' Meeting of the Board of Survey opened in Room 16, Munici-
pal Building at 8:00 P. M.
Present were Chairman Dustin, Secretary Price, Board Members
Blood, Russell and Botka, Superintendent Louanis, Assistant Super-
intendent Bergeron, Assistant Engineer Redford and Finance Committee
Member Douglas Cowell .
Minutes of the previous meeting were accepted as written.
Mr. Dustin opened the meeting by stating it was the Final
Hearing on the extension of Hanscom Avenue and requested the
owner or his representatives come forward to make a presentation
to the Board and the attending abutting property owners and the
Conservation Commission. Mr. Babcock introduced himself and
stated that he was the owner of the property, his engineer was
not available for the meeting and he would attempt to answer
questions . Mr. Dustin asked the developer if he had reviewed the
' concerns (thirteen points) of the Engineering Division and if he
was prepared to answer giving all information available to the
Board. Mr. Babcock indicated he was not an engineer and could
not answer the questions . Mr . Dustin asked the Conservation
Commission if they had any concerns to present at this time.
Their Chairman and the Consultant pointed out concerns for the
wetland, the water table as it affects the abutting property and
possible damage it could have on the down stream system.
At this point Mr. Blood requested the legal time in which
the Board had to act. Acting Assistant Superintendent Bergeron
informed the Board that a recent check with the Town Clerk re-
vealed an application for the hearing had not been filed. Mr .
Blood checked with the Town Clerk and found the application was
not on file in the Town Clerk 's Office. Several abutting property
owners expressed concern for the damage to the area and how it
would effect their homes and property. Answers to these ques-
tions could not be given because the Developer ' s Engineer was
not present. The Chairman addressed the assembly saying that
the lack of filing of proper notice with the Town Clerk by the
Developer in effect made the Hearing a non—hearing and it was
moved, seconded and voted to close the Hearing and hold a new ,
Hearing when all concerned have complied with the proper legal
procedure.
