HomeMy WebLinkAbout1992-09-09 Board of Selectmen Executive Session Minutes Minutes of the Executive Session of the Board of Selectmen September 9, 1992 The Executive Session was convened at 8 : 05 p.m. in the Library Conference Room, Middlesex Avenue, Reading, Massachusetts. Present were Chairman Dan Ensminger, Vice Chairman George Hines, Selectmen Bill Burditt and Eugene Nigro, Town Counsel H Theodore Cohen, Town Manager Peter Hechenbleikner, Nelson Burbank and O. Bradley Latham. Ted Cohen reviewed the latest draft which was prepared by Brad Latham and responded to Cohen's previous draft. Discussion focused on the following: Rent levels over and above the dollar per year or payment in lieu of taxes. The Board agreed to fix the current assessed valuation of the land and that the payment in lieu of taxes would be the current assessed valuation times the tax rate as it may be set from year to year. Extensions. This was OK as drafted. Funding. Commencement date of September 1, 1992 will be in- cluded. Construction coverage insurance. Construction coverage insurance will be added. Alterations. This was approved as is. 10. 2 . 10. 2 is a standard clause with the Town named as loss payee. Counsel will review language that requires that the proceeds be used to rebuild the facility. Fences. Reference to the fences is to be taken out. Cancellation. The cancellation section is OK as is. Contingency Fund. Referencing the contingency fund to the CPI is appropriate. Section 24 - Parking. Section 24 on parking will be modified to provide that parking will be provided as CPDC determines in site plan approval, with one parking space per three seats to one parking space per four seats. Selectmen's Representative. The Selectmen will have the option of appointing their representative on the Board of Directors at such time as the Board feels appropriate. Notice Provisions. The notice provisions are appropriate and the general skating will be modified to indicate the lessor's strong support for public skating. Waivers. Waivers will .be limited to what lessor has the power to waive. Selectmens Minutes - 9/9/92 - page 2 Rights of Passage. The Town will retain rights of passage as the roadway may be approved by CPDC, as well as passage of utilities. Town Counsel and Latham will work on "reasonableness" language to track the Town Meeting approval. The rest of the process will be to finalize this draft and the Board of Selectmen will meet in Executive Session at 7:00 on Sep- tember 22. The Board is to reach agreement in principle on the lease, and will develop a public release outlining what is in the draft lease. The Town then will go out to seek an RFP for development of this site. On motion by Burditt seconded by Hines the Board voted to adjourn the Executive Session at 9:45 p.m. All four members voted in the affirmative and the meeting was adjourned.
