Executive Session 9:08 a.m.
A. Call to Order
Chair Robinson called the Executive Session to order in the Superintendent's Office_
Litigation
Attorney Doneski updated the committee on the status of the TLT case. The Master has come
back with three draft decisions; Asbestos, Track and Lights. The approximate amount due at this
point is $3,369,655.
Mr. Robinson asked about the assessment of interest. Mr. Doneski indicated that the Master may
decline to comment on the interest.
Mr. LeLacheur asked if there was support for liquidated damages. Mr. Doneski said he is not
sure if we will get the claims and liquidated damages.
Mrs. Webb asked if it would be better to wait to hear all of the Master's decisions.
Mr. Halsey pointed out that the clock continues to tick for interest. The sooner we close this case
the better.
Mr. Doneski said that TLT has not been engaged in conversation. To date, they have rejected an
offer to settle in the amount of $2M. He also shared that the liquidated damages may be

addressed last by the Master. The Master is expected to have reports at the end of
May/beginning of June and the final report to the committee by July 1'.
Discussion continued regarding the aspects of the case and possible revenue sources to use in the
ev�vt, the Master finds for TLT.
The School Committee felt it is important to empower our attorney to negotiate a settlement.
Mrs. Webb moved, seconded by Mrs. Joyce to authorize a settlement offer of a maximum
of $SM. The roll call vote carried 5-0. Mrs. Joyce, Mrs. Webb, Mr. Robinson, Dr. Snow
Dockser and Mrs. Borawski.
Mrs. Borawski moved, seconded by Mrs. Joyce, to adiourn. The roll call vote carried 5-0.

The meeting adjourned at 9:55 p.m.
