Executive Session 7:24 p.m.
A. Call to Order
Chair Croft called the Executive Session to order in the Superintendent's Office.
Litigation Update
Superintendent Doherty introduced replacement counsel David Doneski of Kopelman & Paige.
Mr. Doneski said that he has begun the process of examining the documents pertaining to the TLT case.
He reviewed the findings regarding the case. The Town had resolved one portion of the matter and cases
involving asbestos removal, the track and liquidated damages remain active.
The next court date is May 5, 2014. At this time testimony before the Master will continue.
Mr. Caruso asked what the procedure would be to settle this case.
Mr. Doneski said the School Committee would need to provide direction to offer a settlement.
Mrs. Webb would like to see a justification offer. Mrs. Borawski wanted to confirm that if we settled
with TLT that the case would be closed completely. The response was yes it would be.

Mr. Robinson asked if it was the recommendation of Kopelman & Paige to settle.
Mr. Doneski said the litigation could continue for 2 to 3 years.
Mr. Caruso moved, seconded by Mrs. Borawski, to direct lezal counsel to prepare a settlement offer
r to TLT to be presented to the School Committee for review.
Dr. Doherty asked if there would be a quorum over vacation week if the settlement offer was available to
vote on.
Mrs. Webb would like to see justification for a starting number.
The roll call vote was 6-0. Mr. Robinson, Mrs. Webb, Mrs. Borawski, Mr. Croft, Mr. Caruso and
Mrs. Snow Dockser.
Dr. Doherty said he would update the Board of Selectmen at their meeting on Wednesday night.
Mr. Doneski left the meeting at 8:19 p.m.
Mr. Robinson mentioned the possibility of pursing recourse against previous counsel, the architect and
OPM.
Adjourn
Mr. Caruso moved, seconded by Mrs. Borawski, to adjourn and return to open session. The roll
call vote was 6-0. Mr. Robinson, Mrs. Webb, Mrs. Borawski, Mr. Croft, Mr. Caruso and Mrs.
Snow Dockser.
Meeting adjourned at 8:15 p.m.
