HomeMy WebLinkAbout1985-04-01 Board of Survey Minutes Board of Survey Meeting of April 1, 1985 Page 1 A meeting of the Board of Survey convened in Room 11, Community Center at 8:00 P.M. Present were Secretary Hampson, Board Members Polychrones, Griffin and Boucher and Asst. Supt. Redford. Mr. Polychrones read the Notice of Public Hearing at 8:00 P.M. regarding the Definitive Hearing for the approval, disapproval or modification of plans for a subdivision located off Chestnut Road. This proposed new subdivision will provide for two new lots on Chestnut Road Extension. There were three abuttors present. Mr. Hampson introduced the Board and the Department. Also present were Bill Jones of Dana Perkins & Associates and Brad Latham representing Rivers Development Corporation. Mr. Jones presented the plans. Asst. Supt. Redford listed his four concerns, and stated that formal action on this subdivision is required by May 5, 1985. Mr. Griffin asked what are you going to do with the School Department property? Mr. Jones replied we are simply going to slope it. It will retain a slope and the curbing on the cul-de-sac will help to retain some of the water runoff. Mr. Brad Latham stated we are formally requesting a waiver of the sidewalks and will put this request for waiver in writing to the Board of Public Works. Bob Charleton of 45 Parkview Road asked are these single family homes and will they face Chestnut Road? Mr. Jones replied yes. It was moved, seconded and voted 4:0 to close the hearing at 8:25 P.M. i Board of Survey Meeting of April 1, 1985 Page 2 Mr. Griffin read the Notice of Public Hearing at 8; 30 P.M. regarding the Definitive Hearing on the approval, disapproval or modification of plans for a subdivision located off Colburn Road, Annette Lane, Deborah Drive, Applegate Lane and northerly of Spruce Road. The proposed new subdivision will provide for three new lots on Colburn Road Extension. Mr. Hampson stated this is a Definitive Hearing, the main purpose of which is to obtain information and additional data to allow us to review the developers plan and act on it. The time limit for Board action expires April 30th. Mr. Hampson then introduced the Board and the Department. There were approximately 25 abuttors present as well as James Pacy, developer and Eric Nitzsche, Engineer for Robert E. Anderson Inc. Mr. Nitzsche outlined his plan for the three lots, and explained the proposed detention area. He stated he has a hearing with the Conservation Commission scheduled for April B. Mr. Hampson read into the record letters from the Conservation Commission and Mrs. Judith Bliss. Asst. Supt. Redford listed his fourteen concerns with the project. Mr. Nitzsche stated we have no problems with items I-12. Regarding Item 13 - under Chapter 137we can not be denied access to our land. Mr. Boucher asked can you tellus which way the water flows through the drainage streams? Mr. Nitzsche replied from east to west. Mr. Griffin asked what is the proposed square footage for the homes? i Board of Survey Meeting of April 1, 1985 Page 3 Mr. Nitzsche replied 50' x 25'. Mr. Griffin asked what is the coverage over the 18" pipe leading under the driveway? Mr. Nitzsche replied about 1. 1/2 feet of cover. Mr. Redford stated we would consider a driveway as an active loading area and would require a three foot cover or a better class of pipe. Mr. Hampson asked did you address the wetlands concerns in the Environmental Impact Report? Mr. Nitzsche replied yes, we did address it. Mr. Griffin asked what is the figure for frontage on lot 3. Mr. Nitzsche replied 120 feet. Mr. Harry Parsons of 47 Deborah Drive stated the back corner of my property is also wetlands. I am extremely concerned that any additional water will severely impact my proeprty. The drainage ditch can not handle the present water capacity. Mr. Polychrones asked is your land affected by water now? Mr. Parsons replied yes, my land is constantly wet, I have trouble with water in my cellar now. Judy Bliss of 46 Deborah Drive stated the back of my property is now 3 - 6 feet of mud. Chairman Barker and Superintendent Fletcher returned to the meeting at 9: 10 P.M. Mr. Polychrones asked how are you going to address this woman's complaints? Mr. Nitysche rpelied by creating a Swale on the side of her property. Mrs. Bliss asked why can't we have a geophysical study done on this area. . r Board of Survey Meeting of April 1, 190S Page 4 Mr. Parsons again asked what about the additional water onto my property? Mr. Nitzsche replied this will be taken care of by the detention pond. Mr. Paul. Karry asked what kind of a pond are you going to create in there? Mr. Nitzsche replied this is going to be a dry pond except in the wet seasons. Mr. Karry stated this could be a dangerous condition for our children. Bob Spinella of 16 Applegate Lane stated this proposal has not been properly filed, there is a lot of information missing here, I think it best that you address these problems, these three homes are going to be permanent fixtures in our neighborhood. Mr. Hampson stated we still have 30 days in which to decide. Mr. Joseph Giovanni of 30 Deborah Drive stated, concerning the drainage, he is deeply concerned that if there is any back up in the ditch, we could end up with more problems than we presently have. As far as opening Deborah Drive as a through street, you are going to adversely impact all the property owners in this area. I don't see anything here tonight that justifies this. Mr. Charles Wayne of 27 Applegate Lane asked how can you expect hay bales to act as permanent erosion barriers? There are a lot of kids in the neighborhood and we are concerned about water hazards. ' Mr. Nitzsche replied the hay bales will be maintained only during construction. The erosion fabric fences will be permanent. Mr. Wayne asked who actually owns all this property? James Pacy replied I own all of it. Board of Survey Meeting of April 1, 1985 Page 5 Ellen Lottiero of 22 Deborah Drive stated I would like to go on record as totally opposed to any development in this area and am also opposed to a through street on Deborah Drive. She stated a detention area is not a viable solution to our problems. She presented another petition signed by over S6 residents. Mr. Redford stated Mr. Nitzsche should submit a cross-section of the detention area for presentation. Mr. Nitzsche stated the Conservation Commission will insist upon a condition that this area be maintained as a permanent detention area. Mr. Wayne stated I would suggest that the Board reject this until the submission is complete. Mr. Hampson stated we will notify the lead person on the petition of the status of this. It was moved, seconded and voted 5:0 to close the hearing at 9:50 P.M. The Board next discussed the status of Rice Road. The potential builder of a house has asked through their legal counsel the determination of the status of Rice Road. Mr. Redford stated based on a brief review of the information, Rice Road appears to be a right of way and used primarily by the Girl Scout Camp as a driveway. The town currently only plows snow from Forest Street to the front of House No. 6. It was moved, seconded and voted 4:0: 1 (Mr. Polychrones abstaining) that Rice Road be considered a private road with no legal status under the Subdivision Control Law.
