Reading, Mass. , May 22, 1931.
' The Regular Meeting of the Board of Public Works was called
to order at 7:30 P.M.
All members and the Superintendent were present.
Minutes of May 10th m=aeting read and accepted.
Board signed Order of Taking of Easement for flight of Way
through property of Meadow Brook Golf Club and Silas Henry
Carroll, as per motion and vote filed herewith.
Board voted to restore the surfaces of the sidewalks and
streets, caused by installation of the underground duct, charging
the expense of same to the Municipal Light Department. Superin-
tendent instructed to so advise them.
Board signed order for sidewalk assessment against the pro-
perty of Arthur D. Gordon, located on the Westerly sidw of Main St.
Board to have a hearing on Hancock Street. xtension.
Mr. Goldsmith interviewed Board relative to fire insurance
on Water Station building project.
Letter received from Fred F. Smith, relative to placing
sewer on Smith Avenue. Board voted to hold hearing on June 5th.
Letter received from Fred F. Smith, regarding procedure of
having water installed on Lewis Street. Superintendent to write
him in detail.
Mr. Fairclough to interview Francis Hunt, owner of Lot #6
in the new water development.

Board voted to install curbing abutting lots 8 and 9 '
Virginia Rd. and Lot 6 and 34 Pennsylvania Avenue. Also voted
in exchange for service rendered on the options obtained in the
new water project to install four (4) corner curbings at corner
of Pennsylvania Avenue and Virginia Road.
Application received from Evelyn M. Davies for a corner
curbing, corner of Berkeley Street and Freemont Street. Taken
under advisement.
Applications received for -granolithic sidewalk at #28
Berkeley St. by Albert E. Merrill; and for a granite curbing
and granolithic sidewalk at #81 Summer Avenue, by Charles A.
Schmidt under Betterment Act.
To interview Mr. Sampson regarding advisibility of placing '
a 25% charge instead of 66 2/3% on sewer users over a maximum
of $300.00.

MEMORANDUM OF VOTE TO BE PASSED BY BOARD OF PUBLIC WORKS
Upon motion duly made and seconded, it was
VOTED: That this Board adopt an order of taking for
an easement in, through, and over the property of The Meadow
Brook Golf Club Corporation of Reading, Massachusetts , and
Silas Henry Carroll, for a Right of Way, to the extend and for
the purposes , ad designated and defined in such order of taking,
which order is incorporated herein and made a part of this vote,
and that One (1) dollar be awarded as damages to The Meadow
Brook Golf Club Corporation of Reading, Massachusetts for such
taking, and One (1) dollar be awarded to Silas Henry Carroll,
and it is further voted that this Board cause such order to be
.recorded in the Middlesex South District Registry of Deeds and
notify the owners of such taking as provided by law.

In keeping with the general principle that all
proceedings must be of such a nature as to secure competition,
the bid must conform to the plans, specifications and
advertisement of the municipality and the contract entered
into must also conform to the plans , specifications and
advertisement. If a contract differing therefrom in terms be
awarded or made, it cannot be said to have been the result of
the competition which the statute requires and it is invalid.
The rule that the contract must conform to the plan, applies,
although but one bid was made, and although there is no
allegation or suggestion of fraud and although thschange made '
in the contract is to the advantage of the city.
