Executive Session
January 9,2001
The meeting convened at 7:00 p.m. at the Senior Center, 49 Pleasant Street, Reading,
Massachusetts. Present were Chairman Matthew Nestor, Vice Chairman George Hines,
Secretary Camille Anthony, Selectmen Sally Hoyt and Matthew Cummings, Town
Manager Peter Hechenbleikner and Assistant Town Manager Russell Dean.
Sale of Real Estate
The Town Manager updated the Board of Selectmen on 128 Sales' interest in making a
presentation to the Board of Selectmen regarding the landfill property under agreement
with Dickinson.
128 Sales wants to make a presentation to the Selectmen. They would like to be able to
purchase a piece of the landfill property from Dickinson where the restaurant is planned.
They want to expand their facility. We met with John Kline and Dickinson on the issue.
Chairman Matthew Nestor asked about the 128 Sales property and the fact that the
landfill site may extend onto the property. The Town Manager indicated we had done
borings on the landfill site as identified by Camp Dresser McKee. DEP has sent a letter
indicating that is an issue to be addressed. At this point, most questions are unanswered.
DEP is involved in the process.
Chairman Matthew Nestor discussed the restaurant and bar approval issue.
Vice Chairman George Hines stated that he spoke against selling the property to 128
Sales in the early 1980's as a member of the Planning Board and as a Town Meeting
Member.
Selectman Camille Anthony stated that 128 Sales has been a difficult neighbor.
Selectman Matthew Cummings asked if they had plans prior to coming now to build a
state of the art facility.
The Town Manager drew a map and indicated that a sewer easement running through the
property has prevented 128 Sales from expanding at the moment.
Selectman Camille Anthony stated that she has always liked the idea of a restaurant.
The Town Manager stated that he thought McManus was not aware of the consent order,
or the potential that some of the waste from the former landfill may be under their
property.
Selectman Matthew Cummings asked if Dickinson develops the restaurant within the
office building, what is the revenue difference and do we get the same revenue or greater.

Vice Chairman George Hines asked about the hotel/restaurant concept. The Town
Manager stated that the hotel footprint has been a concern for Dickinson because it
borders a wetland and, therefore, attaching the restaurant to the hotel would appear to be
unlikely.
Selectman Matthew Cummings asked if we have to go back to Town Meeting for
approval if we agree to allow a sale of a portion of the site to 128 Sales. The Town
Manager indicated he doesn't think so -- the Selectmen received permission to sell the
property under guidelines and this is within that.
Selectman Matthew Cummings asked about zoning changes. The Town Manager stated
that there are none that we know of.
Vice Chairman George Hines stated that we must have done a 2 1 E assessment on the site
before it was sold to 128 Sales.
Chairman Matthew Nestor stated that he wanted an informal read from DEP on the
impervious surface sufficing as a landfill cap. The Town Manager stated that we'd try to
get a read from DEP on the trash issue.
Vice Chairman George Hines stated that CDM and Brackett & Lucas need to get
involved.
Selectman Matthew Cummings asked if CDM could get an estimate for a "plain vanilla,"
closing that part of the site.
Vice Chairman George Hines asked if we want to listen to 128 Sales for the sake of
listening. Agreement was that 128 Sales could come in and present to the Board.
On motion by Cummings seconded by Anthony, the Board of Selectmen voted to adjourn
their Executive Session Meeting of January 9, 2001 at 7:28 p.m. On a roll call vote, all
five members voted in the affirmative and the meeting was adjourned.
