HomeMy WebLinkAbout1983-07-25 Board of Survey Minutes Board of Survey Meeting of July 25, 1983 Page 1 ' A meeting of the Board of Survey convened in Room 16, Municipal Building at 8; 10 P.M. Present were Chairman Wood, Board Members Polychrones, Griffin and Hampson, Superintendent E. Roger Louanis and Assistant Superintendents Edward D. McIntire Jr., and William R. Bergeron. It was moved, seconded and voted 2:0:2 (Mr. Polychrones and Mr. Hampson abstaining) to accept the minutes of the Board of Survey meeting of July 11, 1983 as written. Mr. Griffin read the Notice of Public Hearing regarding the approval, disapproval or modification of plans for a new subdivision called Batchelder Estates. The proposed subdivision will provide for fourteen (14) new lots. The roadway is located on the northerly side of Franklin Street between Pearl Street and Haverhill Street adjacent to ' Batchelder Field. There were approximately six residents present as well as several members of the Conservation Commission. Mr. William Jones of Dana Perkins and Associates, the Engineer for the development, introduced himself and presented the plan to the group. He stated he has submitted this development to the Conservation Commission and have obtained an Order of Conditions. All of the lots abutting the Flood Plain Zone contain at least the 12,000 square feet outside of the Flood Plain Zone. Chairman Wood stated the names of the streets must be changed. Mr. Jones stated we have submitted a revised set of plans and are . proposing the names Deer Run and Quail Run for the new roadways. Mr. Polychrones requested that one of the streets be named Douglas A. Cowell Drive in honor of our deceased Board Member. Board of Survey Meeting of July 25, 1903 Page 2 ' Attorney 0. Bradley Latham stated the applicant would have no problem with this request. Chairman Wood stated the proposed sewer pumping station is located on a lot, which bothers her. Although we have an easement, the owner of that lot may not allow us to go on his land at midnight, should a problem arise. Mr. Jones replied the pumping station is located 100 feet from the dwelling. The specifications will require some type of screening or fencing so that it will be obvious to the owner that it is there. The alternative is to put it in the middle of the cul-de-sac which presents its own problems, such as snow plowing, etc. Chairman Wood stated I still believe that public functions are ' best served on public land and not necessarily on the land of any individual homeowner. Chairman Wood stated she has the same problem with the drainage that goes across and backs up to the Batchelder Field area. Mr, Jones stated he thinks the practice of putting in culverts has been well established in this Town. The only other way around that was to run the drainage through Batchelder Field. The culvert could be extended and channelled into Town property. Mr. Bergeron stated the plans before you tonight have had some 30 modifications. The developer's attorney feels that the Town does not have the right to extend the drainage beyond the Town's land. Mr. Jones stated the water we are talking about is flowing into the Flood Plain District and this is the purpose of the Flood Plain District. This plan follows the contour of the land. The applicant is willing to do whatever is required and whatever can be done within the Zoning By-Law. Board of Survey Meeting of July 25, 1983 Page 3 ' Attorney Latham stated the applicant would like to request the plan be modified and that this Board have an additional 45 days to render their decision and ask Town Counsel to rule on the rip-rap in the Flood Plain Zone and the Conveyance of Easements and Utilities in that area. We would then file a Notice of Intent. It was moved, seconded and voted 4:0 for a 45 day extension for the time to act on this Subdivision upon request of the Applicant. Chairman Wood stated we need a legal opinion from Town Counsel on what the best way of handling this would be and that is why we are extending the time for 45 days. It was moved, seconded and voted 4:0 to continue this Hearing to September 12, 1983 at 8:00 P.M. ' The meeting adjourned at 9:25 P.M. Respectfully submitted, Secretary 1
