appeal in the pending case before the Superior Court. -3- !.:inutes of the Yeeting of the Law Committee Held April 29, 1946 i No further business being brought before the meeting, it was VOTED: To adjourn.
