' Meeting of the Board of Public Works convened in Room 16,
Municipal Building at 7:30 P . M.
Present were Chairman Cowell , Secretary Wood , Board Members
DeHart, Fallon , Barker and Superintendent Louanis.
It was moved , seconded and voted 5:0:0 to accept the minutes
of February 23, 1981 with addition. It was moved, seconded and
voted 3: 1: 1 to accept the minutes of the meeting of February 26th
as written. It was moved , seconded and voted 5:0:0 to accept the
minutes of the meeting of March 2, 1981 with correction.
The meeting was adjourned temporarily at 7:45 P . M. and
following a meeting as the Board of Survey reconvened at 8 :00 P .M.
At 8 :00 P.M. the Board met with Herbert Converse , Chairman
of the United Church Homes of Reading, Inc. , Ruth Converse and
Harold Wyatt who are concerned with the proposed housing for the
handicapped and elderly on Bay State Road. Mr. Converse presented
the Board with a nine page statement of preconstruction conditions
' and requirements setting forth criteria patterned after the Cedar
Glen project which they propose to follow on this project. Mr.
Converse stated the project will consist of one four story masonry
building containing 97 units ( B 2-bedroom and 89 1-bedroom) ser-
viced by two elevators and indicated the two parking areas which
meet the specified requirements. There will be access by means of
a 26' roadway, with proper radius, from Bay State Road which will
continue around the building. Mr. Converse pointed out that an
easement will be given to the Town and it is planned to connect to
the water main on Haverhill Street completing a loop to the main
on Bay State Road; this will be a plus for the Town of Reading.
They are however opposed to an access roadway from Haverhill Street
as it would be an open invitation for traffic to cut through to
avoid the traffic circle and eliminate a half-mile of driving for
people going down Haverhill Street who wished to come to Reading
Square by way of Salem Street. Pedestrians may enter the complex
' by way of a sidewalk parallel with and easterly of the 26' roadway.
It is also planned to have a sewer pumping station just off Bay
State Road . The Board expressed serious concern relative to the
width of the proposed entrance since it does not meet with the
standards of the Board of Survey and in the event of an unusual
situation serious problems could become evident. Mr . Cowell '
advised Mr. Converse when the final plans are available it will
be necessary for the Board of Public Warks to hold two public
hearings. The meeting adjourned at 9:00 P.M.
The Board read letter from Barbara Taylor (4-H leader) request-
ing the use of the Reading Common on Saturday, April 18 , 1981 from
10:00 A.M. to 4:00 P .M. in order that her group could conduct a
rabbit show. Mrs. Wood moved, it was seconded and voted 5:0 :0 to
grant permission to the Carrot Crunchers to use the Reading Common
from 10:00 A.M. to 4:00 P.M. on Saturday, April 18th for the purpose
of exhibiting their rabbits (approximately twenty) subject to the
standard provisions , as follows:
1. No alcoholic beverages may be served in the public way
2. Proper police and insurance protection be provided
3. The area be broom clean at the conclusion of the event.
The Board read letter addressed to the Board of Selectmen by
Carmel Restuccia of the Reading Art Association, requesting per-
mission to hold the Spring Art Festival on the Reading Common
Saturday, June 6, 1981. It was moved , seconded and voted 5:0:0
to grant permission to the Reading Art Association to use the Read-
ing Common from 8 :00 A.M. to 6:00 P .M. on June 6, 1981 subject to
the standard provisions.
The Board reviewed Town Counsel ' s bill for the month of
January 1981 and it was moved , seconded and voted 5:0:0 to approve
the bill covering 1 .6 hours at $45.00 per hour or $72.00.
It was moved , seconded and voted 5:0:0 to extend the sanitary
sewer in Barbara Lane and assess betterments accordingly.
It was moved , seconded and voted 5:0:0 to sign letter committing
$592.90 for 70% sewer laterals to the Tax Collector in compliance
with the provisions of the General Laws, Chapter 80 as amended by
Chapter 63 of the Acts of 1933.
The Board signed the Payroll and the Billroll for the period
ending March 6, 1981.
The Board read Petition from the residents of "D" Street and
Mr. Cowell requested the Superintendent write informing the peti-
tioners the Board is unable to include this in the 1982 budget
period , but would consider the request when the 1983 budget is drafted .

Under old and new business, the Board discussed Contract
No . 79-23 with Camp Dresser and McKee . In response to Mr.
Fallon ' s question, the Superintendent stated that P .V.C. pipe
would be used only to transport chemicals from one point to
another . Then, in response to questions from Mr. Barker, the
Superintendent declared that he had explored the issue of obtaining
a clerk of the works with John Willis Of Camp Dresser and McKee as
it will be necessary to have someone protect the Town' s interest
and as a result of this preliminary discussion , had received some
material from Mr. Willis. To date , Mr . Willis has not received
a report from D . E. Q . E. The Board received a report from the
Engineering Division setting forth 94 items to be discussed with
C .D .M. and Mr . Fallon submitted a three page list of questions as
a result of his perusal of the contract. It was agreed that Mrs.
Wood , Mr . DeHart and Mr . Barker would review the contract during
the ensuing week and prepare questions so that everything could
be discussed at a daytime meeting with the Engineers and C.D.M.
The subject of telephones was brought to the attention of
the Board once again . Mrs. Wood stated that she felt the indivi-
duals should submit a personal bill for the basic cost of the
telephone in his home . Following a discussion, Mrs. Wood moved
that the individuals involved submit a bill for the telephone in
their home to the Town on a monthly basis. Mr. DeHart seconded .
The vote was 2: 3 - the motion lost . Mr. DeHart moved to recon-
sider the motion of March 2 regarding the removal of all Town
paid ' phones in employees residences as of July 1 . Mr . Barker
seconded. The vote was 3: 2. The motion did not carry as it was
not a 2/3 vote. Following further discussion, it was moved,
seconded and voted 3: 1: 1 to table further action on house ' phones
until after a new Board is seated. Mr . Barker suggested we
contact the business Office of the New England Telephone Company
requesting they send a representative to visit the garage , treat-
ment plant etc . , and determine whether it would be possible to
' obtain less costly and/or improved services.
The Superintendent agreed to comply with Mr. Barker ' s request
concerning a report to the Board involving allocation of funds ex-
pended for overtime and further agreed to Mr . Fallon ' s request
to confer with the Chief-of-Police relative to the real need ,
for bringing out our call men following an accident, etc.

I . Pre-construction Conditions and Requirements
Prior to the commencement of construction the following
conditions and requirements numbered 1-12, inclusive , will be
complied with :
1 . Final plans shall be submitted to the Board, the
Board of Health,, the Building Inspector , the Wiring , Plumbing ,
and Gas Inspectors , the Fire Chief , the Board of Selectmen, the
Conservation .Commission and the Board of Public Works , which
plans shall be in substantial conformance with the building and
development plans already presented to the Board . Further , no
construction, including site development, drainage , or founda-
tions shall begin until detailed construction plans and specifi-
cations shall have been approved by the Department of Housing and
Urban Development which is providing funds for the Project and by
the Reading Town Engineer and the Building Inspector .
2. The Applicant shall comply with the Wetlands Pro-
tection Act , M.G.L. ch. 131 Section 40 and the Reading Zoning By-
Laws relating to wetlands and flood plains except as otherwise
permitted hereunder . Prior to commencement of construction of
the Project, the Applicant shall seek the approval of its plans
from the Reading Conservation Commission under M.G.L. ch. 131
Section 40, and the Reading Wetlands By Law, subject to Paragraph
31 of this permit.
3. Construction of the Project shall commence within 18
months . Construction shall be completed within 18 months after
commencement of construction.

4 . The Applicant shall obtain the following permits
upon the following terms and pay all permit fees in accordance
with the Town Permit fee schedule:
( a) A building permit shall be obtained from the Build-
ing Inspector .
( i) The application shall be submitted on the form
furnished by the Building Inspector .
( ii) Completed construction plans and final archi-
tectural plans for the building shall be
submitted with the application showing that
the proposed structures comply with the State
Building Code .
( iii) The Applicant will provide a "buffer" strip
screen of .trees and other vegetation along the
lot line abutting # 's 36, 42 and 52 Bay State.
Road. This buffer strip shall include the
types of vegetation described in the provi-
sions of Section 5.3. 1.3 of the Zoning Code.
( b) All plumbing , gas, and electrical permits shall be
obtained from the relevant permit granting autho-
rity.
V 5. The final detailed site plan and landscape plan
shall be prepared and submitted to the Board for its review and
approval prior to commencement of construction. This plan shall
show the exact location and configuration of buildings, parking
areas, driveways and walkways. It shall show outdoor lighting ,

provisions for public safety, buffer zones and screening, loca-
tion of disposal units for solid waste , landscape grading and
planting .
6 . The Applicant shall furnish the Board with a copy
of the Performance and Payment Bonds running to the United States
Department of Housing and Urban Development.
7. Prior to commencement of any construction or other
related activity on the Project site, the .Applicant shall obtain
insurance that includes comprehensive general liability coverage.
8. The Applicant shall obtain the Fire Chief' s ap-
proval of the plans for a fire detection system.
- 9. The Applicant shall comply with and agree to the
provisions of M.G.L. ch . 90 Section 18 regarding traffic regula-
tions .
/ 10. The. Applicant shall submit final surface water
drainage plans , final water and sewerage plans, and final roadway
plans to the Board of Public Works as applicable to a development
of this type and obtain that Board' s approval . Approval will be
based on consistency with the Town of Reading Board of Public
Works General Specifications, as amended.
V 11. The Project shall be in accordance with the appli-
cable requirements of the Town of Reading Board of Survey Rules
and Regulations , adopted March 17 , 1975 with the following excep-
tions:
( a) The travelled way will be a minimum of twenty-six
(26) feet wide.

( b) Sidewalks need not be adjacent or parallel to the
roadway, but adequate sidewalks shall be provided
to allow pedestrian access . There shall be a .
sidewalk on only one side of the travelled way.
( c) The curb will be constructed of precast concrete,
not granite;
( d) There will not be a street sign;
(e) No paved circular turnaround will be required.
12. The Applicant shall obtain all required State
permits .
II . Construction Conditions and Requirements
/ 13. All work performed pursuant to the drainage , road-
way, water and sewerage plans referred to in Condition #10 shall
be subject to inspection by the Board of Public Works to insure
compliance with the approved plans and specifictions. Inspection
will be in accordance with the rules and regulations specified in
Condition #10.
14. All sanitary disposal facilities installed on the
buildings on the site shall be connected to the Town's sanitary
sewer system in accordance with the requirements of all Town and
State code and regulations . Such connection shall be made on Bay
State Road and will connect to a small pumping station on the
site, if required.
15. Periodic notification of the progress of the work
shall be given to the Town Inspector of Buildings and the Gas,
Wiring, and. Plumbing Inspectors, so that the inspections of the

construction can made to determinecompliance with the appropri-
ate code involved.
16. Fire safety devices and equipment shall be instal-
led as follows and in accordance with the building code require-
ments :
( a) Interior fire alarm systems in all building to be
connected to the master box.
( b) Hydrant locations to be designated by the Reading
Fire Department.
/ 17. She Applicant shall provide at its expense a new
V water line , looping across the property from Bay State Road to
Haverhill Street.
✓ 18. All utility lines, including the fire alarm system
shall be placed underground.
19. No less than 97 parking spaces shall be provided on
the site.
20. An emergency fire access route at least twenty (20)
feet in width will be provided around the Project site and shall
be protected from use by non-emergency motor vehicles.
21. Sprinklers connected to the water supply shall be
located in all boiler rooms and landlord storage areas .
22. Smoke doors shall be installed in corridors as
shown on the submitted plans.
23. Bay State Road shall be maintained in a passable
condition during construction and shall be restored to its pre-
sent condition on completion of construction. All disturbed

pavement areas will be overlaid full with , after proper patching,
a one-inch bituminous concrete pavement.
24. The applicant shall provide bus transportation for .
residents for a minimum of two days per week , four trips per day,
to Reading Center and back, in the event of termination by the
Massachusetts Bay Transportation Authority of bus service on
Salem Street.
25. Construction on the Project site of approximately
6.845 acres shall be limited to 97 dwelling units in one build-
ing. No building shall be constructed on the site other than
that 'shown on the final working drawings as approved by the
Board , copiesof which drawing shall be maintained on file in the
office of the Town Clerk . The remainder of the site shall be
permanently left as undeveloped open space and shall never be
sold separately from the developed portion of the site. Further ,
there shall not be constructed at any point a vehicular access
road across the site onto Haverhill Street . The Applicant upon
the request of the Board shall execute and deliver to the Town of
Reading such covenants and other documents as the Board shall
deem necessary to carry out the terms and revisions of this
Condition ►25.
26. All 97 units in the Project shall be for occupancy
by elderly persons aged 62 and over , except the spouse of an
eligible person is eligible regardless of the person' s age and
that handicapped units will be available for occupancy by non-
elderly handicapped persons. Recognizing the need for housing

for both low and moderate income persons, the applicant will make
all units available to all such eligible persons , consistent with
applicable federal regulations including 45CFR §880.603(c) .
27. The Reading Council on Aging shall be allowed to
use the community activities area for activities benefiting the
occupants of the Project subject to the approval of any tenants
organization or management agent.
28. No voluntary transfer of ownership of the premises
of this Project shall be permitted by the Applicant during the
entire forty (40) years of the HUD mortgage .
29. In the event the real property constituting the
premises of this Project owned by the Applicant or entity owned
or controlled by the Applicant becomes available for sale to any
buyer other than an entity owned or controlled by the Applicant,
the Town of Reading or Reading Housing Authority shall have,
subject to Federal, State and local regulations, a right of first
refusal to purchase said property. The Town of Reading or Read-
ing HousingAuthorityshall elect to exercise its right of first
refusal within 120 days from the filing of written notice by the
Applicant with the Town Clerk that the property is available for
sale. If the Town of Reading or Reading Housing Authority elects
to exercise its right of first refusal it shall give written
notice to the Applicant or other entity then owning the real
property and shall file a copy of the same with the Town Clerk.
30. Use and occupancy permit shall be obtained from the
Is Building Inspector and other inspectors prior to occupancy.

31. In case of disagreements between Applicant and
local officials or Boards as to the issuance of approvals pur-
suant to any of the conditions set forth herein or as to compli- '
ance with specifications, this Board shall review and decide the
matter and issue a written decision which shall be conclusive,
final , and binding , except as otherwise provided by . M.G.L. c.40A.
32. The Board recognizes that the plans submitted
during the hearing are subject to review by the United States
Department of Housing and Urban Development, the Massachusetts
Department of Environmental Affairs, the Conversation Commission,
and other authorities having jurisdiction over the Project.
Therefore, the plans for construction of the Project shall be
considered to be in substantial conformance with the plans sub-
mitted to the Board if such plans include modifications required
by such Board or authority and if such modifications do not make
the Project inconsistent with local needs. In the event modifi-
cations are made which the Board believes may make the Project
inconsistent with local needs , a public hearing shall be held by
the Board which hearing shall be limited to the modifications
required and whether such modifications make the Project incon-
sistent with the local needs and such hearing shall be subject to
the provisions of M.G. L. c.40A.
33. This permit shall be recorded at the Middlesex
South Registry of Deeds and/or Registry with the Middlesex South
Registry of the Land Court simultaneously with the recording

and/or registering of the deed by which the Applicant acquires
title to the premises to which this permit relates .
34. This permit is binding upon the Applicant and its-
heirs , successors and assigns . However , nothing in this Condi-
tion #34 shall be deemed to derogate from or change of terms of
Conditions #28 and 29.
35. This Comprehensive Permit may be amended by action
of the Board of Appeals underrequest of the Applicant or any
subsequent owner of the premises to which this Permit relates but
only after notice and a public hearing , which public hearing
shall be limited to consideration of the particular proposed
amendments.
