HomeMy WebLinkAbout2002-11-19 Board of Selectmen Executive Session Minutes Board of Selectmen Meeting Executive Session --- November 19, 2002 The Executive Session convened at 7:40 p.m. in the Town Hall Berger Room, 16 Lowell Street, Reading, Massachusetts. Present were Chairman Camille Anthony, Secretary Richard Schubert, Selectmen George Hines and Gail Wood, Town Manager Peter Hechenbleikner, Town Counsel Joan Langsam and Paula Schena. Review Status of Legal Issues Fraen - Town Counsel Joan Langsam noted that the Fraen litigation has been settled. She gave them the check and the case has been dismissed. Eaton — The Appeals Court refused to reinstate, and her term expires the end of June. Town Counsel will follow up with the court in March. Mola—This is ongoing-- the Town has won at both levels. Beacon Street — This is between the neighbors and developer. They are appealing the zoning decision. Welch—He is drafting the conditions and giving bond for the sidewalk. Cabobianco vs. Coote—Town Counsel is waiting to hear from the court. Cumberland Farms —We asked for $150,000 for the hard cost of the 24" water main. They are offering$90,000. This does not include the cost of the installation of the water main. The Town Manager recommended accepting the offer, and noted that the money will go back into the Water Fund. A motion by Hines seconded by Schubert to authorize Town Counsel to counter the proposal at $120,000, not to go below$90,000, was approved on a roll call vote with all four members voting in the affirmative. Appellate Tax Board—We"elel—This is a neighbor issue. Retirement Board — Middlesex Retirement Board is denying liability for one year and five months of creditable service for Christopher Picco. Town Counsel is waiting for the decision. Tine vs. Retirement Board—Judge Houston has not responded since 1999. There is a conference hearing on December 3, 2002. The Town Manager updated the Board on the landfill. He noted that the insurance policy has been received. Board of Selectmen Meeting—Executive Session—November 19, 2002—Page 2 Approval of Minutes A motion by Wood seconded by Hines to approve the Executive Session minutes of October 22, 2002 was approved on a roll call vote with all four members voting in the affirmative. A motion by Wood seconded by Hines to approve the Executive Session minutes of October 20 2002 as amended, was approved on a roll call vote with all four members voting in the affirmative. A motion by Wood seconded by Schubert to adjourn the Executive Session of November 19, 2002 at 8.15 p.m. was approved on a roll call with all four members voting in the affirmative.
