Board of Health meeting came to order at 5:35 pm on November 29, 2016 In the Berger
Room of Reading Town Hall.

Minutes of October 19, 2016 were presented. Shurland made motion to accept, seconded
by Costigan. Motion passed 3:0
Monthly Reports
Plan review submitted from Jordan's Sweet House. They will be selling pre-packaged fudge,
not making it there as previously requested. Burger King will be doing exterior renovations
to building as well as the dining area and bathrooms. Artis Senior Living Center received
their food establishment license. An open house for the facility will be held after the first of
the year.
DiLauro attended meeting of Opioid Abuse Prevention Coalition. Retail establishments
identified as hot spots for drug abuse will be contacted and owners requested to put up
overdose education posters in their restrooms. The Board will collaborate with RCASA for a
future article to be published in the Chronicle. Standard Operating Procedure has been
developed to remove all medical waste associated with flu clinics and disposed of with Curtis
Bay Medical Waste Services. Public Health Nurse has been Issued a cell phone to conduct
communicable disease follow up. The lower level conference room Is scheduled daily as
required to conduct these confidential interviews. Approximately 1100 flu vaccines have
been administered so far this flu season.

Tobacco Regulations
The Board reviewed the proposed track changes including those from town counsel to
update the current regulations to restrict the sale of Flavored tobacco products, except in
adult only tobacco stores; enact a minimum price sale cap for cigars, enact a proximity ban
where no tobacco products sales permits would be issued to new retailers with 500 feet of a
school; enact a permit cap to limit the number of tobacco sales permits and amend the
Environmental Tobacco Smoke Regulation to ban the use of any tobacco or nicotine
products in or on town owned property including parks and playgrounds.
Wilson noted that the definition of a minor was missing and the statement related to
tobacco and nicotine delivery product sales to minors was also missing.
Under Section 6, Subsection 9, regarding the maximum number of tobacco product sales
permits Issued, the maximum number was changed to 19. Presently there are 18 tobacco
sales permits issued.
Under Section 6, Subsection 11, regarding a tobacco sales permit being issued to a new
applicant for a retail location within 500 feet of a public or private elementary or secondary
school, the Board decided to increase the distance from 500 feet to 1000 feet to be
consistent with the town's zoning bylaw regarding medical marijuana dispensaries.
Webb and Shannon voiced their support for the update to the tobacco regulations.
Delios expressed concern about the added restrictions having a potential negative impact on
the business community. She reiterated the Board of Selectmen's goal of Increasing
Economic Development opportunities and expressed concern that the BOS were not
sufficiently informed. She also stated that the Town needs income and if it does not receive
more income, there will be budget cuts and layoffs. Wilson responded that tobacco related
jobs are low-wage and don't bring in much money for the Town.
Shurland made a motion to accept the draft regulations to Include town counsel changes,
the missing definition and statement of tobacco sales to minors; Section 6, Subsection 9,
changing maximum number of tobacco permits issued from 20 to 19; and Section 6,
Subsection 11, changing the distance from 500 feet to 1000 feet for any new retail tobacco
establishment in proximity to a public or private elementary or secondary school to be
consistent with the town's zoning bylaw regarding medical marijuana dispensaries. Motion
seconded by Costigan. Motion passed 3:0
Friedmann will review articles for publication in the Chronicle.
