A meeting of the Board of Survey convened in Room 16, Municipal
Building at 7: 45 P.M. Present were Chairman Barker, Board Members Griffin
and Boucher, Supt. A.V. Fletcher, P.E. and Assistant Supt. William A.
Redford.
The Board reviewed Asst. Supt. Redfnrds memo regarding
Subdivision Bond Reductions.
It was moved, seconded and voted 3: 0 that the Board of Survey
reduce the Performance Bond an Gavin Circle from $10,000 to a zero
balance.
The Board next met with Jack Rivers to discuss the bond reduction
on Sanborn Village Phase IIT.
It was moved and seconded that the Board reduce the bond from
$99S,578 to $965,000 for the Sanborn Village Phase III Subdivision.
' Mr. Rivers stated I am quite surprised at the small amount of
money to be redcuced. It is my understanding the sewer was calcualted at
$370,000. We presently have 700 feet installed plus the manholes and the
box culverts.
Mr. Redford stated you requested the bond estimate six weeks ago
when this work was not even started.
Chairman Darker stated perhaps this should be laid on the table
and brought back in two weeks.
Asst. Supt. Redford stated the reason the recommended action is
to "consider" and not "reduce" is that I am somewhat concerned about
partial releases of this nature. The water main has not been put in. The
laterals connected to this main are not put in and are secured in this
bond. Also, the retaining walls and control structures are not in.

Mr. Rivers replied it seems inr_redihle to me that I have to
' generate $1,500,000 for the Tri-Party Agreement before I can recover any
return on my money.
Mr. Griffin asked are there still questions about access
maintenance?
Mr. Redford replied the Department received a number of
complaints during our unseasonable thaw, and Mr. Rivers addressed those
issues.
Supt. Fletcher stated I recommend tabling this issue at this
time.
It was ni.roed, seconded and voted 3:0 to table this issue for
definite consideration on February 10.
The Board next reviewed Asst. Supt. Redfords memo regarding a
' Floodplain District Determination on Bay State Road. There were six
abutters present.
Chairman Barker introduced the members of the Board and the
Department and welcomed everyone to the meeting.
Mr. Howard Reith of RCH Associates, Inc. was present representing
the applicant.
Mr. Reith stated I made the worst possible assumptions that the
drainage and watershed for this site is at the northeast end of the
southeast side of Cedar Swamp. I am hoping the Board can waive the 90'
elevation requirement.
Asst. Supt. Redford stated the Board of Appeals is the
determining body as far as issuing a building permit in the Flood Plain.
We can only review the data and report to the Board of Appeals whether or
not we determine this area is suitable for habitation.
Mr. Griffin asked do we have any evidence of flooding in the
area?

Mr. Redford replied no, we do not.
' Supt. Fletcher stated it is the recommendation of the staff that
we send a supporting letter to the Board of Appeals, with the
recommendation that the house be located closer to the road and not set
back any further than any of the other houses.
Mr. Reggie Peters of Bay State Road stated I have lived in the
area for 40 years and i can honestly state there hasn't been any water
there at all.
It was moved, seconded and voted 3:0 that the Board supply a
favorable report for the suitable habitation of Plat 96, Lot 156 in
accordance with the Toning By-Law, Section 4.4.4.2 and recommend that the
house be brought closer to the street and approximately in line with the
buildings of the other homes in the area.
