A meeting of the Board of Survey convened in Room 16, Municipal
Building at 7: 45 P.M. Present were Chairman Wood, Secretary Barker, Board
Memhers Polychrones, Griffin and Hampson and Assistant Superintendent
Edward D. McIntire, Jr.
The Board met with Attorney D. Bradley Latham and William Jones
of Dana Perkins Engineering Associates regarding Pine Grove Estates
Subdivision off Haverhill Street.
The petitioner, Stoneham Savings Bank, is making a formal request
that the Board waive the roadway length limitation to allow the major
roadway in the subdivision to be extended by approximately 150 feet,
subject to the approval by the Board of the definitive plan showing the
final road layout.
Mr. Jones stated there has been some modification to the plan and
it is now required to fill 3400 square feet of the Flood Plain. The road
is now 1,050 feet long. He stated they would accept the provision that
the road can not be extended further without looping the water main, and
that would be included on the Definitive Plan.
It was moved, seconded and voted 3:0:2 (Mr. Barker and Mr.
Polychrones abstaining) that the Board of Survey waive the roadway length
limitation to allow the major roadway in the subdivision to be extended by
approximately 150 feet total length.
The Board met. with Ernest r,. Babcock, developer of Hanscom Avenue
Extension, at 7:51 P.M.
The proposed development of Hanscom Avenue Extension has been
submitted at various times since 1966.
The Board of Survey approved a plan to construct the street in
December 1977. The owner then filed with the Conservation Commission and
their modifications required a change resulting in the elimination of one
lot and the installation of a cul-de-sac whirh was approved by the Board

of Survey on September 24, 1979. There were then further complications
with the Conservation Commission that resulted in an eventual appeal to
the State. The results of that appeal were not issued until November 9,
1980. Therefore, due to the time of the year, no work was started until
1981.
The present plan with all the modifications was signed by the
Board on July 13, 1981. The water main was then installed that year along
with the piped drainage.,
In August and September of 1981 and the Spring of 1982, gravel
was hauled in and approved and in July 1982 the binder layer of pavement
was installed on the roadway.
The work in 1983 has consisted only of shaping part of the
drainage swale.s.
The developer has asked for and received a number of extensions.
The delays in the construction have been due to both a late issuance of
the Orders of Conditions by the Conservation Commission and the slow rate
of progress exhibited by the Developer.
The latest time for completion expired on September 24, 1982.
A certificate of deposit, in the amount of $34,000.00 issued by
Bank of Boston Middlesex, has been offered by the developer as surety for
the completion of the work on this subdivision.
The developer also requests an extension of time from the Board
as the previous extension of time has elapsed.
Mr. Babcock stated he is asking for an extension of one year. He
' stated he obtained an extension from the Conservation Commission until
August of 1984. This Fall he will continue on with the sidewalks and
rough grade of the lots. He will not put in hot top or curbing or
sidewalks. He stated there should be four foundations in before the first
frost.

' Assistant Superintendent McIntire stated there was a
recommendation by the Department for the completion by March of 1984
because of a lack of progress on this job. The Department would like to
see some progress on this subdivision. It will be a fact that the
planting season will probably not be ideal and may require a further
extension of time from March 11 1984. There is also work required on a
lot at the beginning of the subdivision on the left hand side. The
residents have seen a partially completed subdivision for seven years
now. Mr. McIntire stated he would like to see the base course of
sidewalks down on the entire area.
Mr. McIntire stated there is no record of the. approved Plan or
the Covenant Agreement ever being recorded. Until those items are
' recorded, there is no way any Release of Restrictions could be signed.
Mr. Babcock asked could you release them with the clause that
when they are recorded they will be released?
Chairman Wood replied no, all of the work must be done before I
would release it.
Mr. Babcock asked would you release the four lots on the plan
that is recorded?
Mr. McIntire replied the Covenant Agreement may also be different
from the existing requirements and he would not recommend this.
Chairman Wood stated we can put you on the Agenda for the 12th of
September if everything is recorded by then. I don't think we are looking
favorably towards a whole year extension. We are looking for some
' progress on this Subdivision.
Mr. Babcock asked if the Registry of Deeds will accept a
duplicate, may I get copies from you?
Chairman Wood replied first find out if they will accept the
duplicate, then call the Department and we will assist you.

' Mr. Barker stated I would like you to understand that I want to
see progress down there. It is my personal opinion that if you grade
gravel, if will just settle over the Winter and I would like to see a
binder course on the sidewalk and a written agreement regarding the stone
wall. I think you should leave here with a strong feeling that. March 1,
1984 is going to be the first. extension.
The matter was tabled until September 12, 1983.
The meeting adjourned at 8:24 P.M.
