Town of Reading Meeting Minutes 6J91 'N ?0 Board - Committee - Commission - Council: Date: 2017-05-18 Building: Reading Town Hall Address: 16 Lowell Street t LEi-,K Zoning Board of Appeals toil AUG -1 A C� 2,I'I Time: 7:00 PM Location: Selectmen Veeting Room Purpose: Public Hearing Attendees: Members - Present: David Traniello, Chairman Cy Caouette Robert Redfern Kathleen Hackett Erik Hagstrom Nick Pernice Members - Not Present: John Jarema Others Present: Session: Public Rachael Proia, 62 Belmont Street Mary Nigro, 110 Lowell Street Christopher Wicken, 128 Howard Street Minutes Respectfully Submitted By: Kim M Saunders Topics of Discussion: Mr. Traniello called the meeting to order at 7:00 PM Case # 17-04 The Zoning Board of Appeals held a Public Hearing in the Selectmen's Meeting Room at Town Hall, 16 Lowell Street, Reading, Massachusetts on the petition of Christopher Wicken who seeks a Special Permit under Sections 5.3.2 & 5.4.7.2 of the Zoning Bylaws in order to construct a two story addition 18' x 22' with a platform and stairs as per plot plan on the property located at 128 Howard Street, Reading, Massachusetts Mr. Wicken the owner of 128 Howard Street presented his proposal to the Board and said the added space would allow for a family room and a room upstairs. He gave his opinion the proposed addition would not be detrimental to the neighborhood. Mr. Wicken distributed updated plans to the Board. He said as suggested by Glen Redmond the Zoning Enforcement Officer the plot plan was updated showing the platform location changed to the back of the property. He informed the Board the existing covered entrance will be removed to create additional space. Mr. Redfern commented the proposed construction is in the rear of the property and won't be seen by a passerby. He acknowledged the email the Board received from Mr. Redmond. The email stated a new plot plan was requested relocating the proposed platform and stairs. He said the proposal meets the requirement of the zoning bylaw for a Special Permit. Ms. Hackett had no comment. Mr. Caouette commented on the conflict between the legal ad and the email from the Zoning Enforcement Officer. He said the Applicant should be seeking a Special Permit. Page I 1 Mr. Hagstrom said the proposal is straight forward and had no concerns Mr. Pernice had no comment. Mr. Traniello read the email received from Mr. Redmond. He agreed a Variance is no longer needed since the Board received the updated plot plan changing the platform location. Mr. Traniello said the proposal is not increasing the non -conformity of the principal structure. Mr. Traniello opened the meeting to the public and closed with no public comment. On a motion by Mr. Hagstrom, seconded by Mr. Caouette, the Zoning Board of Appeals moved to approve the petition of Christopher Wicken who seeks a Special Permit under section 7.3.2 of the zoning bylaw in order to construct an addition ...... with conditions: Vote was 5-0-0 (Traniello, Caouette, Hackett, Redfern, Hagstrom). Case # 17-03 The Zoning Board of Appeals continued a Public Hearing in the Selectmen's Meeting Room at Town Hall, 16 Lowell Street in Reading, Massachusetts on the application of Rachael Proia, pursuant to M.G.L. Ch. 40A §9 for a Special Permit for an Accessory Apartment under Zoning Bylaw Sections 4.4, 5.3.2, and 5.4.7; and pursuant to M.G.L. Ch. 40A §6 for a Variance from Zoning Bylaw Section 5.4.7.3.b, for property located at 62 Belmont Street in Reading, Massachusetts. Ms. Proia the owner of 62 Belmont Street provided an updated packet to the Board. The packet contained correspondence and plans the Board requested at the last meeting. She said the Engineering Department submitted an email confirming the Board of Selectmen does not need to approve the proposed driveway. Glen Redmond the Zoning Enforcement Officer submitted a revised letter stating the proposed accessory apartment conforms to the zoning bylaw. She said the updated plans reflect calculations from Mr. Redmond showing the accessory apartment versus the primary dwelling. Mr. Pernice had no comment. After Mr. Hagstrom read section 5.4.7.3 Performance Standards of the Zoning Bylaw, he agreed the proposal meets all criteria. Ms. Proia said the new dwelling will meet the zoning setbacks. Mr. Caouette questioned the memo the Board received from Chris Cole in the Engineering Department. The memo requested additional information added to the plot plan. The Board agreed to add a condition to the Special Permit. Ms. Hackett had no comment. Mr. Redfern said he is satisfied the proposal is applicable for a Special Permit. Mr. Traniello read the updated denial letter and email received from Glen Redmond. Mr. Traniello commented the legal notice recited the Applicant was seeking a Variance. He said after receiving the updated plans and denial letter the Applicant will only need a Special Permit. He asked Ms. Proia to withdraw the application for a Variance. Mr. Traniello opened the meeting to the public and closed with no public comment. Mr. Pernice asked if the existing curb cut will be filled in. Ms. Proia replied the curb cut will be filled in even though the Town did not request it. Ms. Proia requested her Variance application to be withdrawn. On a motion by Mr. Redfern, seconded by Ms. Hackett, the Zoning Board of Appeals moved to approve the Applicant's request to withdraw the Variance application 17-03. Vote was 5-0-0 (Traniello, Caouette, Hackett, Redfern, Hagstrom). On a motion by Mr. Redfern, seconded by Ms. Hackett, the Zoning Board of Appeals moved to approve the application for an accessory apartment under section 5.4.7 of the zoning bylaw for the property located at 62 Belmont Street in Reading, Massachusetts, the applicant being Rachel Proia in accordance with the plot plan ......with conditions: Vote was 5-0-0 (Traniello, Caouette, Hackett, Redfern, Hagstrom). Page 1 2 Mr. Traniello confirmed a condition will be added to the Special Permit that will require the Town Engineering Department approve the driveway. Other Business Minutes: April 6, 2017 On a motion by Mr. Redfern, seconded by Mr. Hagstrom, the Zoning Board of Appeals moved to approve the April 6, 2017 minutes as amended. Vote was 6-0-0 (Traniello, Caouette, Hackett, Redfern, Hagstrom, Pernice). April 20, 2017 On a motion by Mr. Caouette, seconded by Ms. Hackett, the Zoning Board of Appeals moved to approve the April 20, 2017 minutes as amended. Vote was 6-0-0 (Traniello, Caouette, Hackett, Redfern, Hagstrom, Pernice). Adjournment On a motion made Mr. Redfern, seconded by Ms. Hackett, the Zoning Board of Appeals moved to adjourn the meeting at 8:10 p.m. Vote was 6-0-0 (Traniello, Redfern, Caouette, Hackett, Hagstrom, Pernice).
