MINUTES OF THE EXECUTIVE SESSION OF THE SELECTMEN'S MEETING
April 26, 1988
--' The session convened at 10:00 p.m. Present were Chairman Nigro,
Vice-Chairman Graham, Secretary Ziegler, Selectmen Landers and
Russell, Town Manager Hechenbleikner, and Town Counsel Cohen.
Ted Cohen discussed the case of Eric Russo, a Special Education
case. He recommended settlement in the amount of $9 , 553 for
legal fees. On motion by Russell, seconded by Ziegler, the
settlement was approved by a vote of 5-0-0. Attorney Cohen indi-
cated that the Superintendent of Schools supports a settlement.
The Town Manager was directed to send a letter to the School Com-
mittee telling them that this case had been settled with the
funding to come from their Special Needs Budget.
Attorney Cohen outlined the case of Andrew Bruce, a slip and fall
accident on Green Street. On motion by Ziegler, seconded by
Graham, the Board authorized the settlement of the suit for
$5,000. The vote was 5-0-0.
Selectmen Russell presented a proposed settlement with TASC on
the issue of rent due for the Town's occupancy of the former
Public Works site from November of 1987 through the date vacated
to begin use of the new garage. The settlement will provide that
the Town will accept, at Strout Avenue, the clean demolition
product which would include concrete and bricks from the old
Public Works Garage. The Town would crush this material at its
discretion. The material will be hauled by TASC, and placed, un-
der the direction of the Department of Public Works, in a loca-
tion and form that will enable the crushing of suitable material.
Based upon this request, the Town will be able to continue to oc-
cupy the old Public Works site until 12/31/88 with no rent and
with taxes waived. This settlement was approved on motion by
Russell, seconded by Ziegler, by a vote of 5-0-0.
The Board agreed that the Zoning Board should be invited to meet
with the Board of Selectmen in Executive Session on May 10, 1988.
The Board of Selectmen discussed the following items in Executive
Session regarding personnel:
1. The Board of Selectmen heard the presentation by the
Town Manager on the retirement of Rheta McKinley. In
summary, this would agree to retroactive pay and title
as Director of Council on Aging from the present back
to July 1, 1987 for Rheta McKinley. Rheta McKinley
would continue from the present time until July 1, 1988
as a transitional consultant for the Council on Aging.
The Town would . pay for attorney fees. The total cost
- of the settlement as outlined is $10,000. On motion by
Russell, seconded by Ziegler, the Board approved the
settlement as outlined by a vote of 3-2-0 with Landers
and Graham voting in the negative.
2. Labor negotiations were discussed. The Town Manager
will send to the Selectmen a copy of the Fire Union
proposals and the Public Works Union proposals.

On motion by Russell, seconded by Ziegler, the Board voted unani-
mously in a roll call vote to come out of Executive Session at 12
o'clock midnight.
On motion by Russell, seconded by Landers, the Board voted to ad-
journ at 12:01 a.m.
