Bancroft , Brophy, Lindsay and. Superintendent Welch were present. The motion was made to establish a bound for Mr . Torrey of Sumi:;er Ave . and so voted. Bound established at northwest cor- ner of Sum,ier Ave . and Prescott St. The motion we.s made that the fence at Memorial play ground be completed on the Westerly side , and so voted. Order of Takint-; for Lowell St . and Bancroft Ave. was received from -,lie Town Counsel and signed by tine Board. Lowell Str_ jt ana Bancroft Avenue , Town ways in s id "eading, and navinv complied with the i equirernents of law rel-ting to notice, did on the twenty-first day of February, 1936 18 -2- March 20, 1936 . relocate or alter such public ways accordingly, and duly filed their report thereof with the boundaries and measurements of the same in the Office of the Town Clerk of said Town on the twenty- fourth day of February 1936. WHEREAS, at a Town meeting duly called, warned and held the sixteenth day of March 1936, in accordance with the provisions of law applicable thereto, it was voted to accept the report of the said Board relocating or altaring the said public ways as therein Bet forth. NOW THEREFORE, we , the undersigned, being at least a majority of the Board of Public Works of the said Town of Reading, duly elected, qualified and acting as such, do hereby, under and by virtue of the provisions of Chapter 79 of the General Laws and of any and every other power and authority us hereto in any way enabling, take the right or easement to use for all the purposes of a. Town way for the use of said Town of Reading, the land in said Town, .bounded and described as follows: Beginning at a point on She Southerly side-line of Lowell Street , said point being South 46 - 421 East , a distance of two hundred nine and 04/100 (209.04) feet from a stone bound set at an, angle point in the Southerly side-line of Lowell Street; Thence on a curve to the left , having a radius of twenty (20.0) feet , a length of forty-five and 03/100 (45.03) feet , across land of the Workingmens Co-operative Bank, to a point on the Easterly side-line of Bancroft Avenue; Thence North 40 - 181 East, along said Eaeterly side-line of Bancroft Avenue , a. distance of fifteen and 93/100 (15.93) feet to a stone bound marking a point of curve; Thence on a curve to the right , having a radius of twelve and 40/100 (12.40) feet, a. length of twenty-seven and 92/100 (27 .92) feet to a bolt marking a, point of tangent on said Southerly side- line of Lowell Street; 19 _3- March 20, 1936. Thence South 46e - 42 ' East , along said Southerly side- line of Lowell Street , a. distance of fifteen and 93/100 (15.93) feet to the point of beginning. The above described area is estimated to contain two hundred thirty-nine (239) square feet Of land, more or less. The above described lines being more fully shown on a plan entitled, "Alteration of the Southeast corner of Lowell St. and Bancroft Ave. , Reading, Mass." dated February 1936 , Board of Public Works, Philip Welch, Supt. , said plan being a pert of this description and to be recorded herewith. Any and all trees upon the land are specifically in- cluded in this taking. We estimate and determine that no damages will be sus- tained by any person or persons in their property by reason of the taking to ba made for this improvement . No betterments are to be assessed for tris improvement . The name of the record owner of land taken or afi'ected is Workingmens Co-operative Bank, and the easement area taken is approximately two hundred th'_rty-nine (239) square feet. Office of the BOAFD OF PUBLIC WORKS Town of Reading ORDER OF TARING At a meeting of the Board of Public works of the Town of Reading held this twentieth day of March 1936, it is ordered: WHEREAS, the Board of Public Works of the said Town of Reading having determined and adjudged that common convenience and necessity require that a Town way be laid out under the provisions of law authorizing the assessment of betterments as and in the location hereinafter described which is substantially the present location of a private way known as Fairview Avenue, running Westerly from Sunnyside .Avenue to the end of the layout of Fairview Avenue as accepted May 3 , 1915, and having complied with the requirements of law relating to notice, did on the twenty-first day of February 1936, lay out such way accordingly, and duly filed their report thereof with the boundaries and measurements of the same in the office of the Town Clerk of said Town on the twenty- fourth day of February 1936, and WHEREAS, at a Town Meeting duly called, warned and held the sixteenth day of March 1936, in accordance with the provisions Of law applicable thereto , it was voted to accept the report of the said Board laying out the said way under the provisions of law 21 —5— March 20 , 1936 authorising theassessment of betterments and to accept the laying out of said way as therein set forth and made an appropriation therefor. NOW THEREFORE, we , the undersigned , being at least a majority of the Board of Public Works of the said Town of Reading, duly elected, qualified and acting as such, do hereby, under and b_- virtue of the provisions of Chapter 79 of the General Laws and of any and every other power and authority. us hereto in any way enabling, take the right or easement to use for all the pur- poses of a Town way for the use of the said Town of Reading, the land in said Town, bounded and described as follows: Beginning at a point on the Southerly side-line of a public way known as Fairview Avenue , said point being N. 760-10 , E. , a distance of 556.62 feet from a stone bound at the intersection of the Easterly side-line of Summer Avenue , and said Southerly side line of Fairview Avenue; Thence N. 760 - 10 , Es , by lands of Florence H. True, Royal C. Jaques , and the Heirs and Devisee of Joseph D. Gowing, a distance of 461.34 feet to a point of curve; Thence by a curve to the Right , having a radius of 20.0 feet , a length of 30.e4 feet , through land of said Heirs end Devisee of Joseph D. Gowing, to a point on the Westerly side-line of Sunnyside Avenue, said last two described lines being the Southerly boundaries of this layout; Thence turning and running N. 160 - 00 W. , along said Westerly side-line of Sunnyside Avenue , a distance of 60.07 feet to a point at land of Viola A. Miller at al, said described line being the Easterly extremity of this layout ; Thence by a curve to the Left , having a radius of 20.0 \ feet , a length of 32.20 feet , through land of said Viola A. Miller et al , to a point of tangent ; Thence S. 760 - lo , W. , by lands of Viola A. Miller et al , Royal C. Jaques , Amos M. McLean, Robert 0. Chealey and Edith G. Chesley, and Amos M. McLean, a distance of 442.72 feet to a point of curve; 2 -6- March 20 , 1936. Thence by a curve to the Right , having a radius of 20.0 feet , across land of Amos M. McLean, a length of 29.90 feet to a point of tangent on the Easterly side-line of Pratt Street , said last three described lines marking the Northerly boundary of this layout. The above described lines being more fully shown on a. Plan entitled "Fairview Avenue , Reading, Mass." made under date of February 1936 , Board of Public Works , Philip Welch, Supt. , and filed in the office of the Town Clerk, with our report aforesaid as a part thereof, a copy of which Plan is to be recorded herewith, which several parcels included in said land so taken are as shown upon said Plan which is hereby referred to for more particular description thereof. The names of the registered owners of the registered land taken or affected, and the Certificate of Title thereto are all shown in the schedule hereinafter set forth. Any and all trees upon the land are specifically in- cluded in this taking. We estimate and determine that no damages will be sus- tained by any person or persons in their property by reason of the taking for this improveipent. All acts in connection with said laying out and more particularly with this taking are done under the provisions of law .authorizing the assessment of betterments, and betterments are to be assessed therefor. The area which it is expected will receive benefit or advantat,e , other than the general advantages to the community, from such improvements are the areas consisting of the lots hereinafter mentioned and shown on said plan which is hereby referred to for more particular description thereof.
