Meeting called to order at 9.25 P.M. by Chairman Killam. Members present 1J
Dr. Halligan, Henry Johnson, Chairman and Edgar Frost, Secty.
The matter of the claim of Mildred C. Partlow in the amount of $112.00
for suffering, $88.00 for incidental expense, due to an accident at the
corner of Chute & Woburn Streets on Oct. 1, 1938, where str et was being
repaired, was discussed. Miss Partlow was represented by Victor C. Harnish,
Atty. Voted that claim be dismissed.
The matter of Nellie X. Smith, 322 Haven St. Claim $27.00 for Dr. ' s bill
and X-rays, which accident occured March 5, 1938 in front of 246 Haven St.
due to deffective sidewalk was discussed. Voted that Town Counsel settle claim
up to an amount not to exceed $50.00.
The matter of Delia Elms, 120 Howard Street, was discussed. Claim for
Injury on Jan. 6, 1938, on Main Street in front of Municipal Light Board
Office. Claim of $20.00. Voted the Town Counsel settle claim for $20.00.
Fanny I. Bancroft has entered suit for $5,000. Town Counsel has taken
necessary pictures etc. to contest the case. Atty. Amos McLean represents
claimant.
Adjourned 9.50 P.M.

Dear Mr. Killam:-
A claim has been made against the Town by Mildred
C. Partelow, 28 Middlesex Avenue, Reading, as the result of
an accident which occurred on October 1, 1938, on Woburn
Street at the Northeast corner of Chute Street, in which it
is claimed that Miss Partelow fell to the ground because of
• a drop of two feet from the top of the curbstone to the
surface of Woburn Street. The claimant sustained a sprained
ankle and incurred expenses aggregating $88.00 as a result
of the accident.
At the time of the accident Woburn Street was under
construction, having been excavated on September 29, and at
the time of the alleged accident a workman was operating the
compressor on the opposite side of Woburn Street at a very
short distance from the place of the accident; also several
other workmen with pieces of machinery were doing Various
jobs on the highway within a reasonable distance from the
alleged accident.
The attorney representing Miss Partelow has requested
me to place this matter before the Law Committee for con-
sideration, and I shall be glad if the Committee will meet
in the near future and let me know what its decision is with
reference to settlement.

Dear Sir:-
A claim has been made against the Town by Nellie M. Smith,
322 Haven Street, Reading, as the result of an accident which
occurred on March 5, 1938, in front of the premises at 246
Haven Street, Reading.
The claimant asserts that this accident occurred as the
result of a hole in the sidewalk which was made by the tractor
plow. The Board of Public Works contends that the condition
of the sidewalk at this point was positively not caused by
the sidewalk tractor plow, but there seems to be some conflict
on this point.
Mrs. Smith claims to have sustained a sprained ankle as
the result of the accident, and was attended by Dr. Halligan.
I shall be glad if you will take this matter up at the
next meeting of the Law Committee and consider what disposition
your Board desires to make with reference to the case.

Dear Lir. Killama-
A claim has been made against the Town by Lars. Delia
:a.lms, now of 120 akoward Street, Heading, who claims to have
been injured on January 6, 1938, as the result of falling
down on the Easterly side walk on Main Street, in iron of
the premises occupied by the Municipal Light Department,
sustaining injuries to her left arm and foot.
jay investigation discloses that at u-ho time of the
accident there was a depression in the sidewalk reported
b•; the Board of Public Works to cover an area 10" x 12"
and varying In depth between 1/2" and 3/4".
The 106lice Deparcmenc reports 'chu depression to be
3" in depth.
I shall oe glad if the Law Cw=irtee will consider
this case on Friday evening, laovember 2S, aria let no know
whet the pleasure of the Committee will be with reference
to settlement.
