Case#19-13-26 Green Street
The Zoning Board of Appeals held a continuance of a Public Hearing in the Select Board's
Meeting Room at Town Hall, 16 Lowell Street,Reading,Massachusetts on Wednesday,August
7, 2019 at 7:00 PM on the application of Wade and Lorraine Wiliwerth,pursuant to M.G.L. Ch.
40A §9 for a Modification to the Special Permit granted in Case#11-11 or a new Special Permit
under Reading Zoning Bylaw Sections 7.3.2 to convert storage space above the garage into a
master bedroom with%bath to the existing single-family dwelling at the property located at 26
Green Street(Assessors Map 16,Lot 315) in Reading,Massachusetts.
Mr. Caouette stated that the applicants requested a continuance of the Public Hearing to
September 4th, 2019.
Mr. Caouette went on to say that he had reviewed the previous discussion on the case which then
resulted in a meeting with Building Commissioner Mark Dupell and Staff Planner Andrew
MacNichol. A conclusion was made that a previous decision can be amended, where the
referenced sections no longer exist, by referencing the new sections and paragraphs in the current
Zoning Law. It was also determined that the Applicant did not require a Variance for their
application.

On a Motion made by Mr. Redfern,seconded by Mr. Pernice,the Zoning Board of Appeals
moved to grant a continuance for Case#19-13 to September 4th,2019.

Case#19- 15—11 Nueent Lane
The Zoning Board of Appeals held a Public Hearing in the Select Board's Meeting Room at the
Reading Town Hall, 16 Lowell Street, Reading, Massachusetts on Wednesday, August 7th,2019
at 7:00 PM on the application of Brain Learned,pursuant to M.G.L. Ch. 40A §9 for a Special
Permit under Reading Zoning Bylaw Sections 7.3 and 7.3.2,to construct a two story addition to
an existing non-conforming dwelling in regards to front setback on the property located at 11
Nugent Lane(Map 46,Lot 61)in Reading, Massachusetts.
Mr. Caouette swore in the applicants and members of the public for the case at 11 Nugent Lane.
Mr. Brian Learned was present on behalf of the application and provided the details of the two-
story addition to the side of his house. The proposed addition was off to the right side of the
house and stayed within existing setbacks. The family was looking for room for an additional
bedroom(s)for their family.
Mr. Caouette read the Building Commissioner's Denial Letter into record.
Mr. Tornow asked for clarification that the house was on a dead-end street and that the proposed
plan was to stay within the existing setbacks. The applicant confirmed both questions.
Mr. Pernice did not see the proposal as being detrimental to the neighborhood, as it is not
increasing the non- conforming aspect of the house and that he has no issues.
Mr. Redfern briefly went over the history of the house and street. Mr. Learned stated he has lived
there since 2007 and confirmed Nugent Lane was accepted as a Public Way in 1995. He added
the previous address was on Pearl Street until Nugent Lane was completed. Mr. Redfern
reviewed how this led to the offset of the property and agreed with Mr. Pernice that the addition
will not cause a determent to the neighborhood.
Mr. Jarema asked Mr. Dupell if there were any previous cases for the property. Mr. Dupell stated
there were cases from 1991, 1992 and 1993 for a Variance. These Variance's were for not
meeting the required 20-foot setback and they were granted an 11.3-foot setback from the street
but when it was constructed,they created a 10.8 ft setback. Mr. Dupell stated that they were
nonconforming to the Variance that they were granted but the Town took no action and he does
not believe it has any bearing on the Board today. This is why he considered it a nonconforming
structure.
Mr. Hagstrom had no questions or objections.
Mr. Caouette added the information on previous history was appreciated and that he did not have
any objections.
Mr. Canuette opens the meeting up to public comment. Mr. Maughan from 263 Woburn Street
was curious and questioned if the house was there before the road so the road was built non-
conforming not the property. Mr. Dupell confirmed his question and stated that there were issues
with the width of the road and wetlands,which is why the mad was built close to the house.

Mr. Caouette closed the public comment.
On a motion made by Mr. Redfern, seconded by Mr. Pernice, the Zoning Board of Appeals
moved to grant a Special Permit for Case#19-15.
Vote was 5-0-0 (Jarema, Caouette,Redfern, Hagstrom, Pernice)

On a motion made Mr. Jarema, seconded by Mr. Tornow,the Zoning Board of Appeals
moved to adjourn the meeting.
