Executive Session
October 7, 2008
The Executive Session convened at 7:02 p.m. in the Town Hall Conference Room, 16 Lowell
Street, Reading, Massachusetts. Present were Vice Chairman Ben Tafoya, Secretary James
Bonazoli, Selectmen Camille Anthony and Richard Schubert, Town Manager Peter
Hechenbleikner, Assistant Town Manager/Finance Director Bob LeLacheur and Office Manager
Paula Schena.
Litigation
The Town Manager noted that AGFA proposes a $45,000 settlement but the Town'has out of
pocket expenses of approximately $130,000. The memo from Gary Bracket suggests asking for
a counter proposal of$120,000 and one half day of mediation.
Selectman Camille Anthony asked if AGFA is cleaning up, and the Town Manager noted that the
contaminate is in bedrock and will eventually clear up through dilution. Selectman Anthony
noted that $120,000 is too low, and we should include staff time and legal fees. The Town
Manager noted that he thinks the legal fees are included in the$130,000 but he will check.
The Board indicted-that-theywant-to recover the full cost-of-what the-Town paid-out.
Health Insurance
The Town Manager noted that the Town had a consultant study done. The PEC is not interested
in the GIC at this time. MIIA has a GIC look'alike and they are meeting with the PEC tomorrow
to look at that.
A motion. by Anthony seconded by Schubert to approve the 'Executive Session Minutes of
September 9, 2008, as amended, was approved on a roll call vote with all four members
voting in the affirmative.
A motion by Anthony seconded by Schubert to adjourn the Executive Session Meeting of
October 7, 2008 at 7:30 p.m. was approved on a roll call.with all four members voting in
the affirmative.
