' Meeting of the Board of Survey convened in Room 16, Munici-
pal Building at 8:00 P. M.
Present were Chairman Dustin, Secretary Price, Board Members
Russell , Cowell and Testa, Clerk of the Board E. Roger Louanis,
Developer John Rivers, Attorney 0. Bradley Latham and Peter Ogren
from the firm of Hayes Engineering, Inc.
Secretary Price read Notice of Public Hearing regarding
final plan of Sunnyside Avenue Extension. The Chairman opened the
meeting by requesting the developer to present the plan to the
Board and the citizens attending the Hearing. The Developer, John
Rivers was represented by Attorney 0. Bradley Latham and Peter
Ogren of Hayes Engineering who presented the Plan outlining the
Extension of Sunnyside Avenue to a dead end and ending in a cul -
de-sac with five buildable lots and the back lot which was not
buildable and would remain in common ownership with one of the
buildable lots until it was disposed of as possible conservation
land. The builder presented technical data requested by the

Engineering Division regarding the design of the Subdivision in-
cluding drainage computation and technical details supporting the
proposed design. In respect to the list of deficiencies presented
to the Engineer, Mr. Price moved, it was seconded and voted to
postpone the Hearing until the Notice of the Public Hearing for
Cumberland Road Extension was read and that both hearings be
continued jointly since they abut one another. Mr. Price read
Notice of Public Hearing regarding the Final Plan of Cumberland
Road Extension. The Chairman opened the hearing announcing that
both subdivisions were now being heard jointly and asked the
engineer to present the Plan of Cumberland Road Extension. Con-
siderable discussion ensued regarding the nonbuildable lot which
showed on both subdivision plans concerning what disposition the
owner planned for the lot and how it would be legally handled
with the subdivision. Board members asked questions regarding
drainage and sewer design all of which had been submitted for the
' first time to the Engineering Division at this Hearing and had
not been properly reviewed by the Engineering Division. Mr.
Berberian of Summer Avenue brought to the Board' s attention his
concern for drainage and run off on Summer Avenue across his lot
and wanted to be assured that the proposed Subdivision of Cumberland
Road Extension would not create a water problem for him. Mrs. Stone
and Mr. Nazarro of 21 Melbourne Avenue expressed concern of the '
adaquacy of the drainage system to handle the drainage and runoff
from the proposed extension of Cumberland Road. After consider-
able discussion of the drainage problem it was agreed that Hayes
Engineering would meet with members of the Public Works Engineering
Division and the citizens on December 14, 1978 at 2:00 P.M. to view
the problem in the field. The Chairman apprised the Board of the
fact that the Board had not scheduled a meeting until January 8,
1979 and they would have to act on the subdivision before January
3, 1979 to stay within the legal time limit required by the Sub-
division Control Law. It was suggested that the developer should
request an extension of time to January 17, 1979 to allow the Board
sufficient time to act on the plan. The developer indicated that
he was agreeable to the extension of time and he would present a
letter to the Board requesting the extension on December 12, 1978.
Mr. Price moved, it was seconded and voted that the Hearing for
both subdivisions be closed. It was moved, seconded and voted to '
postpone action on this until a date no later than January 17, 1979
with the understanding that the developer or his counsel will be
requesting such an extension. It was moved that in preparation for
future action by the Board the Board meet with the Builders Engin-
eer and interested abutters Saturday, December 16th at 2:00 P.M.
and that they have recommendations for the Board at the next meet-
ing January 8, 1979. It was seconded and voted.
The Board signed a Release from the Covenant Agreement re:
Countryside Lane Extension.
