` Meeting of the Board of Survey opened at 9:40 P.M. in
Room 14, Municipal Building.
Present were Chairman Florence, Secretary Harrison,
Board Members Leonard, Ames and Hodson and Superintendent Welch.
Chairman read letter from Ernest Nigro, Attorney, con-
firming withdrawal without prejudice of the plans submitted by
Pallotta & Son Development, Inc. at a hearing held January 9,
for lands off Summer Avenue to Sunnyside
1961 at 9:00 P.M. Avenue . Moved, seconded and voted to approve
withdrawal at request without prejudice.
The Chairman contacted Mr. Amon, representing Reading
Greenhouses, who, through a misunderstanding, had neglected to
send in letter of confirmation. Mr. Amon promised that the
Superintendent would have the letter by Wednesday, January 18.
` Mr. Ames moved to postpone action until the meeting of January
23. Mr. Leonard seconded and it was voted.
The Chairman read letter from Town Counsel regarding
deposit of fees with the filing of plans with the Board of
Survey. Mr. Killam was unable to find any statutory authority
to require a fee deposit from the developer. In his opinion the
answer was in the negative.
Meeting adjourned at 9:55 P.M.
