HomeMy WebLinkAbout1985-07-08 Board of Survey Minutes Board of Survey Meeting of July 8, 1985 Page 1 ' A meeting of the Board of Survey convened in Room 16, Municipal Building at 6:05 P.M. Present were Chairman Barker, Board Members Polychrones, Griffin and Boucher, Superintendent A.V. Fletcher, F.E. and Assistant Superintendent William A. Redford. Regarding the Performance Bond taking on Gavin Circle, it was moved, seconded and voted 4:0 to postpone action on the Performance Bond until July 29th. Regarding the Performance Bond taking on Latham Lane, Assistant Superintendent Redford stated as of Wednesday, all work in this subdivision has been completed. It was moved, seconded and voted 4:0 to release in total all monies currently held ($500.00) under the terms of a Performance Bond dated October 22, 1979 for Latham Lane. Regarding the Performance Bond taking on Warren Avenue Extension, Assistant Superintendent Redford stated all the work on this subdivision has been completed. It was moved, seconded and voted 4:0 to release in total all monies currently being held ($100.00) under the terms of a Performance Bond dated January 4, 1982. Mr. Griffin stated I have reservations about any meetings that transpire regarding Criterion Road. I believe an accurate accounting of the meeting must be recorded and request that the Department suspend the meeting in the event of legal implications. Assistant Superintendent Redford stated I intend to deal with Board of Survey issues only. Mr. Griffin asked do you feel any need to have Counsel present at this meeting. Board of Survey Meeting of July S, :985 Page 2 Mr. Redford replied I would suspend the meeting if I felt Counsel was needed. Mr. Griffin stated I would urge that very careful minutes be taken. The Board next met with James Pacy, Developer for the Buckskin Drive Subdivision. Assistant Superintendent Redford informed the Board that the Developer (Land Realty Trust) has done very little work on this subdivision during the past construction seasons and has substantial work remaining despite previous proddings. Mr. Pacy stated my major problem is unavailability of materials. John DiTonno, my contractor, could not get materials for paving. He presented the Board with a letter from DiTonno explaining his problems and an Order for the cutting of granite curbing that was initiated on June 20, 1985. Superintendent Fletcher stated I have a problem with why an order wasn't placed the previous Spring. We have three developments this Winter where the curbing is in. I know they have been slow, but we are talking about well over a year. Mr. Pacy stated from my point of view it is not a good idea to complete the road untilall the heavy machinery is removed from the site. Superintendent Fletcher stated that has nothing to do with curbing. Chairman Barker stated there are no trees, no sidewalks and no bounds down there. You put down a binder course and you stopped, you sold the lots and you left. He added, I am not going to let projects sit. Mr. Pacy stated this is not deliberate. Chairman Barker stated I am in favor of taking this bond at this time. Mr. Polychrones asked why couldn't you have done something down there to show you had intentions of carrying on this work? Board of Survey Meeting of July 8, 1985 Page 3 Mr. Pacy replied I had no idea the problem of purchasing these materials existed. Mr. Polychrones asked when would you say you are going to complete this? Mr. Pacy replied DiTonno stated that once he receives the curbing, he can install it in one week. Chairman Barker stated I in asking you for assurance of a firm commitment to finish this by October 15th. Mr. Pacy replied according to these freight records I will have this completed by August. Chairman Barker stated I will not accept a verba] response. Mr. Griffin asked if we delay taking the bond until the first week in September, will that allow us enough time to get this done before the cold weather sets in? Mr. Redford replied we would be able to get everything done except the curbing before September. Curbing does not have to be put in before the sidewalk. Superintendent Fletcher asked how can we be assured this order has been placed? Chairman Barker stated there are many other things you could be doing down there, and I want that assurance in writing. He asked how long are the residents supposed to put up with an uncompleted street? Assistant Superintendent Redford stated at least a month ago 1 told Mr. Pacy about this. There is no reason why sidewalks, bounds or binder course can not go in. If I was doing the work, I would prefer the sidewalks in first, but this does not mean that your surveyor couldn't place grades on the opposite side. ' Board of Survey Meeting, of July B, 1985 Page 4 II Superintendent Fletcher stated I want sidewalks and bounds in there by July 29th. Mr. Pacy stated if this will prevent the taking of the bond, I will do it. Superintendent Fletcher stated unless the sidewalks and bounds are in by July 29th, I want the bond pulled and a delivery date ascertained for the granite. Mr. Polychrones moved that we extend the taking of this bond until July 29th pending that the sidewalks, bounds, and leveling course be installed by that time and that the granite curbing order be verified and a delivery date established. The motion was seconded. Chairman Barker amended further that the developer be reqested to submit in writing a schedule for total completion of and acceptance by the Board of Buckskin Drive. This document should be in our hands by July 29th. The motion was seconded. The main motion as amended was voted 4: 0. The meeting adjourned at 8:45 P.M. Respectfully suubb/Lmtit�teed, c retar
