HomeMy WebLinkAbout1990-05-15 Board of Selectmen Executive Session Minutes Minutes of the Executive Session Board of Selectmen Meeting May 15, 1990 The executive session was convened at 9:20 p.m. Present were Chairman Russell Graham, Vice Chairman Dan Ensminger, Secretary George Hines, Selectman Eugene Nigro and Town Manager Peter Hechenbleikner. Section 1. Town Manager reviewed the issues with regard to an unfair labor practice filed against the Town for the Town Manager's and Selectmen's failure to recommend to the Finance Committee and the Board of Selectmen the inclusion of two firefighters making up a total number of 43 firefighters in accordance with the contract. The Town Manager recommended that these two positions be added at a total net cost of $53,484. On motion by Nigro, seconded by Hines and a roll call vote all four members voting in the affirm- ative, the Board voted to support the Town Manager's recommenda- tion with regard to this. Section 2 The Town Manager reviewed the status of litigation or potential litigation with RESCO. On motion by Ensminger, seconded by Nigro the Board voted to approve the following procedures as outlined in the Town Manager's memo 5/15/90: 1. That the Town agree to sign a letter with the other com- munities indicating that we will be staying with our current contract with RESCO for FY91 and reiterating what the con- tract means in terms of procedures and dollars. 2. That the communities will enter into litigation with RESCO seeking declaratory judgment that our understanding of the contract is valid. 3 . That the communities enter into negotiations with RESCO in a long-term contract beginning July 1, 1991. 4. That the Town will support financially up to $30,000 a year for two years the cost of litigation and negotiations. This motion was approved on a roll call vote with all four mem- bers voting in the affirmative. George Hines asked what would happen if other communities back out. The Town Manager indicated that it would have an effect only in the area of additional costs of litigation. On motion by Ensminger, seconded by Nigro the Board voted to go into open session at 9:40 p.m. with all four members voting in the affirmative by vote of 4-0-0. The communities will enter into negotiations with RESCO on a long-term contract beginning July 1, 1991. 4 . That the Town will support financially up to $30,000 a year for two years the cost of litigation and negotiations. Further, the Board of Selectmen recommended that the reduction in cost of trash expense be used to offset the use of free cash for FY91, reserving additional free cash for use in the FY92 budget. The Town Manager indicated that we are in the process of enforc- ing the agreement at Eric's Greenhouse. The Town Manager indicated that he had discussions with the MBIA about the noise of the engines, and had gotten a commitment that the noisy "high idle" engines would be moved out of Reading. Chairman Graham indicated that parking in the illegal curb cut on West Street appeared to be taking place at the Rogan property at West and Oak. Selectmen Nigro asked that the CPDC be made aware of the 24-hour operation restrictions when it reviews the Crestview Exxon site plan. -i Selectmen Ensminger asked about the enforcement action on the Perkins Building and the Town Manager indicated that he had met with Town Counsel that day to review the status of this enforce- ment action. The Board asked that additional information on the Article 23 of the Annual Town Meeting be provided regarding fees. How many fees are actually established by the elected bodies, and pointing out problems with regard to the proposed article. On motion by Ensminger, seconded by Hines the Board voted to ad- journ at 10: 03 p.m. by vote of 4-0-0. Respectfully submit e SecJVta3ry
