HomeMy WebLinkAbout1982-04-26 Board of Survey Minutes Board of Survey Meeting of April 26, 1982 Page 1 A meeting of the Board of Survey convened in Room 16, Municipal Building at 8:00 P.M. Present were Chairman Wood, Secretary Fallon, Board Members Cowell, Parker and Polychrones, Superintendent E. Roger Louanis and Assistant Superintendent William R. Bergeron. It was moved, seconded and voted 5:0 to accept the minutes of the Board of Survey meeting of April 20, 1982 as written. Mr. Fallon read the Notice of Public Hearing at 8:00 P.M. of the Final Hearing regarding the approval, disapproval or modification of plans for a new way called "Buckskin Drive". The proposed subdivision will provide for seven (7) new lots. The roadway is located on the southerly side of Franklin Street between Blueberry Lane and Fox Run Lane. There were approximately fifteen residents present as well as representatives of the Conservation Commission and Mr. Robert Lynch, the Engineer and Mr. James Pacy, the Developer. Mrs. Wood introduced the Board and explained that Mr. Lynch would give his presentation, then Mr. Bergeron would speak on behalf of the Department, and the meeting would then be open for questions. Mr. Lynch stated there are nine total lots proposed, of which one will be donated for conservation use and one is an existing property. Therefore, seven new homes will be built, six on the proposed road and one on Franklin Street. The proposed road will be 400 feet long. Lot 9 is being donated to the Conservation Commission because it is subject to seasonal ponding. Board of Survey Meeting of April 26, 1962 Page 2 Mrs. Sally M. Hoyt, Co-Chairman of the Conservation Commission, distributed a letter dated April 26, 1982 to the Board from the Conservation Commission outlining the design modifications they would recommend regarding the design of Buckskin Drive. Specifically, (1) reduction of filled and disturbed areas, (2) reduced impervious area (3) traffic generation will be minimal (4) pedestrian safety would not be reduced and (5) parking and emergency needs would still be met. Mrs. Mood inquired if this area would open another access to the Kurchian Woods and Mr. Carl Gardner of the Conservation Commission answered it would be strictly a pedestrian access. Mr. Cowell asked what the Conservation Commission intends to do with the so-called pond. Mr. Gardner answered that it is basically an area of seasonal high water, and the drainage would be re-routed. He stated that as long as the drainage is properly constructed, the Conservation Commission finds no problem with the construction. Mr. Mark McCabe of Franklin Street stated he was very concerned with the drainage and preservation of the wildlife in that area. Mr. William Bergeron of the Engineering Department stated the original schedule was given in February. The Department wrote a list of 46 concerns at that time that were answered by the developer on Thursday, April 22. He stated there are still 27 concerns that have not been addressed or complied with. Mr. William Fowler of 323 Franklin Street stated he was very disappointed with the lack of response from the Developer. Board of Survey Meeting of April 26, 1952 Page 3 Attorney Thomas M. Leahy spoke on behalf of his clients, David J. and S. Michael Brown, specifically stating that his clients' land would be landlocked by the building of this subdivision. Mr. Edwin Ciampa of 315 Franklin Street was very concerned with traffic problems. He felt this is a dangerous place on Franklin Street for a new development because of the curve. Mr. James Pacy, the Developer, questioned Mr. Bergeron on the technicalities the Board is concerned with regarding the illegal lots. Mr. Bergeron stated that the drainage problems should have been addressed and that the hydraulic calculations submitted were not acceptable. It was moved, seconded and voted 5:0 to close the Hearing at 9: 10 P.M. and that the Board reconvene as the Board of Survey. The meeting reconvened at 9:30 P.M. The Board concurred unanimously that because of the problems cited, they could not approve the plan as submitted. Mr. Fallon moved that the Board approve the Subdivision Definitive Plan entitled Oak Knoll Acres "Buckskin Drive", as drawn by Northeastern Engineers of Burlington, Mass. The motion was seconded and defeated 0: 5. Mr. Cowell moved that the Board of Survey Hearing close at 9:40 P.M. and the Board reconvene as the Board of Public Works, it was seconded and voted 5: 0.
