• A meeting of the Board of Survey convened in Room 16, Municipal a
Building at 7:30 P.M. Present were Chairman Cowell, Secretary Wood, Board
Members Fallon and Barker and Superintendent E. Roger Louanis.
It was moved, seconded and voted 4:0 to accept the minutes of the
Board of Survey Meeting of January 4, 1982 as written.
Mrs. Wood opened the Hearing at 7:30 P.M. by reading the Notice
of Public Hearing regarding the Horizon Homes Project on Bay State Road.
The Board is scheduled to take action on the final site plans of Horizon
Homes.
Present were Herbert Converse, Margaret Brill and Nate Hicks "
representing the builders and developers of the project. Also present
were fifteen citizens, abutters of the project.
Mr. Converse gave a presentation to the Board and the citizens in
attendance and explained the site plans and the changes that have been
made to it. He stated there would be a 12" water main between Bay State
Road and Haverhill Street on their property. Superintendent Louanis
pointed out that Horizon Homes will pick up the cost of laying the 12"
pipe from Haverhill Street to Bay State Road. The drainage will all go to
the rear of the property in a northerly direction. The entrance roadway
will meet the requirements of the Board of Survey regulations for a road
in a subdivision. There will be a 30' radius an the left side and a 25'
radius on the right side. There will be catch basins on both sides of the '
road, so no problems with drainage are anticipated.

Mr. James McTaggart, 36 Day State Road, questioned the flow of
the rainwater, whether it will flow to the right or left.
Laurie Boucheu of 41 Day State Road, stated that she has had many
problems with water in the basement of her home, the most recent being " . .
having her house exterminated for termites possibly because of her water
problems.
Superintendent Louanis stated that the design of the drainage
system is such that the water will not go out onto Day State Road. The
grade of the building and the parking area is set so that the drainage is

sufficient. �
The Board of Public Works Engineering Division and the
Conservation Commission have both agreed that the drainage will not cause
problems.
Superintendent Louan is stated that if this plan is approved and
built, and there are additional drainage problems, the homeowners could

bring a civil suit against the builders. '
Mr. Paul Fiore, 55 Day State Road stated there is a brook present
between houses 41 and 43 Bay State Road and the water is flowing in a
southerly direction.
Mr. Curt Nitzche, owner of property at 36 and 42 Bay State Road,
stated he has never seen a brook in the area.
Laurie Boucheu of 41 Bay State Road stated that it is written in
the deed to her house that there is a spring running between houses 41 and
43 Bay State Road. .�

Mr. Reggie Peters of 62 Bay State Road inquired as to the number
of parking spaces being planned at the site. Mr. Converse answered that
• 74 spaces are being planned.
Mr. McTaggart of 30 Bay State Road was concerned with traffic in
the area and inquired if a traffic study had been done. He was informed
by the Board that a study had not been done. However, Mr. Barker informed
him that perhaps the Contractor could be persuaded to erect safety signs
at the end of the street to warn cement trucks, etc. of children in the �.
area.
• The residents inquired about a safety access road out to
Haverhill Street from the other end of the site. �.
The Board informed the citizens that the Conservation Commission
does not want to disturb the Wetlands, so there can be no other road out a
to Haverhill Street.
Mr. Peters asked if there is a water pipe going to be laid out to
• Haverhill Street, will it not affect the Wetlands and therefore perhaps an •
emergency roadway could be put in. 10
Attorney Brill answered that regarding the exit roadway, the
• issue has been discussed in front of the Board of Appeals and the •
Conservation Commission, neither of which would allow for a roadway in the
Wetland Area.
• Mr. Fiore stated he felt the proper thing to do would be for the •
Board to go down and look at the water situation.
It was moved, seconded and voted 4:0 to close the Hearing at 8:25
P.M.
