HomeMy WebLinkAbout2003-06-10 Board of Selectmen Executive Session Minutes Board of Selectmen Meeting Executive Session June 10, 2003 The Executive Session convened at 9:45 p.m. at the Senior Center, 49 Pleasant Street, Reading, Massachusetts. Present were Chairman Camille Anthony, Vice Chairman Matthew Cummings, Secretary Richard Schubert, Selectman George Hines and Town Manager Peter Hechenbleikner. Litigation Vice Chairman Matthew Cummings noted that he wanted to talk about the Eaton case. The Board received a copy of Town Counsel's report and the Court of Appeals decision. The Town Manager noted that Town Counsel feels that Ms. Eaton's term will expire on June 30, 2003 which would be earlier than any appeal that could be filed and court action taken. Vice Chairman Matthew Cummings expressed the concern that even if that is the case, the Town cannot allow the Appeals Court to substitute as judgement on fitness for a position for the Board of Selectmen's decision and, therefore, he feels that the matter should be appealed. On motion by Cummings seconded by Hines the Board of Selectmen voted to appeal the Appellate Court decision in the Eaton matter as soon as possible and if possible, to file a temporary restraining order or injunction to enjoin Ms Eaton from going back on the Commission. On a roll call vote, all four members voted in the affirmative and the motion was carried. The Town Manager suggested that this matter be scheduled for discussion with Counsel at the beginning of their meeting on Tuesday night. On motion by Cummings seconded by Hines, the Board of Selectmen voted to adjourn their meeting on June 10, 2003 at 9:55 p.m. on a roll call vote with all four members voting in the affirmative.
