He will contact a sign company and work with them. Bond Street tree and wetland clearing The Commission looked at two pictures of 38 Bond Street. In 1998 there was no shed on property and trees covered the land. In 2008 there is a shed and the tree cover is gone. Mr. Hecht would like Mr. Tirone write a letter to the owner and have him remove the shed. The homeowner will be reminded that no clearing should be done. The owner will have 60 days to remove shed. The homeowner owes the Town some trees. Mr.Tirone will contact Mr. Keating,Tree Warden, and have him value the trees that were taken down. Mr. Tirone will contact the Town and have them remove the tree the resident partially cut down. Minutes for approval 1 Mating Minutes September 12,2012 Approved September 26,2012 Motion made by Mr. Tucker to approve August 22, 2012 meeting minutes as amended. Ms. Stewart seconded. Vote was 3-0-0. (Mr. Sullivan abstain, he wasn't there at the meeting) Motion made by Mr. Sullivan to approve July 25, 2012 meeting minutes. Ms. Scanlon seconded. Vote was 4-0-0. Motion made by Mr. Sullivan to approve August 8, 2012 meeting minutes. Ms. Stewart seconded. Vote was 4-0-0. Continued RDA 12-10: 100 Fairchild, Map,45, Lot 4, Heidom Mr. Hecht stated the homeowners decided to cut down all three trees. They are going to be planting 3 shrubs and 3 trees to replace the trees they are cutting down. Motion made by Ms. Stewart to issue a Negative Determination. Mr. Sullivan seconded. Vote was 4-2-0(Ms. Scanlon and Mr. Maughan feel the homeowners did not need to cut down all 3 of the trees on their property) Mr. Hecht reminded the Commission about the Ethnic training that everyone needs to attend. MACC Erosion Control 8 Guide-Mr.Tirone stated the Conservation Department has received three MACC booklets. It was requested Mr.Tirone keep one in the Conservation Department. The Commission members will share the other two. Johnson Woods site visit- Mr. Tirone stated there was nothing to report on Johnson Woods. The systems went in and he had Hayes look at the base of one of them. Hayes said the soil is okay. Perfecto's Caffe Mr. Tirone let the Commission know Mr. Gabriello, Perfecto's Caffe has presented some new plans. Mr. Gabriello is negotiating with eCars to make their new ideas work. They will bring to the Commission at the next meeting. It was asked that Mr.Tirone pull the CDC's from eCars and forward to the Commission. NOI 270-:211 Washington Street,Map, 17 Lot, 89, Brine Mr. Hecht opened the Public Hearing. The applicant would like to put a detached 2 car garage behind his house nearest to existing driveway as possible to keep driveway construction and impervious ground cover to a minimum. The nearby wetlands consist of a tributary with a solid bank that has been delineated and marked by a qualified Wetland Scientist. Mr. Hecht said this was straightforward. The garage is outside the 35'zone. He asked that the hay bails be setup as V shaped inside the fence area. Ms. Chilress, an abutter, asked what the applicant is going to use the garage for. She wanted to make sure it will not be used for a business. The applicant mentioned he is removing the old shed on his property. The shed is also out of the 35'zone. The Order of Conditions was not drafted; the Public Hearing will be continued. Motion made by Ms. Stewart to continue Public Hearing. Mr. Tuckerseconded. Vote was 6- 0-0. Ms. Chilress also wanted the Commission to know that there may be a blockage with the channel located on Washington Street. The flow is down to a trickle. Mr. Tirone will follow up with the DPW. Amended CDC 270-0545 Storage Shed, Causeway Road, Mass Highway 2 M.6,Minks SryW.W,12,2012 Aprno Se .k ,26,2012 Representative's for MassDot stated they would like to amend their original OOC. They would like to remove an old shed. If they can pick it up and remove it they will. If not,they will need to destroy it on the property and cart it away. They will seed and loom the area. The representatives were not sure if there were footings under the shed. Motion made by Ms. Stewart to amend the Order of Conditions. Ms. Scanlon seconded. Vote was 6.0.0. Policy Discussion: COC A resident at 422 Grove Street said he finished his project in the spring and would like to file for a Certificate of Compliance. He registered the OOC's at the Registry of Deeds. He went over what his project entailed and what the OOC's staled. He wanted to know the process to get a Certificate of Compliance. The Commission said after a site visit and stamped plans are received the Certificate of Compliance can be issued. Mr.Tirone needs to get the site plan and put the applicant on for a site visit on Sunday. The Commission talked about the size of the projects. Getting a certified plot plan is an added expense for some applicants. Maybe a Certificate of Compliance can be issued from the Commission with no asbuilt if no addition and excavation done,a certified letter from an engineer, a site visit from the Commission or administrator,and the work is beyond the 50'zone. The administrator will make sure the Commission has the plan for the site visit. There was concern that the Commission might not pickup on little things. Maybe how to get a Certificate of Compliance should be in the Order of Condition's. This way the applicants will know up front what to expect. Mr. Tirane told the Commission about a resident who is looking for a Certificate of Compliance because they are selling their house. The OOC's was on the builder not the homeowner. Mr. Tirone could not find any file on this. The Commission will make a site visit. Sturges Park improvements discussion Mr. Fuedo represented the Sturges Park Planning Committee who is interested in fixing up the park. They would like to create a Master Plan and present it to the community and Town Boards. They showed the Commission the parks as it is now and what they would like to do in phases. They have capital of$45,000, but are planning on doing some fundraising. The Commission had concerns about the wetland area that the Committee would like to change. The Stale rules might prevent them from doing what they would like in the"play field"area. The absolute maximum is 5000 square feet for replication. They would also need a variance from the Town. Mr. Tirone will make a site visit to point to the jurisdiction wetlands. If wetlands were created it might help the Committee. The Commission will look into the rules and the Sturges Park Planning Committee will come back to the Commission once some investigation is done. Mr.Tirone had a plan that he will forward to the Commission. Regulation Discussion The Regulations were reviewed by Town Counsel;they made no substantial changes. The Commission is going to discuss this'official"document with the public along with the documents Ms. Stewart, Mr. Maughan and Mr. Hecht created. The Committee will proceed to get with Mr. Hechenbleikner to get the document repaginated. A Public Hearing needs to be scheduled. The Committee will individually talk to the Public at the meeting; everyone will lake a section. There will be a feedback section-listen for any objections or to see if the residents like the changes. If there are changes they will have to go back to Town Counsel to see if they are legal changes. The Commission decided on eady October for Public Hearing. Mr. Tirone will book the Senior Center on October 11,2012 at 7:00 p.m.. The Commission asked Mr. Tirone to"publicize"this meeting: advertise on the website,email, notify different committees. Mr. Tirone will to talk to Ms. Delios or Ms. Knight for any ideas to publicize this meeting It was talked about the Town Counsel stated that the"f nds"might need to be put into the bylaw. The'rinds"might not carry the weight the Commission thought if they don't put it in the bylaw under Section H. Mr. Maughan will follow up with Mr. Hechenbleikner.
