HomeMy WebLinkAbout2000-10-24 Board of Selectmen Executive Session Minutes Board of Selectmen Executive Session -- October 24, 2000 The Executive Session convened at 10:00 p.m. in the Craft Room on the second floor at the Senior Center, 49 Pleasant Street, Reading, Massachusetts. Present were Chairman Matthew Nestor, Vice Chairman George Hines, Secretary Camille Anthony, Selectmen Sally Hoyt and Matthew Cummings, Town Manager Peter Hechenbleikner, Assistant Town Manager Russell Dean, Paula Schena and Special Counsel Edith Netter. Litigation George Street Comprehensive Permit — The Town Manager noted that the Edith Netter's bills come to almost $14,000. Edith Netter noted that she found a law that says we have a credible brief. The zoning act provides that Boards and aggrieved can sue. The Town owns a piece of land that is abutting. She noted that the developer has put in a counterclaim but it is very general and interrogatories will need to be done. Edith Netter asked the Board what they want to gain. Selectman Camille Anthony noted that the ZBA hearing was faulty, and they spent very little time in discussion. Vice Chairman George Hines noted that his comments were pretty much dismissed, and the ZBA was bent toward acting more as an affordable housing board instead of the ZBA. The housing needs were not balanced with the community. Selectman Sally Hoyt noted that the ZBA was more concerned with providing affordable housing. Selectman Matthew Cummings noted that the ZBA has sole ability to approve or disapprove, and they are not accountable to anyone. The issue of standing needs to be established. The consensus of the Board was to wait for a ruling on the motion to dismiss. If it comes down to negotiating, a smaller project of three units would be considered. Edith Netter left the Executive Session at 10:25 p.m. Discussion of Strategy with respect to Collective Bargaining—The Town Manager noted that he has met with five of the six bargaining units. All units will come back with short bargaining lists. Approval of Minutes On motion by Cummings seconded by Hoyt, the Board of Selectmen voted to approve the Executive Session minutes of their meeting of September 12, 2000. On a roll call vote, all five members voted in the affirmative and the minutes were approved.
