Motion to Issue by Mr.Flynn;second by Mr.Curds.Vote 6-0.0 NOI 270-0677 116 Van Norden,The commission reviewed the Order of Conditions. Motion to issue by Mr.Couillard;second by Mr.Curtis. Session abstained Vote 5-1-0 0 Low Meadow Notice of Intent was continued until February 8,2017 270-0639 Went Street The commission reviewed the dewatering plan for the pump station off West Street.The site is in the RMLD property. Pump Station project previously approved has started and the contractor has encountered water in the eight foot excavated pit The commission asked if the water was contaminated. GZA is testing the water now and the soil has been stockpiled at the DPW garage according to protocol,Town Engineer,Ryan Percival stated if it's apparent that the soil is contaminated then it will be properly handled,but the preferred method is the soil goes back into the hole it came out of.The commission was told CDM has a LSP on staff and he will be monitoring the site.The project is ready to start pumping groundwater tomorrow of 40 to 100 GPM the flow that can be regulated according to the£rack tanks in distilling Fusin's capacity.The GZA consultant said the excavation is open for seveml weeks.Infiltration of 10,000 gallon a day is allowed within 100 feet of the site.CDM Smith has recommended the dewatering plan along within Albanese D&S.GZA took samples;results should be back tomorrow January 26,2017 and will be sent to the Conservation Commission.Mrs.Scanlon asked to see the results of the Poll disposal characterization.The contractor checked with the DEP and the EPA on their solution;all agreed with the proposed plan.The project should pump 8k gallons per day with a Frac tanks capacity of 10,000 per day. 300 cubic yards of soil will be removed from the pit and stored at the DPW garage. Motion to approve by Mr.Couillard;second by Mr.Curtis. Vote 6-0-0 Page 1 1 OOC 270-054714 Strawberry Hill Lane The applicant requested an extension of an existing Order of Conditions that has been extended twice before. 90%complete with this project but the order will expire in April and the contractor will need more time. Motion to approve by Mr.Flynn;second by Mr.Couillard.Vote 6-0-0 ANRAD 270-0674 44 Roma Lane January 25th 2017 the commission closed the hearing at the previous meeting.Mr. Throne was asked to prepare a denial for the commission m sign for tonight's meeting.Mr Tirane discussed the conservation commission paying for the third party review with a reduced scope of work. This was suggested by the chair,Ms.Longley and backed up by Community Development Director,Julie Mercier.Mr.Carroll declined the offer and suggested a new line location on the plan that was closer to the neighbor's house to the north,an area he wanted to use for future projects and said anything less would feel like a taking. Mr.Correll's December 7,2016 plan was projected on the while hoard and discussed by the commission. Mr.Couillard suggested a compromise and asked Mr.Carroll to join the discussion after the meeting had already been closed. The November 17,2016 site visit was discussed. Mr.Carroll wanted the undeveloped area to the north of his house designated as non jurisdiction by the commission. On the November 17,2016 site visit with Oxbow Associates augured soil above flag A-10 and above A-11,up by the Stonewall both sell augers where hydric.The next soil auger was taken over the some wall closer to the house in the undeveloped portion of the site near the S inch and 20 inch oak tree.The soil in this location was found to be hydric.The last soil auger was by Roma Lane nem a 30-inch Oak tree where several highbush blueberry bushes were located.The soil was also found to be hydric but the two gentlemen from Oxbow Associates did not agree. The tree root system in undeveloped area was buttress and hammocks and low cress of soil were a consistent part of the landscape and the soil was rocky. Mr.Couillard said he opposes the town paying for any wetland delineation work and its the responsibility of the homeowner to provide such information. The commission asked to see the original October 17,2013 Manuell plan on the white board. The commission discussed the plan. Mrs.Scanlon made a motion to accept the October 17,2013 Manuel)plan as part of the record.Additional discussion about the wetland line ensued.Mr.Pinette said the sail above the Stonewall on the undeveloped portion of the site is spongy. Mr.Couillard said he would deny the ANRAD on insufficient information Ms.Longley asked for motion from the commission. Ms.Scanlon made a motion to accept the 2013 Manuell plans as part of the record seconded by Mr.Flynn Vote 6-0- 0 Mr.Couillard made a motion to deny the ANRAD Mr.Flynn second Vote 6-0-0 Mr.Carroll was asked to comment on the discussion hejusl witnessed about his property while sitting in the audience and if he could come up with a compromise after hearing the discussion. Mr.Carroll affirmed he declined the offer for reduce scope and to allow the conservation commission to pay for third- party review.Mr.Carroll talked about future projects in the undeveloped area;a pool,patio,hardscape orjust open lawn next to his house.Nothing is£mol;he is in between projects but would like to use the undeveloped side for something.Mr. Carroll intends to install a remaining wall as part of his plan if he had the money to do the work. Mrs.Scanlon suggested using the existing lawn in back of the house for any future project or structure and said it would be the best place to comply with the wetlands protection act and the town bylaws.Ms.Scanlon went on to say that she would deny the project for lack of information. Mr.Cartoll asked if he returns with a notice of intent using the Oxbow line for the application,how would it be received. Mrs.Scanlon said it would be rejected for insufficient information and went on to explain the town's bylawjurisdictional setbacks. Page 1 2 Ms.Longley said this is an area that deserves a little more scrutiny and it didn't get that with the Oxbow application so there is not sufficient information to approve the ANP AD at this point.Ms.Longley asked the commission if we have a motion.Mr.Flynn said we already have a motion and that he had already second the motion. The commission voted to deny the project Vote 60-0 Administrative Report-The annual report was discussed and the comments by the commission are needed by February 1'.
