HomeMy WebLinkAbout1978-10-30 Board of Survey Minutes October 30, 1978 Meeting of the Board of Survey convened in Room 16, Muni- cipal Building at 7:40 P. M. Present were Chairman Dustin, Secretary Price, Board Members Russell , Cowell and Testa and Superintendent Louanis. The Finance Committee was represented by Jose Canto and Gail Wood. Minutes of the previous meeting were accepted as written. The Board of Survey reviewed letter of October 25, 1978 from the Law Office of Latham and Latham regarding proposed building of a house on Lot 38 Timberneck Drive owned by Mr. and Mrs. Doherty. The letter stated the property in question was in the Flood Plain District and an application to the Board of Appeals for a special permit under the Zoning By-Law 4.4.4.2 "If any land shown on the Zoning Map or defined in the By-Laws as being in a Flood Plain District is proven to be in fact neither subject to flooding nor unsuitable for human occupancy because of drain- age and topographic conditions, and if the use of such land will not be detrimental to the public health, safety and welfare, the Board of Appeals may permit buildings for human occupancy on such land in accordance with the requirements of the underlying district after the necessary proof has been presented to and reported on by the Board of Survey and the Board of Health." The Superintendent reported to the Board that he did not feel that the applicant had submitted sufficient information on which the Board could take action and suggested that the applicant' s lawyer be informed that a report by an engineer would be necessary before the Board could take action. It was moved, seconded and voted to instruct the Superintendent to so notify the law firm. Meeting adjourned at 7:50 P.M. pectful l y�ubr tted, tary
