HomeMy WebLinkAbout1980-10-30 Board of Survey Minutes October 30, 1980 ' Meeting of the Board of Survey convened in Room 16, Munici- pal Building at 7: 30 P . M. Present were Chairman Cowell, Secretary Wood, Board Members DeHart , Fallon, Barker and Clerk of the Board Louanis and Assis- tant Superintendent Bergeron. Chairmen Cowell welcomed the thirteen (13) people in atten- dance and Secretary Wood read notice of the continuance of a pub- lic hearing at 7:30 P .M. regarding the approval, disapproval or modification of a definitive plan for Gavin Circle . The proposed subdivision will provide for ten new lots and will extend in a northerly direction from Franklin Street approximately 874 feet between Main Street and Pearl Street. Mr. Symes , the developer, was present and was represented by Attorney 0. Bradley Latham and Peter Ogren, P . E . of the firm of Hayes Engineering, Melrose, Ms. Chairman Cowell introduced the Board and stated that the developer and/or his representatives would make a presentation , ' questions would be forthcoming from the Board and then the developer would entertain questions from the citizens. Mr. Ogren , P. E. outlined the modifications that had been made to address the concerns of the previous hearing and how those pro- blems had been resolved . Chairman Cowell asked the Department if any items of concern remained. Assistant Superintendent Bergeron indicated all items had been addressed and the requested calculations had been sub- mitted and reviewed. Mrs. Sally M. Hoyt, Co-chairman of the Reading Conservation Commission read the attached letter at the hearing. Mr . and Mrs. Graham of 640 Pearl Street expressed their con- cern about additional runoff to their property caused by the con- struction. Mr. Ogren explained how the new drainage system would operate and indicated that there should be no difference in flow. The question of a possible additional lot on Pearl Street was discussed at length. Clerk of the Board Louanis indicated it would be possible to create a new lot after the subdivision is approved by use of a subdivision not approved since it would be possible to create a lot with legal frontage and area according to the zoning By-Laws but he indicated that the Pearl Street lot would be subject to the Conservation Commission' s approval prior , to any building. Mr. Hadad and Mr . Campbell repeated their previous concerns with traffic safety problems on Franklin Street. Attorney Latham indicated that since the last hearing he had discussed the problem with the Police Chief as well as previously discussing it with the Safety Officer . He also pointed out that as long as the subdivision conformed to the Board of Survey Rules and Regula- tions the Board had no recourse but to permit the entrance onto Franklin Street a public way. Mr . Campbell indicated there was a problem with water dis- charging onto abutting property downstream of the existing drain- age system discharge point. Attorney Latham indicated agreements had been made to rectify that problem with the landowner. Mr. Hadad requested a delay by the developer for two weeks for further check with the Safety Officer and the Police Chief. Attorney Latham indicated there was ample time since the people were made aware of the plans at the preliminary hearing on Decem- ber 3, 1979 to request any such information and would not agree to any delay . There being no further questions it was moved , seconded and voted to close the hearing at 9 :00 P .M. The Board reviewed a request for Amendment to the Protective Water Quality Easement by Attorney Plunkett to clear the intent of the proposed restrictions. Mr. Bergeron outlined what was requested and how the Department proposes to change the wording. Following a discussion it was moved , seconded and voted 5 :0 to accept the modification as proposed by the Department. Mr . Bergeron also explained that the homes on Lots 6 and 7 had covered decks constructed over the easement. It was moved, seconded and voted 5:0 to allow the encroachment as the structure currently exists provided a certified foundation location of the existing structures and attached appurtenances be given to the Board of Public Works to be kept on file . , The Board discussed at length the Gavin Circle subdivi a ion and it was moved, seconded and voted 3:2 to approve the subdivi- Minutes continued October 30, 1980 sion as submitted subject to all the normal provisions.
