HomeMy WebLinkAbout2002-04-04 Zoning Board of Appeals Minutes - Draft LDRAFT TOWN OF READING ZONING BOARD OF APPEALS MINUTES OF APRIL 4,2002 MEMBERS PRESENT: MICHAEL LARKIN JOHN JAREMA EDMUND BALBONI ROBERT REDFERN DONNA BOGGS A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the Town Hall, 16 Lowell Street, Reading, Massachusetts at 7:00 PM. Building Inspector Glen Redmond was also in attendance. Case#02-02 A Public Hearing on the petition of Kevin M. Brown who seeks a special permit and/or appeal from the decision of Anthony Fresco who seeks an appeal from the decision of the Building Inspector under Section 6.3.17/7.4 of the Zoning By-laws in order to construct a 16'8" x 22'4" free standing structure that does not conform to current setbacks on the property located at 941 Main Street, Reading, MA Chairman Michael Larkin swore in the applicants. 4 Kevin Brown is seeking a permit to reconstruct a 16'8"x 22'4" shed on his property. He demolished the previous structure. There is an existing 4' foundation, a poured concrete floor, and supplied conduit. Mr. Brown purchased the 8,897 sq. ft. property in 1978. The property includes a two story residence, a one story commercial garage, and an open walled detached shed. There is a special permit for the commercial use. Glen Redmond stated the existing structure was tom down without a permit. The shed is too close to the property line to rebuild. He issued a"stop work order". Michael Sandberg, 935 Main Street, Reading, MA, stated this is not a rehabilitation of the original structure. The new structure comes to the edge of his property line. The roof is much higher and it overhangs on his property. The roof run off from the snow and rain will fall on his property. The new building appears to be for commercial use, since the door faces the adjacent auto body shop. The residence has been vacant since 1994. Mr. Brown stated the entrance is dictated by the existing wall. Michael Venuti, 12 Hampshire Road, Reading, MA, resident since 1977, stated the shed was initially used for recreational purposes. The shed is now used for repairs by the auto body shop. There is a constant smell of paint fumes. ( Zoning Board of Appeals Minutes of 4/4/02 page 2 Yvonne Vernon, 12 Hampshire Road, Reading, MA, submitted a copy of the special permit. The special permit lists the use as an auto body shop. She requested Glen Redmond look into the paint spraying booth. Glen Remond stated he would Michael Brossard, 8 Hampshire Road, Reading, MA, stated the fumes are so strong when they are spray painting cars he can not go outside. John Jarema stated he did not want to increase the non-conformity further by placing the shed too close to the property line. He stated the use of the shed should remain storage and questioned what would be stored there since the residence is vacant. Michael Larkin stated, with the house vacant, it appears the use of the shed will be connected to the garage. Robert Redfem stated it appears to be a change in use and an expansion. Mr. Brown stated he will store the usual house hold items such as a lawnmower and rakes. Glen Redmond stated there is no existing structure and the petitioner must conform to the set back requirements. The shed can not be closer than 5' to the lot line and no larger than 25% of the back yard. On a motion by John Jarema, seconded by Edmund Balboni,the Zoning Board of Appeals voted to grant Kevin M. Brown a Special Permit under Section 6.3.17/7.4 of the zoning by-laws, in order to construct a 16'8" x 22'4" free standing structure at 941 Main Street, Reading MA. The motion was denied by a vote of 0-3-0. Case#02-03 A Public Hearing on the petition of Mike and Ellen Canterbury who seeks a variance under section 5.1.2 (Table of Dimensional controls) of the Zoning By-laws in order to construct a front and rear deck within the required front and side yards on the property located at 25 Wilson Street, Reading, MA. Chairman Michael Larkin swore in the petitioners. The petitioner is requesting a variance to construct a front stoop 6' x 6', a 5' wide side deck, and a 17' x 12' rear deck. The petitioner received approval from the Conservation Commission for a minor structure. The house was built in 1948. The side set back is 14'6" and is non-compliant with the 15' side set back requirement. Building Inspector Glen Redmond denied the petitioner a building permit. The applicant requested a continuance to review their petition. Zoning Board of Appeals Minutes of 4/4/02 page 3 On a motion by John Jarema, seconded by Edmund Balboni, the Zoning Board of Appeals voted to continue Case 402-03 on the petition of Mike and Ellen Canterbury for the property located at 25 Wilson Street, Reading, MA, until May 9, 2002. The motion was approved by a vote of 3-0-0. #02-04 A Public Hearing on the petition of William J. Hanson&Marlene Wolf who seeks a variance under section 5.1.2/5.2.3.4/6.2 of the Zoning By-laws in order to construct a canopy within the required setbacks and to install the number and size of signs as indicated on plans on the property located at 2-4 West Street, Reading, MA. Chairman Michael Larkin swore in the applicants. Arty. Mark Babrowski, 37 Main Street, Concord, MA 01742, represented the applicant. Arty. Babrowski stated the applicant has received approval from CPDC. They are requesting a variance for a canopy 8'3" from the street in a business A district. The applicant submitted a new set of plans. Ally. Babrowski listed the variance qualifications as: 1. The lot is uniquely shaped that narrows in the rear forcing the canopy to be located in C the front. �r 2. Failure to have a canopy would cause direct financial harm. 3. The canopy is not detrimental to the neighborhood. There are other stations in Town with a canopy. The applicant is seeking a sign variance to add "Mobil"to the canopy. Arty. Babrowski referred to other stations in Reading that have three signs, one on the canopy, one on the building and one free standing sign. John Jarema asked if the Town Engineer was involved in the CPDC approval. Mr. Babrowski stated he was. John Jarema asked what direction the ground water run off from the station and canopy would be. Ally. Babrowski stated the front drains to the street and the rear drains to a separate system. The rear drainage system is the same as the one used on North Main Street. He is confident CPDC sized the drainage for the area. The drainage requirements are written into the CPDC decision. Arty. Babrowski stated this location has been a gas station for the past 45 years. Edmund Balboni stated they are expanding the use to include a Dunkin Donuts, office space, and a gas station. Edmund Balboni also requested the petitioner have a traffic study performed. Zoning Board of Appeals Minutes of 4/4/02 page 4 On a motion by Edmund Balboni, seconded by John Jarema,the Zoning Board of Appeals voted to continue the public hearing on William J. Hanson&Marlene Wolf for the property located at 2-4 West Street, Reading, MA,to allow the petitioner time to have a traffic study performed, until May 25,2002. The motion was approved by a vote of 3-0-0. On a motion by Edmund Balboni, seconded by John Jarema, the Zoning Board of Appeals voted to adjourn at 10:30 p.m. The motion was approved by a vote of 3-0-0.
