HomeMy WebLinkAbout2001-04-05 Zoning Board of Appeals Minutes - Draft 7, RA ; TOWN OF READING ZONING BOARD OF APPEALS MINUTES OF APRIL. 5, 2001 MEMBERS PRESENT: MICHAEL LARKIN JOHN JAREMA EDMUND BALBONI SUSAN MILLER BERNARD O'SHAUGHNESSY A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the Town Hall, 16 Lowell Street, Reading, Massachusetts at 7:00 PM. Building Inspector Glen Redmond was also in attendance. Case#01-04 A Public Hearing on the petition of Jill& Carl McFadden who seeks a variance/special permit/appeal from the decision of the Building Inspector under section 5.1/5.1.2/6.3.1.2 of the Zoning By-laws in order to raze the existing dwelling and construct a new dwelling on a nonconforming lot on the property located at 33 Wakefield Street,Reading, MA. Chairman Michael Larkin swore in the applicants. Atty. Brad Latham represented the petitioner. The existing dwelling is a cape style house created in 1947. The lot size is 15,646 sq. ft. and is located in a S20 Zoning District. Any. Latham submitted the deed, including the change of titles, and the assessors records dating back to 1948.. The property was not held in common ownership. The petitioner purchased the property in 1998. They would donate their existing house to the Town of Reading and then build a single family, farm style house. The setbacks meet the zoning requirements. Atty. Latham cited Case#00-15, July 20, 2000, with similar circumstances, and the Zoning Board of Appeals allowed relief. John Jarema was concerned with the height of the new house. The height of the existing house is approximately 21' and the new house would be 30'. Atty. Latham stated the surrounding houses are approximately 30' high. Atty. Latham submitted letters, in support of this project,from abutters Nancy &Jim Lydon and Joseph and Kimberly Ciccariello. On a motion by John Jarema, seconded by Edmund Balboni,the Zoning board of Appeals voted to close the portion of the public hearing for taking testimony. The motion was approved by a vote of 3-0-0. On a motion by John Jarema, seconded by Edmund Balboni,the Zoning Board of Appeals voted to overturn the Building Inspector's decision, to consider the lot at 33 Wakefield Street,Reading,MA, a buildable lot, and on receipt of the proper documentation, to issue a building permit, subject to meeting all the zoning requirements. The motion was approved by a vote of 3-0-0. Zoning Board of Appeals Minutes of 4/5/01 page 2 L Case#01-05 �r A Public Hearing on the petition of John Blake who seeks a variance/special permit/appeal of the decision of the Building Inspector under Section 4.2.2/2.2.1/6.3.2 of the Zoning By-laws in order to renovate the existing detached structure for use as a family room on the property located at 291 South Street, Reading,MA. Chairman Michael Larkin swore in the applicants. The petitioner is seeking a variance/special permit to convert their existing detached barn into living space. The first floor is a family room and the basement is a work area. The upstairs square footage is 27' x 24 ''1'. The remodeling would include new windows, a new roof and propane heat. Glen Redmond questioned whether the barn was an accessory structure. He requested a floor plan to determine the exact use of the building. John Jarema stated the building could not be used as an apartment. He requested a justifiable statement, on how the space would be used,to determine if the use is incidental. Walter Begonis, 289 South Street, Reading, MA, stated he has lived next to the barn for 29 years. He would prefer to see the barn rather than an addition. On a motion by Edmund Balboni, seconded by John Jarema, the Zoning Board of r Appeals voted to continue the hearing on the petition of John Blake for the property �r located at 291 South Street,Reading, MA, until April 19, 2001. The motion was approved by a vote of 340-0. Case#01-06 A Public Hearing on the petition of Courtney Evans who seeks a variancelspecial permit under Section 5.0/6.3 of the Zoning By-laws in order to add a dormer to the second level and to construct a porch with a roof to the rear on the property located at 128 John Street, Reading, MA. Chairman Michael Larkin swore in the applicants. The petitioner stated he is renovating his house after last summer's fire. They have owned this house for 22 years. The would like to add a 12 '1' dormer and extend the existing ridge pole back 5' to enlarge an existing bedroom. They are building on the existing footprint. The lot is 4,914 sq. ft. The house is 25' from the next door neighbor and 2.8' from the lot line. The petitioner submitted a letter from their neighbor in favor of this project. John Jarema asked the petitioner when the back addition was added to the house? The petitioner responded he did not know.. . .. Zoning Board of Appeals Minutes of 4/5/01 page 3 F On a motion by Susan Miller, seconded by John Jarema,the Zoning Board of Appeals fir' voted to grant Courtney Evans, for the property located at 128 John Street, Reading,MA, a Special Permit under Section 6.3.3.4 of the Zoning By-laws, to construct a second story addition and a dormer wall on the northerly side of the house,that shall not extend beyond the present foot print, as shown on the plans prepared by Steven Manning, dated September 2000, revised November 18, 2000. The motion was approved by a vote of 3-0-0. The petitioner requested to withdraw their request for a variance for the back porch, without prejudice. On a motion by Susan Miller, seconded by John Jarema, the Zoning board of Appeals voted to grant Courtney Evans, for the property located at 128 John Street, reading, MA, a Variance under Section 5.1.2 of the Zoning By-law,to build a 5' x 12' second addition and dormer on the northerly side, with a side yard set back on the northerly side of 2.8', as shown on the plot plan submitted by the petitioner, dated February 5, 2001. The motion was approved by a vote of 3-0-0. On a motion by John Jarema, seconded by Edmund Balboni, the Zoning Board of Appeals voted to accept the withdrawal of Courtney Evans, of their request for a variance, without prejudice for the porch on the back entrance. The motion was approved by a vote of 340-0. 6 On a motion by John Jarema, seconded by Edmund Balboni, the Zoning Board of Appeals, voted to close the Public Hearing at 9:35 p.m. The motion was approved by a vote of 3-0-0. New/Old Business Town Planner Anne Krieg submitted the proposed new wording of Section 6.3 of the Zoning By-laws. The general consensus of the Zoning Board members was to change two of the sections. The first change was to remove Section A from 6.3.1.1. and secondly,to remove Section A from 6.3.17. Glen Redmond requested definitions.
