MINUTES December 26,2012 W NOV 27 PM 5: 21 The meeting of the Reading Board of Health came to order at 9:12 am in the Berger Conference Room of Reading Town Hall. Present were Board members Barbara Meade, David Singer,Andrew Friedmann, Staff,Ruth Clay and David Greenbaum,Richard Doyon,Pilgrim Hospitality and Jeff Bender,Romano's Macaroni Grill. Ruth Clay gave an overview of the time line from Jan to the present. She inquired as to why Macaroni Grill had not hired a co within the 3,0 days as ordered by the Board on May 24,2012. The consult d Doyon stated that he did not begin work until October due to lack of payment.,"Clay ' ed Town Cottnsel stated that suspension of the permit could only be imposed if the vio had no[been correct. However,he said that the Board could hot renew their p effective January 1 or assess fines as noted in the Food Code.' Jeff Bender told the Board that he was committed to a change in the mana at team. He would be in house twice a week once scheduled andone unscheduled to sure a complete turnaround where Macaroni Grill would become a role model. He stated the kitchen manager would be replaced. He has a manager in training that would be in place in January. Friedmann inquired why these issues have gone on for so long. Bender stated that follow up has been a problem. Singer inquired with regard to the guidelines set up by the restaurant, what had changed to get them to this point. Bender stated that again follow up and communication were kcv; he would meet with his staff twice a week. Friedmann inquired if they had enough staff. Doyon stated there is only one,person closing.,,,I-1e advised Bender that he needs to listen to the Board, respond by correcting the issde3'with a sense of urgency. Doyon stated he saw evidence of mice infestation, but not inside. He did not see evidenceof cockroaches. Greenbaum suggested that pest management extermination should be more than once a month, perhaps once a week until the problem is resolved. He also noted that the reports should be explicit in what work was done and where in the establishment. Motion made by Friedmann, seconded by Meade to assess a fine of$20,000 based upon $500 per repeated violation at the December 18,2012 inspection plus the cost of Reading's legal fees as a consequence to the December 18,2012 inspection. Motion passed 3:0:0. Motion made by Friendmann,seconded by Singer,requiring a letter from Macaroni Grill confirming that the company would not contest the fine in court. Motion passed unanimously.
