HomeMy WebLinkAbout1985-05-13 Board of Survey Minutes Board of Survey Meeting of May 13, 1985 Page 1 A meeting of the Board of Survey convened in Room 11 of the Community Center at 8: 30 P.M. Present were Chairman Barker, Secretary Hampson, Board Members Polychrones, Griffin and Boucher, Supt. A.V. Fletcher, P.E. and Asst. Supt. William A. Redford, Mr. Hampson read the Notice of Public Hearing at 8:30 P.M. regarding the approval, disapproval or modifications of plans for a proposed subdivision located off Duck Lane within an area approximately bounded by Main Street, Bunker Avenue, Pearl Street, Audubon Road, Hampshire Road and Lawrence Road. The proposed new subdivision will provide for fifteen new lots on two new sections of roadway. There were approximately 20 abuttors present. ' Chairman Barker welcomed everyone to the hearing and introduced the members of the Board and the Department. Present for the developer were Atty. Simon Zaltman, Frank M. Guermonte, Joseph Cunningham - Builder and Howard M. Buttrick, Engineer. Atty. Zaltman opened the meeting by stating please realize this is only a preliminary hearing. We are looking for guidance from the Board of Survey. Our engineer is also here to answer any questions you might have. We appreciate last week 's meeting having been postponed. Asst. Supt. Redford apologized for last week's confusion and proceeded to go over his list of eleven concerns with the subdivision. (copy attached). Chairman Barker then read both letters received from the Conservation Commission dated May 4, 1985 and May 10, 1985 (copies attached). Board of Survey Meeting of May 13, 1985 Page 2 ' Mr. Griffin asked what is the distance of the primary cul-de-sac from the Duck Lane area? Mr. Buttrick replied approximately 500 feet. Mr. Polychrones asked do you propose to build on that hill? Mr. Buttrick replied we plan to grade the area considerably, and we plan on retaining walls 4-5 feet high. Atty. Zaltman stated with regard to the letter from the Conservation Commission dated May 10, 1985 concerning the vegetation adjoining the stream on the property that has been cut down, we take full blame for that. When we go before the Conservation Commission, whatever their requirements are, we will take care of them. Mrs. Napolitano of 24 Audubon Road stated I was told my back yard was a wetlands area. I had to petition the Department of Natural Resources and the State when I installed my pool. I have full documentation if you would like it. Mr. Redford stated there is an existing drain that cuts across the Monks, Napolitano and Lawton properties. As indicated, anything within 100 feet of that open ditch, does require a Conservation Commission filing. Mrs. Napolitano stated I am very concerned about the water and the drainage problems, and our pools. Supt. Fletcher stated if any part of this development is in a wetlands area, it will have to go before the State and the Conservation Commission. Dorothea Webster of 54 Lawrence Road stated I presently have a drainage easement on my property which is overflowing now. What impact will this subdivision have on my property. i Board of Survey Meeting of May 13, 1985 Page 3 I Chairman Barker replied sometimes these problems are improved. They can not make your condition any worse than it is today. Tim Pressey of 32 Hampshire Road stated we do not want any kind i j of a through road connection. I want to be on record that the neighborhood I would be opposed to any kind of a through way connection. We started to have water in our cellars after Audubon Road was built. I am afraid this will happen with this new development. Janet Trevor of 64 Lawrence Road stated I would like to reiterate these concerns. We are getting water in our garage because of Audubon Road. I am also concerned about the vegetation that was cut down. Mr. Griffin asked how many lots with retaining walls over six feet will be necessary? ' Asst. Supt. Redford replied it appears to be four or five. Tim Pressey of 32 Hampshire Road stated I an concerned about the filled areas more than the cut areas. What affect will this have on any drainage problems in this area? Supt. Fletcher stated we will have to see the final plans. Mr. Redford added that it appears they attempted to balance the cut and fill, this is a preliminary plan only. Bob Trevor of 64 Lawrence Road stated the land there now is actually super-saturated. Can you build a house without just going up, can you go down? Mr. Redford replied yes, they can go down, however, in this area they may hit ledge. Mr. Trevor stated I have problems with the drainage also. Mr. Dennis Brailey of 885 Main Street was concerned about his piece of land on Main Street if this development is approved. I Board of Survey Meeting of May 13, 1985 Page 4 Angelo Napolitano of 24 Audubon Road asked does this town have a "Master Plan" on file? Mr. Redford replied we have one that is 16 or 17 years old. Mrs. Pat Crowley of 12 Audubon Road asked what does formal action by May 18th mean? Chairman Barker replied we must act on the preliminary plan by that time and then we will have to act on the Definitive Plan when it is submitted. Richard Burnham of 70 Lawrence Road asked is there any process by which you are going to provide a walkway for the school children through that area. Chairman Barker replied that will have to be dealt with by the ' developer. Atty. Zaltman requested an extension of time to address some of these problems to June 10, 1985. Mr. Cunningham, the builder, stated these houses will be of the best quality, they will be more expensive than any homes on Audubon Road. They will be large colonials and splits. Mrs. Napolitano asked to be informed of any action taken on this development. It was moved, seconded and voted 5:0 to close the hearing at 9:40 P.M. Barker, Chairman TOWN OF READING Board of Survey RE: Proposed Chandler Road Subdivision Dear Mr. Barker: The Conservation Commission has reviewed the above-referenced plans for their wetland value impacts. The following is a list of concerns the Commission has identified: 1) There have been reports of drainage problems in the Audubon Road area. The increases in runoff caused by the development will have to be shown to be miti- gated without impact to the neighboring property or downstream. 2) The open drainage stream will remain in its present condition with proposed construction activities limited in its location. 3) Filling operations should be monitored for erosion and slope maintenance reasons. Please be advised that the stream, bank, and 100 feet beyond are under the jurisdiction of the Conservation Commission. Any activity within these areas requires the prior approval of the Commission. It is unfortunate that prior to your appearance before this Commission you have already set your proposed project in a bad light. You will be required to restore the vegetation along the stream bank to its original condition. Once your project receives its subdivision control approval you should submit a Notice of Intent to this Commission. Before that time you will be required to leave the land under our juris- diction unaltered. - Sincerely, Charles T. The Board must hold a public hearing and act on the submission (approve, approve with modifications, or disapprove) within 60 days. The Board uses the forum of the public hearing to obtain reports, information and concerns specific to the submitted plans from the developer, Board of Health, Conservation Commission, various Boards and Committees and effected public. The Board uses the remaining time within the 60 day limit to deliberate on all the information presented and reviews the subdivision plan and filing for its conformance with State requirements, local zoning ordinances and the Town's Subdivision Rules and Regulations. In the case of this Preliminary Plan Hearing, a more detailed submisison of these subdivision plans is required and an additional (Definitive) hearing conforming to the same requirements described above must be held prior to any utility or housing construction. The Board of Survey encourages all individuals affected by this planned development to offer input consistent with the provisions of Subdivision Control Law during the hearing process. This hearing will follow the procedure described below: 1. Chairman calls the hearing to order. Y 2. Secretary reads the legal notice of the Public Hearing. 3. Chairman introduces Board, Department, Applicant, etc. 4. Presentation of proposed Development by Applicant. S. Comments on the proposal and Review of submitted information: a) Department of Public Works - Engineering Division; b) Attending Boards and Officials; c) Written correspondence by any Boards, Officials, and/or public. 6. Chairman opens the hearing to discussion: a) Board of Survey; b) Attending Boards and Officials; c) Attending Public. 7. Chairman indicates that the Board intends to close the hearing, deliberate on the information presented, and act on the submittal prior to May 18, 1985; and indicates that the plans and the department are available for additional review and comments. S. Secretary makes motion to close the hearing. 9. Board votes on motion to close the hearing. The Reading Department of Public Works Engineering Division, after review of the information filed to date, submits the following list of concerns and comments: 1. Formal action on this subdivision is required by May 18, 1985. 2. The proposed roadway 'Chandler Road' should be renamed Duck Road to remove any confusion with a new road name beginning 162 feet from Audubon Road. 3. The proposed sewer main exceeds the maximum length of 300' between manholes. 4. Insufficient roadway layout information (vertical curvature data) has been submitted for review. S. The proposed sewer layout on lot 14 has insufficient cover, ease- ment width, and the location may interfer with general building placement. 6. The proposed sewer system does not appear to service Lot 10, (and may service lots 9 and IS more efficiently if redesigned. 7. The proposed drain catchbasins require 3' sumps. B. The proposed drainage system requires additional manholes, catch- basins, and layout modifications. 9. The proposed roadway design results in major regrading and filling along with substantial retaining walls. 10. No stars water runoff control or mitigation devices are indicated. 11. This proposed subdivision, due to the size, will be required to conform to the Board of Public Works' 2 for 1 Sewer I/I policy.
