HomeMy WebLinkAbout2009-03-17 Board of Selectmen Minutes - Executive Session Board of Selectmen Meeting Executive Session March 17, 2009 The Executive Session convened at 7:02 p.m. in the Town Hall Conference Room, 16 Lowell Street, Reading, Massachusetts. Present were Chairman Stephen Goldy; Vice Chairman Ben Tafoya, Secretary James Bonazoli, Selectmen Camille Anthony and Richard Schubert, Town Manager Peter Hechenbleikner, Assistant Town Manager/Finance Director Bob LeLacheur, Public Works Director Ted McIntire, Water Distribution Supervisor Peter Tassi, Town Counsel Gary Brackett and Office Manager Paula Schena. AGFA Litigation The Town Manager noted that the AGFA mediation is tomorrow. Town Counsel Gary Brackett indicated that he needs a range of settlement for mediation and authority to commit and sign agreement. He suggests payment of no less than $110,000 for repayment of clean up costs as outlined, and noted that AGFA has offered $46,000. Selectman Richard Schubert asked if the $134,000 includes staff time and legal expenses, and the Town Manager indicated that it does. Chairman Stephen Goldy noted that the hard costs are$114,000 to cover all the invoices. A motion by Bonazoli seconded by Anthony to grant settlement authorization to Town Counsel and to the Town Manager in the amount of not less than $115,000, in the pending mediation between the Town of Reading and AGFA related to the contamination of the Revay well and the recovery of expenses related thereto was approved on a roll call vote with all five members voting in the affirmative. A motion by Bonazoli seconded by Anthony to adiourn the Executive Session,meeting of March 17, 2009 at 7:25 p.m., was approved on a roll call vote with all five members voting in the affirmative.
