HomeMy WebLinkAbout2001-01-04 Zoning Board of Appeals Minutes - Draft TOWN OF READING DRAFT ZONING BOARD OF APPEALS MINUTES OF JANUARY 4, 2001 MEMBERS PRESENT: JOHN JAREMA SUSAN MILLER EDMUND BALBONI A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the Town Hall, 16 Lowell Street, Reading, Massachusetts at 7:00 PM. Building Inspector Glen Redmond was also in attendance Case#00-17 A continuance of a Public Hearing on the petition of H.B. Development Corporation who seeks a Comprehensive Permit under Section M.G.L. Chapter 40B in order to construct eight buildings containing a total of 32 condominium units on the property located at 443 Grove Street,Reading,MA Atty. David McBride stated they have received approval from CPDC. They are still waiting for ajudgement from the previous lawsuit in the land court resolution. He requested the public hearing be continued. On a motion by Edmund Balboni, seconded by Susan Miller, the Zoning Board of Appeals voted to continue the public hearing for Case #00-17,H. B. Development corporation,for the property located at 443 rove Street,Reading,MA, at the request of the petitioners attorney. The motion was approved by a vote of 3-0-0. Case#00-35 A Public Hearing on the petition of Joseph& Wendy Calaresso who seeks a variance/special permit/appeal from the decision of the building Inspector under Section 4.2.2/6.1.1.2 of the Zoning By-laws in order to place goods outside the canopy and not consider this open storage on the property located at 122 Main Street, Reading, MA. Case#00-36 A Public Hearing on the petition of Walter Arsenault&Daniel Arsenault who seeks a variancelspecial permit/appeal from the decision of the Building Inspector under Section 4.2.2/6.1.1.2 of the Zoning By-laws in order to display goods as open storage and to allow parking serving a neighboring property on the property located at 126 Main Street, Reading,MA. Atty. Brad Latham requested that Case 400-35 and Case#00-36 are held concurrently. Chairman John Jarema swore in the applicants. Zoning Board of Appeals Minutes of 1/4/01 page 2 4W Atty. Brad Latham stated there has been a historical display of potted plants and trees at this location. The applicant received a complaint from the Zoning Administration stating that this is open storage. They believe this is"display and sale", stating storage is putting an item away and this is displaying an item for retail sales. Automobile sales are another example of this. Atty. Latham stated that if the Zoning Board believes this is substantially true,but not fully, they could grant a special permit with the added restriction of not impeding parking. He also stated that the plants need sunlight. Building Inspector Glen Redmond stated this is open storage.He is concerned with a ripple effect. The petitioner is impeding their parking and parking onto the adjoining lot. John Jarema asked if the products are brought inside during the evening. Atty. Latham stated they are not. Walter Arsenault stated the current parking area is sufficient for their current business. They currently have 70 parking space and usually need only 40 spaces. John Jarema stated he would like to seek guidance from Town Counsel. He requested a rendering of the parking spaces from the applicants. On a motion by Edmund Balboni, seconded by Susan Miller, the Zoning Board of Appeals voted to continue the Public Hearing on Case 400-35 and Case#00-36 until January 18, 2001,to allow the petitioner time to provide schematic plans for the new parking and building and to allow Town Counsel time to review these cases. The motion was approved by a vote of 340-0. The Zoning Board of Appeals unanimously voted to adjourn their meeting at 8:30 p.m. Respectfully submitted, Joy Mohr Recording Secretary
