HomeMy WebLinkAbout1980-09-08 Board of Survey Minutes ' September 8, 1980 Meeting of the Board of Survey convened in Room 16, Municipal Building at 7:35 P . M. Present were Chairman Cowell, Secretary Wood, Board Members DeHart, Fallon, Barker and Clerk of the Board Louanis. It was moved, seconded and voted to accept the minutes of the previous meeting as corrected. Chairman Cowell, at the previous meeting, had requested that any decision concerning Latham Lane be postponed until such time as the Clerk of the Board was available, and since Mr. Louanis was present the Board met with 0 . Bradley Latham, Esquire, Peter Ogren of Hayes Engineering and Mr . Albert Symes developer of property on Latham Lane. Attorney Latham stated that to his knowledge no where in the Board of Survey Rules and Regulations did it state that a cellar floor be at an elevation where it could be sewered. Chairman Cowell stated that in his tenure on the Board he was not aware of a variance in cellar floor elevations being granted and that was why he wished Mr. Louanis to be present. Mr. Louanis offered that other develop- ments in Town have received approval from the Board of Survey and do not have an elevation which could be sewered: the main reason for setting cellar floor elevations is to insure a dry basement, as the Board of Survey relates to wetlands and water table. Mr. Ogren assured the Board the rear of the properties involved was two to three feet lower than the elevation requested for cellar floors there- fore drainage would not be a problem. It was moved, seconded and voted 5:0 to reconsider the matter. Mrs. Wood moved to grant the variance proposed by Symes Associates for the modification of plans for cellar floor elevations on Latham Lane as follows: Lot 3 - 189.5 Lot 4 - 190.0, Lot 5 190.5 , Lot 6 - 191.0 with the stipulation that Mr . Latham record each elevation on each Purchase and Sales Agree- ment andon each deed . It was moved, seconded and voted 5:0 to adjour at 8 :30 P .M. Re spe, ptfully submitted , Secretary 'Z
